SANTA ANA (CNS) - A man who drove drunk and veered into oncoming traffic while making a turn, slamming head-on into a minivan and killing a mother of three in Lake Forest, was convicted today of second-degree murder.William Joseph Carroll, 51, of Mission Viejo, had a blood-alcohol level of about 0.23 -- nearly three times the legal limit -- when his Ford F- 250 pickup truck slammed into a Toyota Sienna minivan driven by 36-year-old Ana Martinez about 11:40 p.m. May 7, 2013, Deputy District Attorney Daniel Feldman told jurors during the trial.Martinez, who was driving to work at the time, was "crushed to death" in the crash, Feldman said.The prosecutor said Carroll was making a left turn from El Toro Road to Santa Margarita Parkway in Lake Forest when he veered into oncoming traffic.A witness told investigators that Carroll ran a red light, he said. Witnesses "describe Mr. Carroll's truck like a train out of nowhere," Feldman said, adding that the force of the collision was like "100 mph" when combining the speeds of both vehicles.Carroll's attorney, Sara Ross, told jurors it was " a case of government overreach." Ross acknowledged that Carroll was "responsible for the killing of Ana Martinez, but he's not guilty of murder."Both drivers attempted to avoid each other, she said, adding that the intersection is "a bit confusing." "It's a very confusing road and you're going to need that context to determine whether this was a murder," Ross told jurors.Feldman said Carroll was charged with second-degree murder rather than vehicular manslaughter because when he was convicted of DUI on Sept. 11, 2008, he was warned he would be charged with murder in the event of involvement in a DUI-related death.Carroll faces 15 years to life in prison when he is sentenced Jan. 19. 1797
SANDUSKY, Ohio - Luggage lost in the wind with a Sandusky, Ohio man's supply of life-saving medication inside.Alvin Rogers was taking the Greyhound bus from Sandusky to Pensacola, Florida in September. His headache started in Atlanta."They were telling me I couldn't go to Pensacola because of the storm," said Rogers.Rogers' insulin pens, similar to the medicine he lost in the bags that can't be found by Greyhound. Hurricane Florence delayed Rogers, but while he was stuck, Alvin was told his three bags were sent to Pensacola on another bus."I said, 'Well, how can my luggage go to Pensacola in a storm and I can't," asked Rogers. "I mean, it's still gotta be on the bus."That was the first time Rogers was separated from his bags and the thousands of dollars worth of medicine that he needed for an extended trip. When Rogers finally got to Pensacola a day later, the bags were nowhere to be found."So I had to wind up buying a plane ticket to get back to Ohio so I could get my doctors to get me some more meds," said Rogers.Rogers' bus and plane tickets bringing him to Pensacola, Florida and back to Ohio.A month later, back in Sandusky, Rogers still doesn't have his bags even after constant calls from Roger's roommate, Karin Lucas."A fiasco," said Lucas, describing when she calls Greyhound. "I get transferred constantly. Representatives pass the buck."Rogers and Lucas say when they reach out to Greyhound for help, they're surprised when a live person is on the other end of the line.Lucas says they could get 0 for each of the three lost bags through the Greyhound claim process. But the emergency plane ticket was nearly 0 itself. The original Greyhound ticket was about 0, including the extra money Rogers paid to get help loading and unloading the luggage and Rogers can't get that money back."For all the good it did, I still wound up losing everything," said Rogers.Roger's claim form identifies ,000 worth of medicine and personal items lost in the bags."Everything he owns was in those bags because he planned on relocating," said Lucas.Lucas says when she reaches out to Greyhound for help, she gets nowhere."For them to be as nonchalant about the situation is really really sad," said Lucas.The Cleveland Greyhound Station, where Rogers says his bags might arrive if they are ever found.Greyhound said they are still looking for the bags. For a good year, it could be 90 percent protective, while the next year, the flu shot may only be 10 percent effective. The COVID-19 vaccine is expected to be 60 percent effective."I think for me, personally, if I saw a vaccine coming out in the next year or so that had a 60 to 70 percent efficacy, that to me would be very encouraging," said Dr. Pulendran.The public, though, may still need some convincing."One of the hardest things for the general public to embrace is the idea of probability. We like to know definitively if something works or not,” said Evans. “The reality is that a vaccine is a probabilistic issue. The pandemic has been, in a sense, a chronic trauma almost for all of us and everyone has experienced it differently," says Dr. Christina Conolly, with the National Association of School Psychologists.Dr. Conolly says parents should vary how they talk to their children about the pandemic and attending school, according to their age."For myself, I have a rising 6th grader, 11-year-old, so in talking to her, she understands what’s going on and I want to be honest and truthful but I may not share with her every single detail of what’s going on just because of the fear and anxiety that can come about," says Dr. Conolly.Details to omit include death tolls and what's happening worldwide. Instead, focus on what's happening in your community. For teenagers, many will already have an idea of all the ups and downs of the COVID-19 pandemic, because of their access to cellphones and the internet. Dr. Conolly advises making sure the content they're watching is factual. Younger kids will need reassurance and transparency of what school will look like and what's expected of them."For little kids, it's okay to share with them what’s going on with the pandemic but talk to them in terms of we are here to make sure you stay safe. The school and the staff in your school are making sure you stay safe," says Dr. Conolly."I wanted to see how Trent, my youngest, was when I went out. When I saw how he looked behind the mask and how he kind of retreated I thought, 'OK, I need to be more sensitive with him.' He doesn’t need all the details, he needs the facts, what we do when we go out now, what you’re going to expect when you see," says Beth Middleton, a former elementary school teacher and mom of four.Middleton is hoping her local school district provides parents with specific details of what children can expect when they head back to class."If we don’t prepare them for what the classrooms are going to look like and the counties don't prepare us as parents for what it's going to specifically look like when they enter at all different levels, then we’re not going to know. Then we’re not going to prepare them well enough," says Middleton.Plus, there are some families who have been directly affected by COVID-19. Schools will be focusing on the health, safety and mental health for those students and staff, too. Then, there's the wearing of masks by teachers and some kids who may or may not be wearing them."You might have to explain, 'Well, maybe some kids aren’t wearing masks because they have a health condition and they can’t wear a mask. Or maybe because of other things that are going on.' So just try to make sure you’re educating your kids about best practices and you’re talking to them about if someone isn’t maybe why that’s occurring to help them understand, to try and eliminate anxiety that might exist," says Dr. Conolly.The key is to remain calm.
