SAN DIEGO (KTGV)— A homeless man and convicted rapist accused of sexually assaulting a woman at an East Village bar in November faced his accuser in San Diego Superior Court. Gary Cushinberry, who's accused of multiple counts of sexual assault and attempted rape, pleaded not guilty. The judge ordered all media to conceal the victim’s identity, and to refer to her as Jane Doe. Jane Doe took the stand and recalled what happened on the evening of November 5th. She said she was at Amplified Kitchen and Beer Garden in East Village, celebrating with some colleagues.After having a few drinks, she headed to her car. She admitted she was drunk at the time, and her memory was hazy. But she did remember the moment her bottom touch the ground.“He was touching underneath the blanket, and I just remember being shocked. Uh, next he further proceeded to put his hand in my pants,” Doe said. While he attacked her on the ground underneath a dirty blanket, he tried to drug her with what she thought was a meth pipe, Doe continued. Detective Carlos Munoz of the San Diego Police Department also spoke in open court. After the case was assigned to him, he monitored surveillance cameras in the area. The detective found footage of a homeless man fitting Gary Cushinberry’s description, pulling Jane Doe into a bush next to her car. The two were not in frame for the next 25 minutes, until video captured Jane Doe speeding away from the parking lot, back into Amplified, where she later reported the assault.“It’s like you imagine a fight or flight. And I didn’t really fight and I didn’t flight. I just froze,” Doe said. Cushinberry, who is already a convicted rapist in Indiana, returned to the frame, just two minutes later. “When he walks up toward the intersection, or the corner, he is adjusting his belt, he is adjusting his waist,” Detective Munoz said. The next day, Jane Doe provided information for a suspect sketch.Officers also took her to Palomar Hospital to run a rape kit. DNA Criminalist Adam Dutra of the San Diego Police Department Crime Lab tested the DNA swab taken from the front button and zipper of Jane Doe’s shorts.“There was strong support for the inclusion of Mr. Cushinberry as the 98% contributor,” Dutra said. SAN DIEGO COUNTY, Calif. (KGTV)— With precipitation numbers up, participation numbers were down for outdoor events around San Diego County. But many who chose to endure the rain said it was worth the extra splash. It’s a rare sight in the heart of San Diego: kids sledding on a giant snowy hill at Montgomery Waller Park. For the Murillo family, it’s an annual tradition. “We go to see Santa Claus, we go to the little stores that they have there, and we come to sled down for a little bit,” mother Diane Murillo said. She and her children were bundled up while having fun at San Diego Snow Day. But this year, Murillo noticed that the crowds were much smaller. “It’s a lot smaller. It’s empty today. There’s actually parking,” Murillo laughed. She said the steady rain discouraged many folks from showing up. The City of San Diego even had to cancel Santa Claus’ helicopter fly-over of the park, due to inclement weather. Murillo also noticed that the snowy hill was very sludgy, and only about half its normal length. But by the looks of the children, the event was still worth it. Meanwhile, in the South Bay, there was a tent full of Christmas-themed games. From Candy Cane trees, ring tosses, to face paint, families enjoyed the free entertainment at the Chula Vista Children’s Faire. “It helps, because that way, we’re not getting wet while they are getting their stuff done and doing the activities. SAN FRANCISCO (AP) -- California wildlife regulators have postponed the start of the commercial Dungeness crab season to protect whales and sea turtles from becoming entangled in fishing gear.The Department of Fish and Wildlife announced Wednesday that it's pushing back the Nov. 15 start of the season to Dec. 1. The postponement affects fishing zones from Mendocino County north of San Francisco to the Mexican border.The San Francisco Chronicle says 50 humpback whales were spotted in one week last month off the coast of San Francisco and another 25 in the Monterey Bay area.The recreational fishing season will be allowed to open on Saturday. 655

SAN FRANCISCO (AP) — California regulators on Friday said marijuana deliveries can be made anywhere in the state, even in locales that ban cannabis.Law enforcement groups and the California League of Cities opposed the move, arguing that pot deliveries to places that ban cannabis erodes local government control and will increase crime in those areas.The matter has been one of the most debated issues as state regulators hammer out permanent rules for how marijuana is grown, tested, packaged and delivered.The delivery issue was included in regulations drafted by the Bureau of Cannabis Control, which issues most retail permits. The rules will become law in 30 days unless California's Office of Administrative Law objects. The dispute could end up in court.Recreational marijuana became legal in the state after voters passed Proposition 64 two years ago.The bureau has maintained that Proposition 64 allows for statewide deliveries. It added explicit language authorizing the practice after several law enforcement officials in anti-pot locales insisted they could arrest licensed deliver drivers in cities and counties that ban marijuana.The California Police Chiefs Association, League of California Cities and United Food and Commercial Workers Western States Council opposed statewide deliveries and launched an online petition campaign against the rule."Regulated marijuana dispensaries have tough security, checks for identity and legal age and strictly licensed workers," council executive director James Araby said in a statement. "If marijuana can be delivered anywhere with virtually no regulation, California will lose these safeguards."League of Cities spokeswoman Adrienne Sprenger said the agency was waiting to see if the Office of Administrative Law approves the proposal before deciding its next step.Supporters of statewide deliveries argued that sick and frail people in those areas who depend on marijuana to relieve pain or anxiety cannot make a lengthy drive for a purchase, so they are being shut out of the legal market.The proposal also included a ban on permit holders partnering with unlicensed operators, which industry supporters said will stifle growth.The bureau in its comments explaining the added rule said it's concerned about such partnerships doing business in the black market.California Cannabis Industry Association spokesman Josh Drayton said most California cities and counties have exerted local control and don't allow marijuana, making it impossible for a business such as a beverage maker or nutritional supplement manufacturer to partner with a legal marijuana operator.He said the bureau's stand against unlicensed operators went too far and will hurt the nascent industry by unintentionally preventing such things as non-licensed celebrities endorsing products and other deals not directly involving marijuana."The industry has slowed down enough already without this added hurdle," Drayton said.The California Department of Food and Agriculture, which regulates farmers, also released its draft regulations which would continue to allow farmers to receive an unlimited number of permits to grow pot. 3163
