SAN DIEGO (CNS) - For yet another week, San Diego County avoided the fate of dropping into the dreaded purple tier of California's coronavirus monitoring system, with an adjusted case rate of 6.5 new daily COVID-19 cases per 100,000 population.While the county's unadjusted case rate is 7.4 per 100,000 -- enough to be in the most restrictive purple tier, which has a floor of 7 per 100,000 -- the high volume of tests the county is able to perform daily allows for an adjustment from the state. This adjustment has kept the county in the red tier for several weeks, saving it from having to shut down nearly all non-essential indoor businesses.The state data, which is updated every Tuesday, reflects the previous week's case data to determine where counties stand in the state's four-tiered reopening system.San Diego County did show modest improvement, dropping 0.4 from last week's unadjusted case rate of 7.8. The testing positivity rate continued an upward trend, rising 0.2% from last week to reach 3.5%, but remains low enough for this metric to remain in the orange tier. If a county reports statistics meeting metrics in a higher tier for two consecutive weeks, it will move into that more restrictive tier for a minimum of three weeks.The state's health equity metric, which looks at the testing positivity for areas with the lowest healthy conditions, dropped from 5.5% to 5.1% and entered the orange tier. This metric does not move counties backward to more restrictive tiers, but is required to advance.County health officials reported 269 new COVID-19 infections and seven deaths Tuesday, bringing the case total to 55,210 and the death toll to 877.Five men and two women died between Oct. 22 and Oct. 25, with one death occurring July 19. Their ages ranged from early 60s to mid-80s. All had underlying medical conditions.Of the 10,456 tests reported Tuesday, 3% returned positive, bringing the 14-day rolling average percentage of positive cases to 2.7%. The 7-day daily average of tests is 11,173.Two new community outbreaks were confirmed Tuesday, one in a daycare and one in a business. In the past seven days, 24 community outbreaks were confirmed. A community outbreak is defined as three or more COVID-19 cases in a setting and in people of different households over the past 14 days.Of all cases, 3,875 -- or 7% -- have required hospitalization. And 898 -- or 1.6% -- of all cases and 23.2% of hospitalized cases had to be admitted to an intensive care unit.All students at San Diego State University, meanwhile, remained under a stay-at-home advisory announced Thursday. The advisory began at 6 p.m. Friday and will run through Nov. 2 at 6 a.m. University officials said the move was made to discourage students from participating in Halloween events where physical distancing cannot be done. SAN DIEGO (CNS) - A man who ambushed a janitorial worker at a Little Italy coffee shop at knifepoint, tried to sexually assault her and stole her SUV, was sentenced today to 14 years in state prison.Christopher Merron, 28, was also ordered to register as a sex offender for life.The attack occurred around 4:30 a.m. last Oct. 14 as the victim was cleaning the coffee shop in the 1700 block of India Street. Merron pushed the woman into a back room, took her car keys and threatened her with a knife, according to police and prosecutors.Following a struggle, she was able to break free and run out of the building, said San Diego police Lt. Jason Weeden.The assailant fled in the woman's 1998 GMC Jimmy. Merron was arrested in Mission Valley the next day and the victim's SUV was recovered, Weeden said.Merron pleaded guilty in January to assault with intent to commit a sex offense, robbery and sexual battery charges and admitted a knife-use sentencing enhancement allegation. Other charges, including kidnapping with the intent to commit a sex offense, attempted oral copulation, false imprisonment with force and auto theft, were dismissed at sentencing. 1165

SAN DIEGO (CNS) - As San Diego County heads into a "Halloweekend," public health officials are urging members of the public to practice COVID-19 protocols -- including avoiding large gatherings such as Halloween parties and door-to-door trick-or-treating."These activities involve face-to-face interactions with people from different households," said Dr. Wilma Wooten, the county's public health officer. "If a COVID-19 infection is detected among a participant, it will be very difficult to find and notify those who may have been exposed."These traditional Halloween celebrations are not advised, and large gatherings are not allowed, under state or local health guidance. SAN DIEGO (CNS) - An ex-con and repeat DUI offender who was drunk when he drove on the shoulder of the freeway near Tierrasanta, striking and killing a tow-truck operator tending to a disabled trash truck, was sentenced Friday to 15 years to life in prison plus 10 years.Michael Gilbert Gray, 50, pleaded guilty in August to second-degree murder and admitted two serious felony priors, including a domestic violence conviction for hitting his wife and rupturing her eardrum.Charges of gross vehicular manslaughter while intoxicated and leaving the scene of the Feb. 23, 2017, collision that killed 55-year-old Fred Griffith were dismissed as part of the plea agreement.Griffith's sister, Danelle Ragsdale, said in a letter to the court that her brother -- a single father to three boys -- was "needlessly ripped from all of us."Ragsdale said Griffith and his three sons -- ages 15, 18, and 21 -- were "inseparable.""He (Fred) worked hard for the boys so they would have a good life," the victim's sister said in the letter read in court by Deputy District Attorney Cally Bright. "Fred was a ship in the night who would help you find your way to safety."Griffith's friend, Randall Resch, wrote in a letter that the victim was a "gentle giant" and one of the best heavy-duty tow-truck operators in San Diego County."Fred touched the hearts of everyone who knew him," his friend said. "To me, Fred died a hero's death."Before he was sentenced, Gray apologized to the victim's family and said he took full responsibility for Griffith's death.Witnesses testified during a preliminary hearing last year that they saw Gray's Ford Expedition swerve onto the shoulder of eastbound state Route 52 and narrowly miss a large disabled commercial trash truck before striking Griffith, who was standing outside his tow truck in front of the trash truck.Off-duty sheriff's Detective Mark Palmer testified that he activated his lights and siren in his vehicle and followed Gray's SUV before pulling him over a short distance down the highway.The defendant -- who had a half-empty bottle of vodka in his car -- was still showing signs of intoxication three hours after the crash, said Deputy District Attorney Cally Bright. Authorities said Gray's blood-alcohol content was .27 percent -- more than three times the legal limit -- at the time of the accident. Gray had DUIs in 1999, 2001 and 2013, Bright said.Gray went to prison in 1987 for assault to commit rape and sexual battery convictions and was incarcerated again in 2007 after the domestic violence conviction, according to a probation report. 2592
