OCEANSIDE, Calif. (KGTV) — Police say a Navy veteran who was sentenced last year to nearly a decade in prison for abusing his neighbors' dogs may be released early because of the pandemic.David C. Herbert was convicted in 2018 and sentenced last year to nine years and eight months in prison on six counts of animal cruelty, one count of burglary and four misdemeanor counts of vandalism for harming two separate families' dogs, one of which remains missing.Oceanside Police say Herbert was scheduled for parole in February 2021 but could be released earlier under criteria set by the state because of the coronavirus.RELATED: Oceanside man who tortured neighbor's dogs sentenced to 10 years"Neither the Oceanside Police Department, the San Diego County District Attorney’s Office nor the victims were consulted prior to this decision being made, and the Oceanside Police Department does not have any involvement and/or influence in such a decision," the department said in a release.In April, California adopted criteria after the pandemic hit to protect those who work and live at prisons by issuing expedited releases for thousand of prisoners serving sentences for non-violent offenses, who do not have to register as a sex offender, and who had 60 days or less to serve.Three months later, the state expanded the criteria for thousands of offenders who had 180-days or less to serve; and hundreds who had less than one year to serve who reside at facilities with large populations of medically high-risk patients. (KGTV) -- An Oceanside man convicted of kidnapping and killing a 3-week-old baby girl and trying to kill the infant’s parents and uncle was sentenced to nearly 142 years to life in prison.Anthony Ray McCall, 32, was found guilty of first-degree murder, kidnapping and attempted kidnapping, along with four counts of attempted murder on March 2.A jury in Long Beach deliberated for less than three hours before returning with a verdict.A co-defendant in the case, Giseleangelique Rene D'Milian, pleaded no contest to first-degree murder for the murder of Eliza De La Cruz as well as for the attempted murders of the infant’s father and uncle.The woman was sentenced to 25 years to life in prison.Eliza’s body was found in a San Diego trash bin in 2015.Eliza’s mother said during testimony that she pleaded with McCall not to take her baby. "I couldn't do anything to stop him," Honorato said. OAKLAND, Calif. — A bust of Breonna Taylor was vandalized in Oakland, California.The Oakland Police Department is investigating after large pieces of the statue were found broken off sometime over the weekend, KGO and KTVU report.The sculpture was made by artist Lee Carson to honor the 26-year-old EMT who was shot and killed in her apartment by Louisville police officers in March. The deaths of Taylor, George Floyd and Ahmaud Arbery prompted countless people across the country to take to the streets over the summer to protest police violence against people of color.Carson told KTVU that he hoped the piece would energize the Black Lives Matter movement, which seeks to eradicate white supremacy and intervene in violence inflicted on Black communities.Carson told KGO that the vandalism felt like an attack on Taylor and those fighting against racial injustice.The statue is made of clay, concrete, wood and foam, and was reportedly installed in the downtown area this month.
