VISTA (CNS) - A man and woman were being sought Sunday after the man allegedly rammed and disabled a sheriff's deputy's patrol car while fleeing the scene of a theft at a 7-Eleven store.The theft happened at 2:10 p.m. and someone at the store began following the suspect who was driving a stolen car, according to Lt. William Amavisca of the sheriff's department.Deputies were notified of the theft and caught up to the suspect, who then rammed a deputy's vehicle on East Vista Way, Amavisca said. The deputy's vehicle was disabled. No injuries were reported.The suspect fled the scene and deputies later found the car abandoned and disabled, the lieutenant said. The driver and his female passenger apparently fled the scene on foot.A deputy recognized the man as having a felony arrest warrant, Amavisca said. 819

VISTA, Calif., (KGTV) — The man and woman accused of fatally stabbing a Carlsbad woman in March appeared at their preliminary hearing on Wednesday. Ian Bushee and Malissa James pleaded not guilty to all charges, including murder and burglary. The District Attorney called several witnesses, playing 911 calls and never-before-seen police body camera footage in the courtroom. The 911 call was from the victim, Marjorie Gawitt.Dispatcher: 911. What's your emergency?Marjorie: (inaudible) I've been attacked. That was the beginning of Gawitt's dying message on the morning of March 11, 2019. The 63-year-old woman was sleeping in her Carlsbad home alone when police said Bushee and James tortured and stabbed her fifty times in the face, neck, and back. Dispatcher: We've got help sent out to you, Marjorie. Who did this?Marjorie: I don't know. It took everything Gawitt had left in her to make that 911 call. The call was so tragic, officers testifying on the stand became choked up while listening to Gawitt's voice. Because of her final act of courage, Officer Randy Noa found her minutes later, still alive. On his body camera video, you can hear him trying to speak to Gawitt."You okay ma'am? Oh. Ma'am. Is he still in here or did he leave? (PAUSE) I can't hear you, ma'am," Officer Noa said, breathing heavily."It looked like she was trying to say to me that he was gone. But it was hard," Officer Not testified inside the courtroom. The District Attorney also played a second body camera video, worn by Officer Derek Harvey. On it, you can hear him trying to console the victim. "Ma'am, you're going to be okay. The paramedics are going to be here, any second, okay?" Officer Harvey said. Minutes later, Harvey's camera recorded him finding what looked to be the weapon on the counter."Her eyes were clouded, dilated and fixed," Officer Harvey said. "I knew she was... probably not going to make it." He was right. Despite the paramedics arriving quickly, Gawitt died at Scripps La Jolla Hospital. With the only eyewitness now gone, investigators were back at square one. What they did know was that the victim's gold car was missing, so they worked to track that down. Hours later, surveillance video captured the victim's stolen car in San Marcos. The suspects were taped walking around near a masonry warehouse and at a 7-11 store. Investigators said the two later ditched the stolen car in San Marcos, and for some reason, rode a bus back into Carlsbad. The two were later arrested near the original crime scene. Police said it turns out Gawitt's home was not the first the pair had ransacked that day. "I looked up, and I said something is missing here," neighbor Patricia Gapik said. That same morning, Gapik noticed her sewing basket and her daughter's flute were gone. Random items were also scattered near her sliding glass door. "I then realized that someone was in my house," Gapik testified. "I was scared."Luckily, Gapik was asleep the entire time, and never confronted the burglars. But investigators later found that the two cases were connected. They found some of Gapik's belongings inside the car left in San Marcos. The suspects, Ian Bushee and Malissa James were the same. Thursday morning, the Medical Examiner will be giving his testimony on Gawitt's fatal injuries. 3303

VISTA (CNS) - A Catholic priest who grabbed a seminary student's groin from behind in a restroom stall during a night of drinking at a Carlsbad restaurant was convicted of misdemeanor sexual battery Monday.A jury deliberated about two hours before finding the Rev. Juan Garcia Castillo guilty.Castillo, who had worked at St. Patrick's Church in Carlsbad since 2011, faces six months in jail and registration as a sex offender when he is sentenced Jan. 18, said Deputy District Attorney Joshua Brisbane.The 33-year-old victim -- a former Navy attorney who left the military to join the priesthood -- testified that he had met Castillo the night before the incident, which happened about 1 a.m. on Feb. 4.According to court testimony, the victim went to the restroom to be sick, and was in a stall when Castillo grabbed his genitals from behind.The victim testified that he told Castillo to go away, but the defendant came back in the stall and massaged the victim's groin in a sexual way.Castillo, 35, testified that he followed the victim into the restroom because it looked like he was going to be sick. The priest said he tried to put pressure on the victim's stomach to stop his vomiting because his mother had taught him that trick as a child.The Roman Catholic Diocese of San Diego suspended Castillo once it learned of the "credible allegation" against him. 1371

  

VISTA (CNS and KGTV) - Prosecutors announced Friday they will seek a second trial against ex-NFL tight end Kellen Winslow II, who was convicted of forcible rape and misdemeanor counts of indecent exposure and lewd conduct earlier this week. Following about a week of deliberations, a Vista jury found Winslow guilty of raping a woman in Encinitas and exposing himself to two others, but deadlocked on eight other charges, including rape and kidnapping in connection with two other women. Jurors indicated that they were leaning toward guilty verdicts on each count, but were unable to reach a consensus, leading San Diego Superior Court Judge Blaine Bowman to declare a mistrial as to those counts Tuesday morning, and dismiss the jury. Prosecutors stated they will go forward with trying Winslow a second time. A judge set the trial date for Sept. 30 and denied bail, saying Winslow was a danger to the community.Winslow was convicted of last May's rape of a 58-year-old homeless woman -- Jane Doe 2 -- exposing himself to Jane Doe 3, who was gardening in her front yard in Cardiff last May, and touching himself in front of a 77-year-old woman -- Jane Doe 5 -- at a Carlsbad gym in February. VISTA (CNS and KGTV) - A man accused of killing his 7-year-old daughter at the family's Oceanside home pleaded not guilty Tuesday to murder, assault and child cruelty charges.Pedro Araujo, 27, is charged in last Wednesday's slaying of Mariah Araujo. Police have not commented on the cause of her death, but the criminal complaint indicates that a knife was used.Mariah was stabbed at least 10 times in the neck and upper body, prosecutors said. She also had defensive wounds from the attack.In addition to murder, the defendant is charged with assault on a child in regard to Mariah, and misdemeanor child cruelty involving her 6-year- old sister.RELATED: 7-year-old found dead in Oceanside home, father arrestedHe faces 26 years to life in prison if convicted of all charges.The children's grandmother made an emergency call shortly after 11 a.m. to report that she had just gone to the family's house in the 3500 block of Las Vegas Drive to pick up Mariah and her sister but had been unable to find the older girl, Oceanside police spokesman Tom Bussey said.The woman reported that her son -- the girls' father -- had been evasive about the whereabouts of his elder daughter and had blood on him, Bussey said.Officers went to the residence near Emerald Isle Golf Course and searched it, finding the victim's body in a bathroom. Detectives questioned Araujo and took him into custody on suspicion of murdering his daughter, Bussey said.Araujo's arraignment was initially scheduled for last Friday, but was postponed twice because he was being held in ``enhanced observation housing,'' according to court staff.Members of the girl's family gathered at the Vista courthouse last Friday and told reporters that Araujo was unstable and should not have been anywhere near his daughters.Karina Avina, Mariah's aunt, said Araujo did not have custody of the children as numerous Child Protective Services cases were open and ongoing against him, though the circumstances of those cases was unclear.``We want him to pay the max. That's what we want,'' Avina said. ``We don't want a few years. We don't want him to get out. He needs to pay his whole life.''Araujo is being held without bail.
