SAN DIEGO (CNS) - A judge took under submission today a motion by the federal government to dismiss a lawsuit filed by the cities of Imperial Beach and Chula Vista and the Port of San Diego, alleging that the International Boundary and Water Commission is violating the Clean Water Act by not doing more to prevent Tijuana sewage from flowing into San Diego area waters.The federal government maintains that the IBWC isn't legally responsible for the sewage flowing into U.S. waters from Mexico.But the plaintiffs claim that since the IBWC oversees a flood control channel that redirects the Tijuana River on its way to the Pacific Ocean, as well as water- capture basins in five canyons along the border, the agency is responsible for the sewage that gets through those systems.RELATED: Imperial Beach businesses hurt by sewage & runoff related closuresImperial Beach Mayor Serge Dedina, who has led the fight to against the IBWC since his city was hit with millions of gallons of raw sewage in February 2017, said it was heartening to hear U.S. District Judge Jeffrey Miller say he might go to the South Bay to see first-hand how the situation is being handled.Dedina said the plaintiffs got a fair hearing. SAN DIEGO (CNS) - A man who was previously acquitted of a 12-year-old Escondido girl's murder was released from county jail this week, months after he was charged with being a felon at a county jail.Richard Raymond Tuite, 51, was released Thursday after a judge set his bail at SAN DIEGO (CNS) - Authorities today publicly identified a young man who was fatally shot last week during a fight near Horton Plaza.Patrol officers responding to reports of gunfire found Angel Maravilla, 22, mortally wounded at E Street and Fifth Avenue in the Gaslamp District shortly after 9:30 p.m. Thursday, according to San Diego police.Medics took Maravilla to a hospital, where he was pronounced dead.``The initial investigation revealed the victim and a companion were involved in an altercation with a third man,'' Lt. Matt Dobbs said. ``At some point during the altercation, the (third man) pulled a firearm and shot the victim.''The reason for the fight was unclear. All of the people who died had underlying medical conditions.That total is more than last flu season's entire toll.As of this time last year, the county had recorded 46 flu deaths. Last season's deaths totaled 77."Influenza appears to be declining, but people should continue getting vaccinated as the flu could last until April or May," said said Dr. Wilma Wooten, the county's public health officer. "The vaccine is safe and effective and the best tool we have to prevent influenza."Last week, Chairman Greg Cox, County Board of Supervisors, recommended everyone get a flu vaccine to protect themselves and their family, and reduce the potential strain on the healthcare system, which may be impacted by novel coronovirus concerns.There have been a handful of novel coronavirus cases in San Diego County and as of yet no deaths."It's important for everyone to educate themselves and their family and be prepared ...," Cox said. She had been stabbed nine times.Her older brother, Michael, and two of his friends, Aaron Houser and Joshua Treadway, initially were accused of committing the murder, and police extracted confessions from two of them during lengthy interrogations.The admissions were later ruled to have been coerced, and the charges against the boys were dismissed. During Tuite's retrial, the now-adult former suspects testified that they had no involvement in Stephanie's death.Tuite had been in the area of the Crowe residence the night the girl was killed. He was agitated and looking for a woman named Tracy, according to prosecutors, who contended that the disheveled and seemingly confused transient wandered into the Crowe home and attacked the girl.Investigators, however, found no physical evidence directly linking him to the crime scene.Analysts later found the victim's blood on two shirts that Tuite had been wearing on the day of the murder. Jurors who voted to acquit Tuite said they believed a defense theory of "contamination," in which blood from the crime scene somehow wound up transferred onto Tuite's clothing.More than two decades after the murder, two families reacted Friday after Tuite was released in the current case."I'm absolutely pleased. SAN DIEGO (CNS) - Authorities reached out to the public Wednesday for help identifying a man who entered the women's locker room at a Hillcrest hospital and prevented a woman from leaving the restroom after she rejected his advances.The suspect entered the women's locker room at the UC San Diego Clinical Training Facility at 210 Dickenson St. shortly before 11:15 a.m. on Aug. 20, according to San Diego police.A 30-year-old woman was using the restroom inside the locker room when the man walked inside, prevented her from leaving, then asked her, "Don't you want this?" while gesturing to his body, police said. The man then left the restroom, but held onto the outside doorknob to keep the victim from locking the door.He then walked back inside the restroom and blocked her from leaving four more times before she was able to lock herself inside the locker room and wait until he left.Once the victim heard a co-worker in the hallway, she left the locker room and went outside the building to get help, but she saw the man near another building and she ran away before calling 911.The suspect was described as a 6-foot white man with a thin build, unshaven face and short, dark-colored hair with a gray patch near his right temple.
