NEW YORK CITY — The co-owner of a Staten Island bar that continues to flout local coronavirus restrictions was arrested again early Sunday morning after allegedly hitting a sheriff's deputy with his vehicle, officials said.After a night of surveillance at Mac's Public House, two uniformed deputy sheriffs approached Daniel Presti, 34, just after midnight to place him under arrest, but he ran from the officers, got into his vehicle and began to drive away, according to the sheriff's office.Presti allegedly drove into one of the uniformed deputies, officials said. The deputy was thrown onto the hood of the vehicle and Presti reportedly continued to drive down South Railroad Avenue with the injured deputy still clinging to the hood of the car.,Presti drove about 100 yards before stopping his vehicle, officials said. He was arrested and taken to a police precinct, where he is expected to be charged.The deputy sheriff who was struck by the vehicle was taken to Staten Island University Hospital for treatment, officials said.The car crash was the latest incident surrounding the controversial Staten Island bar — which has garnered national attention and was even spoofed on Saturday Night Live over the weekend.Presti was also taken into custody by deputy sheriffs on Tuesday after an investigation revealed the bar was offering indoor dining and defying several other coronavirus restrictions despite rising infection rates in the area. Staten Island has the highest COVID-19 positivity rate in New York.Bars and restaurants in state-designated "orange" microcluster zones are only allowed to offer takeout and outdoor dining, with a four-person maximum per table.Despite Presti's initial arrest and the loss of the the bar's liquor license, Mac's Public House opened its doors to indoor diners again this weekend, according to the sheriff's office.On Saturday night, deputy sheriffs reported witnessing dozens of people entering and exiting a neighboring commercial space to access the back door of the bar.According to the sheriff's office, food and alcohol were being served to unmasked and standing patrons in exchange for "monetary donations."Following Presti's arrest Saturday night, Mac's Public House said on Facebook that the restaurant would remain open."We will not back down! You have not scared us!! The world is watching and it's time for everyone to wake up!" a statement on the bar's Facebook page said.Mayor Bill de Blasio's press secretary, Bill Neidhardt, commented on Presti's second arrest on Twitter Sunday afternoon."Presti has been telling the world who he really is for days now, but last night's incident made it crystal clear. The calls for charges against officers involved in shootings may be growing louder amongst protesters, but charges and prosecutions in these cases remain rare.Five days after Kenosha police officer Rusten Sheskey grabbed Jacob Blake’s shirt and fired seven shots into his back, many are angry no charges have been filed.“The reason people expect charges in these cases to be filed so quickly is because when a civilian harms someone, they're charged, you know, immediately,” said Kate Levine, an associate law professor at Cardozo Law School in New York.“I believe that all ordinary citizens should be treated the way the police are treated, and prosecutors should do a thorough investigation before they charge,” said Levine, who studies police prosecutions.Bowling Green criminal justice professor Phil Stinson tracks these types of cases. He says even when charged with more serious crimes, like manslaughter or murder, officers are rarely convicted.“About 1,000 times each year, an on-duty police officer shoots and kills someone. And it's actually a very rare event that an officer is charged with murder or manslaughter resulting from one of those shootings,” he said.In many cases, experts say it takes public pressure or independent video evidence to even get charges filed.In the case of Laquan McDonald, a black teen shot dead by a white police officer in 2014, it wasn’t until dashcam video was released 13 months after the shooting that Chicago police officer Jason Van Dyke was charged and eventually convicted of 2nd degree murder."Absent the release of that footage, what you have is the police officers saying Laquan McDonald was threatening us. Right. And only when you see the video do you see this is a kid walking away from them, not threatening them,” said Levine.According to a statistical analysis by Bowling Green University, since 2005, 119 police officers were arrested for shooting and killing someone while on duty. While 44 were convicted of a crime, most were for convicted for lesser offenses. Only seven were convicted of murder.“Instead of treating it as a potential criminal homicide case in a crime scene, it seems that the assumptions they start with in these cases are that an officer was involved in a shooting and that it was probably legally justified,” said Stinson.In Louisville, police executed a no-knock warrant on the wrong apartment shooting and killing 26-year-old Breonna Taylor. Andrew Cuomo announced Friday that all New York school districts were able to reopen for the next academic year.Cuomo said that his decision was based on infection rates across the state. He previously announced a state formula to determine whether or not schools will reopen.School districts have been developing reopening plans, with feedback from parents and teachers.However, according to the governor, of the 749 districts across the state, 127 have yet to submit reopening plans and 50 plans were incomplete.The Department of Health will continue to go over plans as the come in, the governor said.According to Cuomo, the Health Department can disapprove of a district's plans if they don't meet the proper safety measures, which could delay the opening of schools in that district.New York City Schools Chancellor Richard Carranza also unveiled updated school reopening plans this week, which requires teachers and students to be in masks the whole day.Class sizes have also been slashed to 12 or less students, while many areas like gyms and cafeterias are getting revamped to create makeshift classrooms.Disinfection and virus protection are some of the top areas of concern.New York schools have been closed since mid-March in an attempt to mitigate the spread of the coronavirus outbreak. 1323

North Dakota Senator Heidi Heitkamp is facing the very real possibility that she may have to say good bye to the seat she's held for the past six years.Heitkamp is a moderate Democrat, who touts her ability to make tough choices and not always voting based on politics. One of the hardest moments for her was voting "no" to Supreme Court nominee Brett Kavanaugh."I think that a lot of people wrote the political obituary after that vote, and it may in fact be that," says Heitkamp.Voting against Trump was also a risky move, in a state that voted for the president by a 36-point margin.When asked if that factored into her decision at all, Heitkamp replied, “No, because when you’re making this decision, especially on a Supreme Court justice, there’s no do-overs.”In recent polls, Heitkamp trailed her opponent, Congressman Kevin Cramer, by double digits.Having someone always stand with Trump seems to be what some voters in North Dakota are looking for.“She voted ‘no’ on Kavanaugh; that was a big deal to me,” says one voter.But there were plenty who would say the opposite.“I really admired her for doing what was right in her heart, rather than what she was pressured to do,” says another voter. “So, I admire her independence on that.”Heitkamp hopes that come Tuesday she'll beat the odds and be elected to serve another term. 1346
