SAN DIEGO (KGTV) - On Monday, concerns were raised and the release of police body camera video was requested after San Diego police officers reportedly shot a man on Sunday after they arrested him. Police say he managed to get out of his handcuffs and accessed a police gun after he was left in a patrol vehicle.On Monday, SDPD Lt. Andra Brown told 10News that officers were called to the Westgate Hotel on Sunday night for a report of a man who threatened security workers. After officers reportedly took in the 25-year-old Hispanic man, they say he slipped out of his cuffs while in the patrol unit.“It does happen but you know there's a tricky line to walk between having the handcuffs too tight where they can't come off but that also means that they can cause damage to a person that's under arrest and that's not our goal,” said Lt. Brown.She added that the suspect then reportedly broke a divider in the vehicle and grabbed a backup gun from an officer's gear bag that was in another area of the vehicle, all while he was alone in the vehicle and officers were away to process paperwork. “They were in the area of the vehicle. It's not like they were hundreds of yards away. They do maintain visual contact and there are other officers that are in the area,” she told ABC10 News.Once officers noticed, police say he fired a least one round after refusing their commands to drop the gun. They report that they fired back and struck him in the torso, but they say he still got out of the car with the gun and ignored their commands. Officers say a police canine then took him down.Community activist Tasha Williamson said Monday that the suspect should never have been left alone. “It’s not safe for the individual who has been arrested and not safe for the officers who are leaving them in the car with weapons,” she added.She's been demanding the release of body camera video within 24 hours of the shooting, like police did last week after rounds were fired with a robbery suspect.A police spokesperson said Monday that the release of the video will take longer in this case but the department is working hard to get it out and hopes to have it released within a couple of days.“[That’s] not sufficient and what that's telling the public is that when there’s no public outcry, they'll take their time at releasing the video,” added Williamson.The suspect was taken to the hospital with non-life-threatening injuries.SDPD is investigating the officer-involved shooting. SDPD says once its investigation is completed, it will be reviewed by the San Diego County District Attorney’s Office to determine if the officers bear any criminal liability for their actions. Police say the Internal Affairs Unit will conduct an investigation to determine if there were any policy violations, and the Shooting Review Board will evaluate the tactics used by the officers before the Community Review Board on Police Practices reviews the incident. Police say the FBI and U.S. Attorney’s Office will also be monitoring the investigation.The three officers who were involved are on paid administrative leave during the investigation, which is standard protocol. 3161

SAN DIEGO (KGTV) - One driver was arrested after video of a road rage incident in Oceanside made its way into CHP's hands.Two drivers, one in a gray Ford Explorer and the other in a gray BMW convertible, were involved in the February 15 incident on eastbound State Route 78 in Oceanside, according to California Highway Patrol officers.Officers responded to a report of a non-injury, hit-and-run collision just before 4:30 p.m. near the College Blvd. exit. Officers arrived and found the Explorer on its side on the center median while the BMW reportedly fled.RELATED: Road Rage Crisis: Violence on the RiseWhile investigating, officers were made aware of a video recorded by a witness.The video showed the driver of the BMW, identified as 33-year-old Kevin McCall, left his vehicle to berate the driver of the Explorer, identified as 23-year-old Andrew Branch, who was still inside his vehicle, according to CHP.Officers said McCall spit at Branch before returning to his BMW. Branch is then seen driving into the center median and accelerating into the BMW, narrowly missing McCall.Sideswiping the BMW caused the Explorer to overturn onto its side. McCall then drove away, officers said."It was pretty shocking. It was pretty shocking," said CHP Officer Mark Latulippe. Thursday, crews from Big Trees Nursery began removing dozens of trees from the property."I couldn't believe it," neighbor Brian Edmonston told 10News. "I thought it was outrageous and it was a cruel thing to do."In 2017, owner Michael Schlesinger backed a ballot measure which would have allowed him to build more than 100 condos on the land.  The day after Poway voters rejected the plan, Schlesinger closed the club.Poway City Councilmember Barry Leonard told 10News that because the land is private property and the trees being removed are not "native trees", Schlesinger is within his rights to remove and sell the trees.Leonard also said that because Schlesinger terminated water service to the property, he would rather see the trees removed than die. 908

SAN DIEGO (KGTV) — More than 0,000 went missing from New Hope Friendship Baptist Church in 2008 and 2010, according to new Sheriff’s Department investigation report Friday.The investigation was an Internal Affairs probe into Lt. Devera Scott. Scott was also the treasurer for New Hope Friendship Baptist Church during the time the money went missing.The report claims Scott admitted to church officials she took the money. However, the church told investigators they did not want to press charges as Scott had promised the church she would it pay it all back through monthly payments, and a portion of her retirement.The church also told investigators they were in the business of forgiveness and did not want to ruin Scott’s career, according to the documents.Investigators also learned that Scott made the church a beneficiary to a 0,000 life insurance and accidental death and dismemberment insurance policy.The internal investigation became public Friday, following the ruling of a San Diego judge. The decision comes after local media, including 10News, sued to keep police unions from blocking departments from releasing records related to officer misconduct.The San Diego Sheriff's Department was not part of the suit and has been releasing cases pursuant to SB1421, according to sheriff's department Lt. Karen Stubkjaer.Scott retired from the sheriff’s department on March 22, 2013, before the investigation into the missing church money was complete according to the documents. No charges were ever made against Scott.Other court filings suggest Scott might have been facing financial problems at the time.10News reached out to the church for comment.
