(KGTV) – The company that operates Rubio’s Coastal Grill restaurants has filed for bankruptcy protection, citing the COVID-19 pandemic as one of the reasons for its decision.Reuters reported Monday that the Carlsbad-based company filed a restructuring plan that includes a plan to reduce its debt.The company confirmed in a statement that it “filed a prepackaged plan with the acceptance of its lenders, and voluntarily filed petitions for protection under Chapter 11 of the U.S. Bankruptcy Code in the United States Bankruptcy Court for the District of Delaware.”Additionally, Rubio’s said they expect “to complete its restructuring by the end of the year." The company has 47 locations in San Diego County and more than 1,000 local employees."It was COVID that got us here, a very extraordinary situation, such as that we find ourselves in this position," co-founder Ralph Rubio said in an interview. "The great news is all of our restaurants are open, everybody is still employed, we're still operating just as we were before."Marc Simon, president and CEO of Rubio’s, said: “Rubio’s entered the year in a strong financial position, which has helped the Company remain flexible in navigating the unprecedented impact of the pandemic. The agreement with our sponsor and lenders will position the Company to thrive in this constantly evolving market. This plan will strengthen our finances and allow us to continue to serve our loyal guests and drive our business forward.”Rubio added, in a company statement: “COVID-19 has had a significant impact on Rubio’s, like most businesses, and I’m proud of how we have responded to the challenge. Our investments in critical digital technologies in 2019, including online ordering, a mobile app, a new loyalty program and Rubio’s delivery, allowed us to pivot swiftly under varying state and county restrictions. We quickly launched family meal kits and shifted to takeout, curbside pickup and free delivery operations, allowing our guests to enjoy our delicious food when and where they want it. This restructuring plan creates the long-term financial stability we need to continue to serve our communities for years to come.”Despite the bankruptcy filing, company officials said all of its more than 150 locations in Arizona, California, and Nevada will continue to operate as normal. Rubio told ABC-10 that sales plummeted in the first two months of the pandemic, but have since recovered to just single-digit percentages off from last year's sales. Legal filings show Rubio's has million to 0 million in assets, but 0 million to 0 million in liabilities.The company permanently shut down 26 locations in Colorado and Florida due to “this year’s unforeseeable business circumstances.” Those locations had been temporarily closed at the onset of the pandemic.Rubio’s, known for its fish tacos, first started as a taco stand in Mission Bay in 1983. 2914

A 20-year-old man with Down syndrome was carrying a toy gun when he was shot dead by Swedish police in Stockholm on Thursday, according to CNN affiliate Expressen.Eric Torell was diagnosed with both autism and Down syndrome and could not verbally communicate, his mother told Expressen.Torell's family reported him missing after he ran away from home, something he had been known to do before. He had a plastic toy gun with him, which "looked a little like a submachine gun" and was given to him as a gift, said his mother, Katarina S?derberg.Early Thursday morning, the police received reports of a person with a gun in the Vasastan district. After arriving on the scene, they shouted at Torell to "lay down his weapon and lie on the ground," an eyewitness told Expressen.Police officers are then believed to have fired at Torell, according to Expressen. Torell was taken to the hospital, but could not be saved.When S?derberg was first notified of her son's death, she said: "There's got to be a mix-up."She was "totally, totally devastated," she told reporters in her home, as she showed them photos of Torell. "I couldn't understand that it was true, I still can't believe that it is true."She and Eric's older sister, Elsa, were nearly paralyzed by the news, S?derberg said. Why, she asked, did the police officers have to shoot? And why did it have to be a fatal shot, instead of one to the leg?"Even if he made a mistake, even if he went outside with a pistol thing, a toy gun, do they have to shoot him dead because of that? It was light outside," his mother said."You can see a mile away that he's got Down syndrome. It can't be missed," she said. "A 'threatening man'? (KGTV) — Is Democratic Gubernatorial candidate Gavin Newsom avoiding the debate stage? That's the accusation from Republican rival John Cox who says Newsom has agreed to only one debate thus far, despite several opportunities being offered.Newsom tells 10News he has already been part of four debates with Cox but critics point out that was during the primary campaign with other candidates sharing the stage.Newsom tells 10News he prefers meeting with people at town halls where there's more time for interaction with the audience and less grandstanding.RELATED: Gavin Newsom, John Cox to face off in November General Election"Candidly, the last three out of four of our debates, looked like Jerry Springer shows than substantive dialogue," said Newsom. But political analyst Kevin Riggs says its no surprise Newsom is shying away from debates at this point in the race."He's ahead in the polls, he's ahead in the fundraising, at this point his campaign is an exercise in risk management," said Riggs. "His campaign is going to look at this invitation and say, 'What's in it for us?' and the answer is, not much."Riggs says every time Newsom puts himself side by side with Cox, he raises his opponent's profile and gives him a chance to gain ground."Cox needs the exposure," said Riggs, "He needs to be on the same stage with Gavin Newsom."Which is why, says Riggs, the Cox campaign has agreed to multiple debate offers, while Newsom has so far declined or not responded to all but the one offer from CNN.So what can Cox do about it?  Riggs says, "If you're John Cox you try and shame your opponent and try and talk about the fact you are ignoring voters, you're snubbing voters." The Cox campaign did release a statement this week, accusing Newsom of just that, saying he doesn't want to talk about the issues Californians care about. The two are set to meet for the first — perhaps only — one-on-one debate Oct. 1 on CNN. 1967

  

A 7-year-old Guatemalan girl died last week, hours after she was taken into Border Patrol custody, the Department of Homeland Security said.The Washington Post first reported Thursday that the girl died of dehydration and septic shock last week in El Paso, Texas after she was taken into custody by Border Patrol after crossing illegally with her father into the United States."Our sincerest condolences go out to the family of the child," the Department of Homeland Security, which oversees Border Patrol, said in a statement."Border Patrol agents took every possible step to save the child's life under the most trying of circumstances. As fathers and mothers, brothers and sisters, we empathize with the loss of any child."The girl and her father were part of a large group of migrants who approached Border Patrol agents in a remote area of the New Mexico desert last Thursday, the newspaper reported, citing US Customs and Border Protection records.The child began having seizures hours after she was taken into custody and was airlifted to the Providence Children's Hospital in El Paso, CBP told the Post. 1119
