SAN DIEGO (KGTV) - An oft-deported immigrant who was charged in a DUI, hit-and-run crash that injured a young boy in the South Bay will not be tried for the third time.A judge ruled Friday to dismiss the case against 39-year-old Constantino Banda Acosta. Banda was charged with driving under the influence and fleeing the scene of a hit-and-run on Camino de la Plaza in San Ysidro on May 6, 2017.Investigators said Banda ran a stop sign and crashed his pickup truck into the Lake family’s Honda Accord, as they were heading home from Disneyland. SAN DIEGO (KGTV) — A staff member at West Hills High School has tested positive for COVID-19, according to Grossmont Union High School District.The families of 23 students in classes affected by the positive test have been notified and will not participate in in-person classes for 14 days, according to GUHSD PIO Catherine Martin.Those students will continue their instruction virtually during that time, Martin added. All other West Hills students will continue their in-person or distance learning classes as scheduled.In a letter to parents, West Hills High principal Robin Ballarin said after reviewing the positive test with public health officials, there is no need to close the school for in-person learning."We have cleaned and disinfected, as appropriate, and our campus has been deemed safe for occupancy. We understand that this information is concerning. Staff members and students who may have come into close contact with the individual will be directly contacted by San Diego County Public Health with further instructions. SAN DIEGO (KGTV) - A Seattle hiker arrived in San Diego over the weekend, where he'll begin a 2,600-mile trek to raise awareness and money for Alzheimer's disease.Toby Gallier's family was first impacted by the disease four years ago when his mom's partner was diagnosed. Gallier's seen the toll it takes on both patient and caregiver.Gallier will be hiking the Pacific Crest Trail, a grueling five-month trek that will take him through desert, forest and mountains.He's raising money for "The Longest Day" fundraiser through the Alzheimer's Association - you can donate here.You can also follow along on his journey here, Gallier will be posting blog updates whenever he can find WiFi.On Monday the San Diego/Imperial Chapter of the Alzheimer's Association greeted and thanked Gallier for his commitment to this cause. 827

SAN DIEGO (KGTV) — An autopsy report released on Trevor Heitmann, the teenager known as "McSkillet" on YouTube, is revealing details about what happened before he crashed his vehicle on Interstate 805.The report says Heitmann’s parents called the police to request a psychiatric evaluation stating, “On August 23, the decedent's parents contacted the local police department to request a psychiatric evaluation but were informed that the evaluation could not be performed as the decedent had not broken any laws."The statement means hours before Trevor Heitmann drove his car down the freeway killing two people, police were at his house.RELATED: Autopsy details mental state of McSkillet before deadly I-805 crash"Even though police are trained to identify mental health issues and mental illness issues they just can't take someone off the streets unless there is such conduct to warrant it,” said attorney Kenneth Rosenfeld.Rosenfeld, who has no connection to this case, explained law enforcement does have the ability to detain someone using the 51-50 law. It would allow someone to be involuntarily detained for a psychiatric hold for up to 72 hours.Conduct in many cases needs to be observed. Just saying someone is acting out of nature isn't always good enough.RELATED: YouTuber's family releases statement, offers condolences to crash victims“Police officers are not psychologists or psychiatrists,” he said. “They do their best, but usually when someone’s conduct or behavior is so erratic, that’s when they can factor into the idea that this is probably someone worth taking it.”Police dispatch logs show units arriving at the Heitmann home just after 8:00 a.m., Aug. 23, the morning of the crash.At 9:14 a.m., notes say, “based on statements from parents, there was no credible threat and Subject did not meet 5150 criteria. Parents advised if we went in house to ask subject if he would voluntarily go to hospital, subject may become violent. We did not encounter subject.
