SAN DIEGO -- The San Diego Planning Commission advanced a plan Thursday that would make the Midway District more vibrant by adding housing, commercial projects and parks.The plan would grow the area’s housing from 2,000 to 11,000 over the next 20 years. Business development in the area would also generate a similar number of jobs.The district would also boast nearly 30 acres of parks. "We think it's an important opportunity to provide for the park needs of the community," project manager Vickie White said.The parks would all fit into an improved pedestrian and bile network that would make use of existing transit infrastructure. The city hopes the network would reduce the area’s reliance on cars."We're focused on creating comfortable connections along transit corridors to make this a more appealing area to walk or bike -- we see a lot off opportunities for modal increase in this area," White said.Reducing reliance on cars also complies with a citywide climate action plan. "If there's one real, glaring problem with this community it's a lack of connectivity from district to district," Commissioner William Hofman said.The area around sports arena and Valley View Casino Center would also get additional streets and paths.The plan includes a variety of possibilities for the sports arena including operating it as is or demolishing it and pushing for other land-use opportunities.The plan will now go to the City Council’s Smart Growth and Land Use Committee in May. 1493

SAN DIEGO (CNS) - A bicyclist riding with a group of cyclists was seriously injured Saturday when he was struck by a motorcycle in Pacific Beach, police said.The collision happened at 3:14 p.m. Saturday at the intersection of Ingraham Street and Reed Avenue, according to Officer John Buttle of the San Diego Police Department.A 23-year-old man riding a 2017 Harley Davidson Sportster was southbound in the 4200 block of Ingraham as a group of cyclists were eastbound in the 1500 block of Reed Avenue, Buttle said.The cyclists entered the intersection and the motorcycle struck one of them, a 49-year-old man, the officer said.The motorcyclist suffered road rash to his right leg, Buttle said. The bicyclist suffered a broken left femur and broken ribs. Medics took the cyclist to a hospital.Officers from the SDPD traffic division were investigating the collision, Buttle said.Ingraham was closed in both directions at Thomas and Oliver avenues and was expected to last a couple of hours, the SDPD said. 1012

SAN DIEGO (CNS) - A former paralegal specialist for the San Diego division of the FBI was sentenced Monday to 24 months in prison for embezzling nearly 0,000 in government funds.Lynn M. Morris, 56, who pleaded guilty in March to one count of embezzlement of government property, was also ordered by U.S. District Judge Larry Burns to pay 8,000 in restitution."Lynn Morris capitalized on her position at the FBI to line her own pockets with stolen government funds," said Assistant Attorney General Brian A. Benczkowski of the Justice Department's Criminal Division. "This conviction demonstrates the Department of Justice's commitment to investigating and prosecuting government employees who abuse their authority. Individuals who violate the public trust will be held accountable."Between July 2014 and November 2016, Morris embezzled 9,821 that belonged to the United States and converted the funds for her own personal use, according to documents submitted in connection with her plea.The funds were in an account owned by the FBI San Diego Division's Asset Forfeiture Unit, where Morris was a paralegal specialist and the AFU's designated coordinator.The court found that Morris also embezzled ,010 from an additional AFU account and stole ,351 from FBI evidence rooms.Morris admitted that to convert government funds to her own use, she used her knowledge and position within the FBI to withdraw cash from the AFU's account undetected and deposited portions of the stolen proceeds into her personal checking account. 1545

SAN DIEGO (CNS) - A former La Jolla Country Day School teacher pleaded guilty Thursday to having sex with a 17-year-old female student and faces up to one year in local custody.An Oct. 21 sentencing date is scheduled for Jonathan Sammartino, 37, who also could face lifetime sex offender registration and be prohibited from teaching again at any school.San Diego County Superior Court Judge Charles G. Rogers, who took Sammartino's plea to a felony count of unlawful sexual intercourse with a minor, said he was "not inclined" to impose sex offender registration, but still might do so at the sentencing hearing.As part of the plea agreement, felony counts of oral copulation of a minor and digital penetration of a minor were dismissed.Sammartino, the son of U.S. District Judge Janis Sammartino, remains out of custody, pending the sentencing hearing.The victim, identified only as "Jane Doe" in court proceedings, testified earlier this year at Sammartino's preliminary hearing that the first sexual encounter happened in the early part of 2016, when he arrived at her home unannounced around midnight. She said she went outside to meet with him in his car, at which point he told her he didn't trust himself around her.Sexual encounters occurred that night in his car and on several other occasions in his vehicle and his house over the next few months, she testified.The victim, who went on to attend UC Berkeley, filed a report with campus police in the summer of 2018. Charges were filed later that year.In a recorded phone call played during the preliminary hearing, Sammartino admitted to the past encounters with the victim."Why did you do it? You knew I was 17," Doe says on the recording. "You knew I was your student. You knew it was my first time and I lost my virginity to you.""I don't have a good answer, because I wasn't thinking through what I was doing," he replied, apologizing to her several times throughout the call. "I can't believe that I did that."At the preliminary hearing, defense attorney Eugene Iredale unsuccessfully argued to have the charges reduced to misdemeanors, and introduced evidence regarding a 2015 bicycling accident in which Sammartino hit a pothole while riding in La Jolla and landed on his head. Sammartino was hospitalized and had to re-learn some functions before going back to the classroom, according to the defense attorney.Iredale argued that the brain injury affected his emotions and ability to make reasonable judgments, playing "a significant factor" in the commission of the charged acts.Rogers ruled against the defense request in January. Though he said he believed Sammartino had been affected by the injury and was unlikely to re- offend, he stated that the sexual nature of the defendant's relationship with the teen was entirely his idea."She wanted an emotional relationship with Dr. Sammartino. That is abundantly clear, and frankly, I think it's also clear that he wanted and needed an emotional relationship with her. But the sex was not her idea; the sex was his idea," Rogers said. (AP) — Jury deliberations have resumed in the trial of a Southern California man charged with killing a family of four and burying their bodies in the desert.Jurors last Thursday got the case brought by San Bernardino County prosecutors against 62-year-old Charles "Chase" Merritt. The jury was off Friday and deliberations started again Monday.Merritt's business associate Joseph McStay, McStay's wife Summer and the couple's 3- and 4-year-old sons vanished from their San Diego County home in 2010. Three years later, their bodies were found in shallow desert graves more than 100 miles (161 kilometers) away.Merritt was arrested in 2014. Authorities said they traced his cellphone to the gravesite area and to a call seeking to close McStay's online bookkeeping account.If Merritt is convicted, prosecutors will seek the death penalty. 869
