SAN DIEGO (KGTV) - A former employee of the San Diego Metropolitan Transit System is suing the agency for retaliation after he said he stood up for a co-worker.Ivan Augustino moved to the United States from Sudan and still volunteers with projects for his native country. He started working for MTS in 2015.“It was pretty good,” Augustino said.Augustino worked as a Senior Applications Developer.“I am the main guy that deals with the complicated back end computer codes,” Augustino said.In 2017, he said he made a move that changed everything. It started with a co-worker.“One morning, she walked into my office pretty much in tears,” Augustino said.He said that a co-worker confided to him the Chief Information Officer discriminated against her when she asked about a promotion. The lawsuit filed against MTS claims the CIO told Augustino’s co-worker she was “not qualified for the job because of her age, her marriage and family planning status, and her relationship to an active duty military service member.”“The other question she also asked was, how old are you? You seem like you are at an age where you would be having kids,” Augustino said. It was a shocking conversation.“You know, that is wrong,” Augustino said.After his co-worker told him what happened, he first asked advice from another co-worker who then took it to human resources. Augustino said his co-worker did not want to bring the complaint to HR.“The last thing that anyone within the IT department wants is to take an issue to HR because once you report it to HR, there is going to be retaliation,” Augustino said.And that’s what happened, according to the former MTS employee. Initially, he was concerned how MTS investigated the complaint.“I was expecting someone to at least come and talk to me, but no one spoke to me,” Augustino said.He said retaliation began by the CIO and his direct supervisor.“The way they treated me just changed,” Augustino said.He claimed management suggested they would give him recommendations if he found another job. On another occasion, Augustino said they “mocked [his] English as a second language” in an email. On top of that, he said 98 hours of paid time off promised to him for working overtime on a big project was revoked, along with a promised promotion.“Coming from where I come from, I just felt like I did not even know what to do,” Augustino said.Feeling “degraded” and “intimidated”, he submitted a letter of resignation. However, he said he gave management an option.“If you can address this issue and the executive team and bring what I view as retaliation to a stop, I will pull my resignation,” Augustino said. Instead, he said he was fired and walked out of the building by security. His termination came a little over a month after he voiced his concerns about his female co-worker.A spokesperson for MTS told Team 10: “There is absolutely no validity to any of Mr. Augustino’s claims.”When asked if he would defend his co-worker again, Augustino said “absolutely.”Attorneys Zachary Schumacher and Daniel Goularte represent Augustino."This is absolutely a David versus Goliath situation," Schumacher said.Schumacher said fear is why people don't speak up."I like to compare it to battered wives syndrome, where you essentially have this person or in this case this entity who has this major power and balance who is doing all sorts of awful things and figuratively at least, battering its employees and yet they don't leave. They feel this sense of loyalty," Schumacher said. SAN DIEGO (CNS) - The U.S.-Mexico-Canada Agreement trade deal includes 0 million in funding to address cross-border pollution in the Tijuana River Valley, San Diego's congressional delegation announced Wednesday. The funding would be dispersed in four annual installments of million in the form of U.S. Environmental Protection Agency grants under its Border Water Infrastructure Program. In June, the fiscal year 2020 federal budget for the BWIP was only million, according to the office of Rep. Scott Peters, D-San Diego. ``The USMCA delivers a massive funding investment that can fix the Tijuana River's sewage spills once and for all,'' Peters said. ``This funding can stop the environmental crisis that has plagued our community for decades and will improve public health.'' The bulk of the funding would be used to expand and upgrade the South Bay International Wastewater Treatment Plant, operated by the International Boundary and Water Commission. The funding would be used to fortify the plant's water treatment capabilities, allowing it to stanch flows of polluted storm and wastewater into the river. ``Cross border pollution is a nightmare for our community and for the individuals that work and recreate near the border,'' Imperial Beach Mayor Serge Dedina said. ``This funding is a critical step towards cleaning up the contamination in the Tijuana River Valley and making our beach safe for surfers and others who enjoy our coast.'' Transborder pollution from the Tijuana River has contaminated U.S. waters and coastlines for decades, forcing San Diego County environmental health officials to regularly close beach access near the border. During that time, local and state officials and environmental activists have called for federal assistance to protect the health of the environment and residents near the border. In April, Sens. Kamala Harris and Dianne Feinstein, D-California, submitted a jointly written letter to multiple federal agencies requesting they address sewage runoff in the river. In July, Peters and Reps. Juan Vargas, D-San Diego, and Mike Levin, D- Oceanside, introduced legislation to increase funding for Tijuana River cleanup efforts and prevention of future pollution. And in September, the San Diego Regional Chamber of Commerce's annual delegation of local officials and business leaders discussed the issue with cabinet officials and members of Congress. ``This environmental issue has plagued our region for generations and this funding will take major strides in helping us address health and ecological challenges we face,'' Levin said. ``Along with my colleagues, I made it clear to the Trump administration and House Democratic leadership that it is long past time that we make robust investments in cleaning up polluted water that flows over the border.'' The San Diego chapter of the Surfrider Foundation and the city of San Diego have also filed lawsuits against the IBWC, arguing that it has neglected pollution in the river and its effect on the environment. The city jointly filed its lawsuit with California Attorney General Xavier Becerra. The pending funding is a result of Tuesday's deal between congressional Democrats and the White House to support a revised USMCA. Rep. Nancy Pelosi, D-San Francisco, said the modified trade agreement includes more strenuous labor and environmental standards for the three countries. House Democrats are now expected to vote for the deal's ratification and send it to the Republican-controlled Senate. The USMCA would replace the North American Free Trade Agreement, which went into effect in 1994 and is blamed by some politicians on both sides of the aisle for hastening outsourcing and the decline of the country's manufacturing industries. President Donald Trump, who campaigned on retooling NAFTA, has faced pushback from members of Congress for much of the year for elements of the original deal like tariffs on steel and aluminum and its enforcement provisions. SAN DIEGO (KGTV) - A driver led CHP officers on an hour-long pursuit from Southern Orange County to Mission Valley Wednesday night.The chase ended on the onramp from southbound I-805 to westbound I-8.Ray Scheidnes, with California Highway Patrol, says the chase started in the San Juan Capistrano area when they received reports of someone driving erratically just after 6:30 p.m.When they tried to pull over the driver, she instead drove south on I-5 into San Diego County and eventually onto I-8. The driver even called into 9-1-1 dispatch and tried to explain why she wasn't stopping.“I believe that she was afraid to pull over, mentioned something about possibly having some previous run-ins with law enforcement that she didn't think went too well,” Scheidnes said.Scheidnes also added they’re not quite sure why she eventually stopped in Mission Valley.“The vehicle didn't seem to run out of gas or have any mechanical problems, just came to a stop, I think she just decided to pull over,” he said.CHP says the driver is an Orange County resident. She has not been identified. There are no immediate signs of drugs or alcohol, but she could be facing charges of resisting arrest and failure to yield. 1247
SAN DIEGO (KGTV) -- Families worried about paying back rent due to the pandemic are getting more time.Tuesday, the San Diego City Council voted 5-4 to extendthe rent repayment period for commercial and residential renters to December 30, giving renters who have lost income due to the COVID-19 pandemic a few extra months to repay back rent.Council President Georgette Gomez's initial motion Tuesday would haveextended the repayment period for the eviction moratorium to March 31, 2021.Councilwoman Jennifer Campbell amended the motion to the December date as a compromise.On March 25, the council voted unanimously to begin an emergencyeviction moratorium for renters. The moratorium requires renters to demonstrate through documentation that the pandemic has caused "substantial loss of income," according to city staff.Renters are also required to follow the rules in leases, but landlords cannot evict a tenant for nonpayment due to COVID-19.During the meeting, the council heard from landlords and realtors who say renters are taking advantage of the situation."The blanket moratorium has given criminals a free pass at the full expense of landlords, this is not a one size fits all," said property manager Claudia Cooper.Other callers said it would be a disaster to evict families just as children are starting school from home."Folks will be evicted and this pandemic won't be over anytime soon as the presentation mentioned, a lot of children are going to be learning from home and to be evicted right as school starts is just going to exacerbate the effect this pandemic has had on our kids," said one caller.Many callers said evictions must be prevented to avoid adding to the homeless problem."Many people have been out of work and eviction could mean death," said another caller.The moratorium on evictions expires September 30. If tenants are in good standing with landlords, they can work out a repayment plan for back rent through December 30."We are all in it together," Gomez said before discussion of themotion. "The economy is not fully restored. This is not an ideal policy, butit's a necessity for what we are dealing with."Gomez represents District 9, which encompasses Southcrest, CityHeights, Rolando and the College area. It has also been one of the mostimpacted areas during the pandemic.According to a member of Gomez' staff, which gave the presentationon the topic, the city had started 15,659 rental relief applications usingfederal Coronavirus Aid, Relief, and Economic Security Act funds. Disbursements from that pool of relief money are scheduled to be handed out in late August or early September. Those funds will go directly to landlords, however, and not renters.Council President Pro Tem Barbara Bry voted no on the motion Tuesday,not because she didn't agree that people needed help paying rent, but because the arbitrary nature of the rental relief program could leave the city open for lawsuits, she said. She added that not enough renters know the impact of not paying rent."It's a cruel hoax," she said. Bry said that by not paying rent ontime, tenants could be destroying their credit and leaving themselves withmountains of debt and no place to turn once the moratorium ends.In a public comment period, several dozen San Diegans called in, manyurging the council to extend the moratorium -- which was not the motion in front of council -- and many to forgive rent and mortgages outright.About an equal number of landlords called in to urge the council to allow for evictions again, as many said they were paying two mortgages and not receiving income.Councilmembers Chris Cate and Scott Sherman were opposed to theextension on legal grounds, as the gap between when the moratorium was passed to the date proposed in Tuesday's initial motion would have been more than a year.
