CHULA VISTA, Calif. (KGTV) - A Chula Vista mom says she was left holding the bag when her son's school wouldn't let her drop of her his lunch, which was needed for medical reasons.Adriana Escodbedo says the fruit, veggies, and turkey sandwich she packed for her 13-year-old son Danny on Thursday served a purpose. Early that morning, he was at the hospital getting an injection for a medical condition. Though he had some food afterward, his lunch period at Eastlake Middle School wasn't for another six hours."It's recommended they have something in their stomachs if they're getting injected with this medication," said Escobedo.RELATED: Parents concerned with short lunch times at San Diego Unified schoolsAfter Escobedo dropped him off at school, she discovered that Danny - for the first time ever - left his lunch in the car. Hours later, she went back to the school to drop it off and went to the main office."I let the two women in the office know that he took medication that day," said Escobedo.Escobedo say she wasn't allowed to drop off the lunch, but could set up an account in the cafeteria. Escobedo declined, as Danny has food sensitivities."As a mom, I just felt so frustrated. Are you kidding me? She checked her son out of the school, walked off campus, handed him the lunch, and then checked him back into the school.10News reached out to the Sweetwater Union High School District. A spokesperson says the policy is spelled out in the school handbook. The years-old policy came about because too many lunch drop-offs ended up sapping school resources and creating concerns about food spoilage. The district says there are exceptions - including medical reasons - but in this case, Escobedo didn't bring up the health issues, which she says is not true. She says staff should be trained to know the policy and any exceptions."As a mom you just want to do what's best for your child," said Escobedo.The district spokesperson tells 10News:"the front office staff will make an exception based on the situation and only on a limited basis ... the staff members who spoke with the parent said that they offered to call the student out of class so that they could give the student their lunch. The parent did not seem pleased with the responses she was being given and left. Had the parent asked for more clarification, or asked to speak with a school administrator, we could have very easily resolved this matter. Our staff also said that the parent made no mention of health/dietary issues, because again, this would have enabled staff to make an exception in this case.Nutrition is vital to student success which is why we offer a variety of options and all of them healthy and meet state nutritional guidelines. Even if a student does not have an active account, our school never deny a student a meal and the meals we provide would be the same as for a student with an active account ... If parents do have a medical/dietary concern, we ask that they let us know. A meeting with either the school nurse or one of our assistant principals establishes this and we can go forward in a positive way." 3297

CHULA VISTA, Calif. (KGTV) -- Chula Vista Police are searching for a suspect following a deadly stabbing in Chula Vista in mid-July.According to police, the stabbing happened on July 18 around 10:17 p.m. on the 200 block of Rancho Drive.Officers were called to the scene after receiving a report of a stabbing in the area. When police arrived, they found the victim, 23-year-old Ariel Burquez, suffering from multiple stab wounds. The victim was pronounced dead at the scene.Police later determined that the victim and suspect, Raymond Lynde, 28, had an argument before Lynde reportedly pulled out a knife and stabbed Burquez several times.Chula Vista Police are currently trying to locate Lynde, who is on parole for an unrelated offense, police say.“A parole violation warrant has been issued for the murder of Burquez and Lynde should be considered armed and dangerous,” police said.Anyone with information is asked to call Crime Stoppers at 888-580-8477 or CVPD at 619-691-5151. 990

CHULA VISTA, Calif. (KGTV) — Four students at Montgomery High School were arrested Halloween Day during a state-mandated lockdown drill at school. The arrest is causing controversy, and many are now questioning the decision to carry out real arrests during a drill. It was a short 15-minute drill. No one in, no one out. “The whole school was on lockdown and everyone was in their classes. And we had to stay inside because cops came,” student Ernesto Miranda said. Police presence during a lock down is protocol. However, this time, four students were taken away in cuffs. Some are now criticizing San Diego Police officers’ unusual arrest strategy, accusing the department of suing the drill as a ruse to arrest the students under investigation. “It shouldn’t be, like use the lockdown as an excuse to OK, bust down these kids,” student Derek Uribe said. 10News spoke to Sweetwater Union High School District spokesman, Manny Rubio, who told us over the phone, this is the first time the district has ever agreed to cooperate in this kind of arrest. Montgomery High School’s state-mandated lockdown drill was planned for Tuesday, Nov. 13. But on Oct. 29, Rubio said SDPD requested the district to move the drill up sooner, because they urgently needed to make an arrest on campus. The school agreed. They immediately notified students and parents that there would be a drill sometime that week, before noon. Two days later, Rubio said the school carried out the drill. During the 15-minute drill, school stage brought each student in question into the office, where they were arrested by San Diego Police. Rubio said the school made sure to minimize the effects onto the 1,800 students and 100 staff, making the arrests away from classrooms. "I want to be a cop so I think it's smart to not make it a big deal and come in and everything. Just [during] a lockdown drill,” Miranda said. The police department, the school district, nor the District Attorney’s office would specify the exact charges the students face. But Rubio said they allegedly committed multiple violent crimes throughout the county that were, “incredibly severe in nature.”10News asked SDPD a number of questions, including why the students were not arrested at their homes, and why they waited two days before arresting them. CHULA VISTA, Calif. (KGTV) -- The forward rate of spread has been stopped after a fire sparked near a canyon in Chula Vista Thursday evening. The fire started around 5 p.m. in a canyon on the 400 block of Agua Vista Drive. It is in a residential area near the San Miguel Mountain Trailhead.Video from the scene showed white smoke billowing from the canyon. (KGTV) - State investigators have cited an in-home daycare in Bonita for feeding melatonin to children.10News learned a criminal investigation is underway into Brenda Saucedo Family Child Care. The daycare has had a license since 2007, according to the California Department of Social Services.6-year-old Julius had been at his new daycare for two weeks when he was put down for his first nap time in early August. Julius says he was handed a red drink with white flakes in it."I thought it was Gatorade but it didn't taste like Gatorade," said Julius.Julius drank it all."They told me to lie down, and I fell right asleep," said Julius.When he awoke, he still felt sleepy. After he told his family, his mother Vanessa Cherry says a complaint was filed with the state's Child Care Licensing Program, sparking a surprise inspection. Weeks later, she received their report."I felt angry. I felt like I let my son down. You feel betrayed," said Cherry. Based on interviews and documentation like text messages, state investigators cited the daycare for "providing Melatonin to the daycare children to alter their behavior and/or help them sleep." A spokesperson with the California Department of Social Services says "the licensee told CSDD staff that she administered melatonin to school-age children and melatonin was found on the premises.""How dare you give my kid something without telling me without my acknowledgement ... you don't have the right," said Cherry.Cherry filed a report with deputies, who started an investigation.Melatonin is a natural supplement used as a sleep aid. Possible side effects include dizziness and nausea. There have been a handful of recent criminal cases across the country involving daycare providers and melatonin. Three daycare providers in the Chicago area were charged with giving children melatonin gummy bears before nap time. In Oregon, a woman sentenced to 21 years for feeding melatonin to kids while she went to a tanning salon and the gym. Some of those kids now complain of problems with their sleep cycles.When 10News knocked on the door of the daycare, a woman identifying herself as the owner told us the only child she fed melatonin to is her own child because he has autism. As for Julius, she told 10News she didn't put anything in his drink. When pressed on the specifics of the licensing division report, she said, "I don't want to comment on that any more.""They should be shut down. Your child should be safe in a place you entrust with their safety. This is a parent's worst fear. Someone is giving something to your child without you knowing," said Cherry.Anyone with information on the case is asked the call the San Diego Sheriff's Department Imperial Beach station at 619-498-2400.Cherry says she is planning on filing a lawsuit against the daycare provider.The California Department of Social Services issued the following statements in response to our questions: "The licensee told CDSS staff that she administered melatonin to school-age children, and melatonin was found on the premises. The licensee was informed that this was a violation of state licensing regulations and must cease. She agreed to end the practice, and stated that she understands the danger of administering melatonin and that she will not do so again ... The licensee must post a copy of the complaint investigation report on site, provide a copy to the parents/guardians of children in care at the facility, and provide a copy to parents/guardians of all newly enrolled children in the next 12 months. She also agreed to review educational materials on children’s personal rights in child care, as set forth in state regulations, and provide a summary of the material to the analyst assigned to the case. If this corrective action is not completed, the facility may be subject to civil penalties. In addition, because of the seriousness of the incident, the licensee will be required to attend a follow-up meeting with CDSS staff to discuss the incident and any other concerns about the facility’s compliance with regulations. Such meetings may lead to additional licensing action.The inquiry conducted by CDSS found no evidence of injuries or complications to the children.CDSS takes the allegations in this case seriously. The Department cannot confirm or deny the existence of an investigation.
