In a victory for employers and the Trump administration, the Supreme Court on Monday said that employers could block employees from banding together as a class to fight legal disputes in employment arbitration agreements.Justice Neil Gorsuch delivered the opinion for the 5-4 majority, his first major opinion since joining the court last spring and a demonstration of how the Senate Republicans' move to keep liberal nominee Merrick Garland from being confirmed in 2016 has helped cement a conservative court."This is the Justice Gorsuch that I think most everyone expected," said Steve Vladeck, CNN contributor and professor of law at the University of Texas School of Law. "Not only is he endorsing the conservative justices' controversial approach to arbitration clauses, but he's taking it an important step further by extending that reasoning to employment agreements, as well."Justice Ruth Bader Ginsburg took the rare step of reading her dissent from the bench, calling the majority opinion in Epic Systems Corp. v. Lewis "egregiously wrong.""The court today holds enforceable these arm-twisted, take-it-or-leave-it contracts -- including the provisions requiring employees to litigate wage and hours claims only one-by-one. Federal labor law does not countenance such isolation of employees," she said.In the majority opinion, Gorsuch maintained the "decision does nothing to override" what Congress has done."Congress has instructed that arbitration agreements like those before us must be enforced as written," he said.As the dissent recognizes, the legislative policy embodied in the (National Labor Relations Act) is aimed at 'safeguard[ing], first and foremost, workers' rights to join unions and to engage in collective bargaining," he wrote. "Those rights stand every bit as strong today as they did yesterday."Gorusch, responding to Ginsburg's claim that the court's decision would resurrect so-called "yellow dog" contracts which barred an employee from joining a union, said that "like most apocalyptic warnings, this one proves a false alarm."The case was the biggest business case of the term, and represented a clash between employers who prefer to handle disputes through arbitration against employees who want to be able to band together to bring their challenges and not be required to sign class action bans.It also pitted two federal laws against each other.One, the National Labor Relations Act (NLRA), gives employees the right to self organization to "engage in concerted activities for the purpose of mutual aid or protection" the other, the 1925 Federal Arbitration Act (FAA) allows employers to "settle by arbitration."Lawyers for employers, who have long backed arbitration as a means of resolving disputes, argued that class action waivers are permissible under the 1925 law. They say the NLRA does not contain a congressional command precluding enforcement of the waivers.The Trump administration supported the employers in the case, a switch from the Obama administration's position.  3034

In 2020, buying or selling a home has become quite tricky. Experts in the real estate industry are seeing a new trend: purchasing homes without ever stepping foot in them. "We've found ourselves in a really, really interesting situation right now with coronavirus. And also, dealing with a super low inventory across the country," said David Lewis, a realtor in the Atlanta area. Lewis says for those who are relocating, COVID-19 wariness may prevent potential buyers from seeing a property in person. Plus, traveling can be difficult right now."A lot of times, some of them we’re videoing the home for them and some of them are just looking at the pictures and submitting blind offers and just hoping, trusting us to give them a little bit of guidance and also making sure the inspections and things are in line to offer that level of protection," said Lewis.Experts say, when buying virtually, a good home inspection is a must. "It should catch most everything. Now remember, a home inspection is a visual inspection. We’re not allowed to take siding off a house, we see trim damage then that's what we see. We can’t take a look between that wall," said Donny Williams, the Director of Business Development and Marketing for All Atlanta AmeriSpec.Overall, he doesn't recommend buying a home without going inside it first, but he and many other inspectors at his company are seeing it more often now. "I was actually surprised the number of times it actually happened. The guys could remember seven to 15 times each. Times that by 18 guys and that's a lot," said Williams.Before the pandemic, Williams says he rarely would see people purchase homes sight unseen. But as long as contracting the coronavirus is a concern, home buying virtually could be here to stay. Just know that if you are thinking of buying a home this way, there are things a realtor won't be able to fully give their opinions on, such as the neighborhood."That's something that is always largely on the purchaser. There’s several laws and regulations around what a real estate professional can share and information they can give on a neighborhood. So, a lot of times that's always up to the consumer, anyways, right, to get a good feel for the neighborhood or understand the dynamics or school or surrounding area," said Lewis.Overall, make sure before you swipe right to buy a home, meet it first, if at all possible. Having a realtor and inspector you trust is key. Though, what they won't be able to help you with is if the house feels like your home. 2535

  

IMPERIAL BEACH, Calif. (KGTV) - A member of the migrant caravan was arrested in Tijuana on suspicion of throwing rocks over the U.S.-Mexico border fence toward contractors working on the wall.The incident happened about 1:30 p.m. Thursday, Dec. 6, as crews were in the Imperial Beach area. The contractors left and agents arrived to provide security, Customs and Border Protection officials said. No contractors or agents were hit and the wall was not damaged, according to the CBP.When the man threw another rock across the border, agents alerted Tijuana Police to arrest him.CBP said the man was a 27-year-old Honduran national. Mexican officials said he would be turned over to immigration authorities for deportation. 729
