A man shot by a Cuyahoga County, Ohio Sheriff's deputy near Cleveland on I-90 on Thursday has died.The medical examiner identified the man as Brett Luengo, 33, of Westlake, Ohio. He was transported to MetroHealth Medical Center where he was treated, expired and pronounced dead last night. Luengo was a prominent businessman who was the CEO and Vice President of ConstructAbility Inc., a construction services firm in Westlake.The Hispanic Chamber of Commerce awarded ConstructAbility with an award in 2017.The shooting took place along Interstate 90 near West Boulevard Thursday evening.The scene led to a major police presence and traffic back-up in the eastbound lanes between West 44th Street and West Boulevard.The deputy involved was not injured.Witnesses say the incident started after a single-vehicle crash. The driver then got out of the SUV and was acting both erratically and violently to those trying to help him. Authorities say he was involved in an altercation when the deputy exited his own vehicle. When the deputy approached, the sheriff said Luengo "charged (the deputy) in an aggressive manner.""He kept screaming to shoot him. The cop kept asking him to roll over, put your hands behind your back. The man was not cooperating. He kept trying to get up and attack the police officer, he kept lunging at him," witness Jason Geiger said. "I think what happened at that point he ran out of taser cartridges because at that point he shot the guy."Authorities say the deputy fired one shot. A federal appeals court on Friday overturned the death sentence of Dzhokhar Tsarnaev in the 2013 Boston Marathon bombing. The three-judge panel of the 1st U.S. Circuit Court of Appeals in Boston issued the decision more than six months after arguments were heard in the case. Tsarnaev’s lawyers had argued that intense media coverage had made it impossible to have a fair trial in Boston. The April 15, 2013, attack killed three people and injured more than 260 others. Tsarnaev was convicted on 30 charges, including conspiracy and use of a weapon of mass destruction. 577

A golfer in Colorado is recovering after being gored by an elk over the weekend, splitting one of his kidneys.Zak Bornhoft was at Evergreen Golf Course about an hour west of Denver on Saturday evening. He and his friends saw dozens of elk near the course and thought they would be safe if they kept their distance, according to reports.He tells local media the large elk charged at him while he sat in a golf cart near the 17th hole. The person driving the cart brought him to the clubhouse to get help.The Elk’s antler sliced his left kidney in two. Bornhoft was rushed to the hospital, and treated in the ICU. He is reportedly making a good recovery.Elk are allowed to roam freely in the area of the course, and wildlife officials say attacks on golfers are rare. 773

A Detroit 2-year-old born with Spina Bifida has defied the odds and taken her first steps without a walker.A video, which has been shared thousands of times on Facebook, Skylar Turner taking her first steps into her father's arms without her walker.Shawn and Unissa Turner say Skylar is beating the odds and proving to everyone that she will walk."It was amazing," Shawn Turner said. "It was unreal because this is the moment you always wish for."At just two years old, Skylar has already endured more than most girls her age."When you’re told that your child has a birth defect before they come out, it changes your whole outlook on life," Shawn Turner said. Spina Bifida is a birth defect where the spinal cord doesn’t fully develop, making it difficult for those affected to walk.At first, Unissa Turner took Skyler's diagnosis really hard, and says she still tends to blame herself."I do still feel that it’s my fault, but I know it’s not," she said. "But, I definitely took it really hard."A determined toddler, Skylar wasn’t going to let her condition stop her from taking her first steps, or even dancing. She loves Taylor Swift and dances when one of her songs is on.The special moment of Skylar trying to walk to her father, not once, not twice – but three times, until eventually making it into his arms was all caught on camera. A Detroit nonprofit says it was denied service because of the city it's located in.Franklin Wright Settlement has been in business for more than 134 years on the east side of Detroit, and says a bounce house company would not deliver to the city because of safety issues.Deon Mullen, director of the Franklin Wright Settlement, said he tried to rent a bounce house for an annual event for kids, but says Awesome Bounce in Canton told him no."I was quite surprised," he said.Awesome Bounce sent Mullen an email saying the company does not service Detroit because of employees being robbed and equipment being stolen and damaged in the past. Mullen said he was offended by the email and said not all of Detroit is dangerous. He said he feels the owner's decision is bad business.Mullen said he is most upset at a certain part of the owner's response, where he states he feels sorry for the deserving children who were born into one place and not another. He also doesn't feel that the issue of safety is a valid excuse."It can happen anywhere," Mullen said. "In any suburban community, crime can happen."The owner offered to sell Mullen a used bounce house.Mullen said he understands a businessman's concerns about employee's safety, but labeling all of Detroit as bad was something that didn't sit well with him. 1339
