SAN DIEGO (CNS) - San Diego-based medical technology company Phamatech and its CEO have agreed to pay more than million to resolve allegations that they submitted false claims to Medicare and received government reimbursements for unnecessary lab testing, the U.S. Attorney's Office said Friday.Prosecutors allege the company paid kickbacks to a medical clinic, which in return ordered Phamatech lab testing for its patients enrolled in Medicare.Over the course of about two years, Phamatech, which manufactures diagnostic devices and provides lab testing services such as drug and alcohol tests, paid a per-specimen fee to Imperial Valley Wellness in exchange for referrals of urine samples from Medicare beneficiaries, according to the U.S. Attorney's Office.Many of the samples referred to Phamatech were not necessary and thus ineligible for Medicare reimbursement, prosecutors said.The company, along with its CEO and founder Tuan Pham, agreed to pay ,043,484 to settle allegations that Phamatech violated the federal Anti- Kickback Statute and the False Claims Act.The U.S. Attorney's Office said the allegations were originally brought in a lawsuit filed by former Phamatech employee John Polanco, who will receive 7,392 from the settlement proceeds. 1273

SAN DIEGO (CNS) - The San Diego County Regional Airport Authority announced a 10-year agreement with its airline partners Tuesday to improve transportation access to San Diego International Airport and potentially pave the way for a Metropolitan Transit System trolley route to the airport.The investment pact, totaling more than a half-billion dollars, could eventually fund multiple infrastructure projects to increase transit connections between the city of San Diego and the airport. The agreement includes funding from both the Airport Authority and its associated airlines that serve the San Diego International Airport.The projects, which are not yet approved, could include a multi-modal access road between the city and the airport, which would reduce traffic on Harbor Drive by roughly 45,000 vehicles each day. According to the Airport Authority, the reduced congestion on Harbor Drive could allow for the addition of MTS Rapid bus and trolley lines along the street."This agreement ensures that the Airport Authority will have the means to effectively partner with other regional agencies to improve access to the airport through transportation and transit projects," said Airport Authority Board Chair April Boling.The agreement includes 0 million to on- and off-airport transit projects that will be completed collaboratively with the Airport Authority's partner agencies and 5 million for the planned multi-modal corridor. SAN DIEGO (CNS) - The Port of San Diego announced Monday a three-year pilot project to test the use of concrete tide pools as a shoreline stabilizing tool. The concrete company ECOncrete will analyze the efficacy of its concrete tide pools as a possible replacement for traditional shoreline-stabilizing tools like rock armoring. The concrete tide pools will also serve as ecosystems for aquatic animals and organisms that live in natural tide pools. The tide pools interlock like puzzle pieces and are made of low carbon concrete that, according to the company, is environmentally safe and tailored to the environment in which its placed. ECOncrete plans to install 72 of the concrete tide pools across three areas of Harbor Island's shoreline, according to the Port of San Diego. ``ECOncrete's Coastal Star tide pools have great potential to provide many benefits for San Diego Bay,'' said Port of San Diego Board Chair Garry Bonelli. ``The Port looks forward to seeing if they can provide shoreline stabilization, help guard against coastal flooding, and improve the ecology of our bay water.'' The project is the eighth approved in the Port of San Diego's Blue Economy Incubator, which is intended to streamline the process in which businesses can launch pilot projects for so-called blue technology. The port launched the incubator program in 2016 as a way to collaborate with businesses focused on restoring ecosystems, improving water quality and fisheries and monitoring the environment. ECOncrete plans to monitor the tide pools every six months to examine how they could replace current shoreline stabilizers in the San Diego Bay. The best-case scenario, according to the company, would be protecting the city from rising water levels due to climate change while also protecting and sustaining local marine life. ``We are eager to help protect the city's coastlines while increasing resilience and rejuvenating the marine ecosystem of the area,'' said ECOoncrete CEO Shimrit Perkol-Finkel. ``The newly developed Coastal Star tide pool in partnership with the Port of San Diego will help change the way our future coastlines look and function.'' 2162

  

SAN DIEGO (CNS) - San Diego City Attorney Mara Elliott was celebrating a reelection victory Wednesday, following a dominant performance over private attorney Cory Briggs."When I was elected four years ago, I pledged to put the people of San Diego first, and that's just what we've done," Elliott said in a statement Tuesday night claiming victory in the race."With the help of our terrific team in the City Attorney's office, San Diego is a leader in reducing gun violence, helping domestic violence victims, and holding corporate polluters accountable. We moved quickly to protect public health during the pandemic and we've made it a priority to safeguard taxpayer dollars. I'm humbled and grateful that the people of San Diego have placed their trust in me to fight for them for another term."Elliott has been city attorney since 2016, and since then has taken an uncharacteristically proactive approach to the role, sometimes ruffling feathers, such as with the Smart Streetlights program. In August, members of the San Diego City Council boycotted a meeting with Elliott over restrictions on sensitive documents.Briggs has sued the city dozens of times, ostensibly to increase transparency at City Hall. He said during the campaign he wanted to remove petty politics from the office."As someone who has spent nearly two decades fighting special interests at City Hall, I believe now's the time to bring my training, experience and taxpayers-first approach to the City Attorney's Office," he said.Elliott pointed to Briggs' many lawsuits as reasons she is more fit for the office.The pair have faced off in court during the election cycle. Elliot sued Briggs for identifying himself as a taxpayers' advocate, while Briggs sued Elliot for claiming an endorsement from the San Diego Union-Tribune after it expired. Briggs prevailed in both cases.The city attorney serves as the city's prosecutor and legal adviser.Meanwhile, San Diego voters weighed in on a trio of ballot measures:-- Voters rejected Measure A, a housing bond that would have allowed the city to issue up to 0 million in bonds to fund low-income, substance abuse, and mental health service housing. It required two-thirds of the vote to pass, but initial tallies showed it with only 57%.-- Voters approved Measure B, which amends the city's charter to replace the Community Review Board on Police Practices with the Commission on Police Practices, which will be appointed by the City Council to conduct investigations and subpoena witnesses and documents related to deaths resulting from police interactions and complaints made against police officers.-- Voters also approved Measure E, providing an exception to the city's long-standing 30-foot height limit in the Coastal Zone for the Midway- Pacific Highway Community Plan. SAN DIEGO (CNS) - The Del Mar Thoroughbred Club announced new and enhanced safety protocols for horses and jockeys Wednesday which will be in effect for the Del Mar race track's 80th racing season which begins July 17.The initiatives include a mandate for a five-person review panel to analyze each horse's racing, medical and training history to ensure each horse is safe to race and a ban on the use of nonsteroidal anti-inflammatory medication fewer than 48 hours before a race or a workout. Previously, NSAIDs were allowed up to 24 hours before a race or workout.The approximately 1,850 horses stabled at Del Mar will also be subject to increased random testing and analysis, veterinary observation and stable security measures to make sure horses are jockeys are following track rules.Riding crops will be prohibited during morning workouts and could be restricted further as the track continues consulting with the California Horse Racing Board and the Jockey's Guild.RELATED: What you need to know about Opening Day at the Del Mar RacetrackIn addition to its enhanced safety protocols, the DMTC announced the creation of an advisory committee of trainers, veterinarians, jockeys, racing surface maintenance experts and track management to continually discuss how to make Del Mar as safe as possible.``Del Mar continues to strive to provide the safest environment possible for our equine and human athletes for both racing and training,'' said DMTC CEO Joe Harper.``We have a responsibility to implement the best practices for safety and welfare and the further responsibility to educate the public about these practices and about the extraordinary levels of care provided to our equine athletes.''The club announced the increased safety measures at a time when horse racing is under unprecedented criticism from animal rights activists. Gov. Gavin Newsom signed a bill last week allowing the CHRB to suspend racing licenses and race days at Santa Anita Park in Arcadia without public notice due to an unprecedented wave of horse deaths and fatal injuries at the track.A total of 30 horses died during Santa Anita's racing season, which ran from Dec. 26-June 23. The deaths led to calls for increased safety measures and an indefinite closure of the track while state officials investigate the cause of the deaths.The DMTC dealt with a similarly deadly racing season in 2016, when 17 horses died during Del Mar's racing season. After remaking its dirt track with the help of race track consultant Dennis Moore and implementing additional safety measures like adding a radiology and ultrasound facility along the track's backstretch, only five horses died during Del Mar's 2017 season and six during its 2018 season.After instituting the changes, Del Mar has been rated one of the safest horse racing venues in the U.S., tallying only 0.79 horse deaths per 1,000 starts last year, according to the Jockey Club Equine Injury Database. According to the DMTC, the national average was 1.68 among tracks that reported their fatal injuries.``Significant thought, due diligence and stakeholder input went into the crafting of the reforms we are implementing this summer,'' said Tom Robbins, the DMTC's executive vice president of racing and industry relations.``All of us recognize our responsibility to ensure the safety and welfare of the horses that race and train here. We are very appreciative of the cooperation from industry stakeholders including our owners and trainers.''The Del Mar Thoroughbred Club is scheduled to begin its summer season July 17 and continue through Sept. 2.
