EL CAJON (CNS) - A driver whose blood-alcohol content was nearly quadruple the legal limit slammed into the back of a pregnant woman's car in Ramona two years ago, killing the woman and her unborn child, a prosecutor told a jury Wednesday.But a defense attorney denied that his client caused the crash, claiming the prosecution's case was based entirely on circumstantial evidence and a shoddy police investigation.Andrew Milonis, 46, is accused in the Mother's Day 2017 crash that killed 29-year-old Jessica Foderingham and her unborn child, a girl who Foderingham and her husband planned to name Ayanna. The couple then left home for Jessica Foderingham's grandmother's house in Ramona, taking two cars -- Jessica in her Dodge Dart and Christian driving the boys in his Hyundai.He was driving ahead of his wife when he heard a loud bang behind him, saw a dark-colored SUV swerve onto a sidewalk and witnessed his wife's car slam into a tree. An off- duty firefighter helped Foderingham perform CPR until emergency personnel arrived and took her to Palomar Medical Center in Escondido, where she died, according to the victim's husband.Milonis' attorney, Ward Clay, told jurors the crash was "a tragic accident" but said Milonis was not responsible."No one witnessed exactly how the accident happened," Clay said.The attorney said Christian Foderingham never got a good look at the SUV driver.Foderingham testified that the SUV had tinted windows and there might have been two people inside. He could only confirm that the driver was Caucasian.Clay claimed that at the time of the crash, Milonis was not near the crash scene.The attorney also said the California Highway Patrol "made major mistakes" in their investigation of the case, and that "critical, forensic evidence" had been lost or destroyed, though he did not specify what that evidence was.Clay said he expected the jury to be "angry and want to hold someone responsible. Disneyland Park has shut down two cooling towers at its park in Southern California following an outbreak of Legionnaires' disease.Orange County health officials said nine people who visited the Anaheim theme park in September developed the disease.An additional three people who had been to Anaheim but not Disneyland got sick too, said Jessica Good, a spokeswoman for the Orange County Health Care Agency. "There is no known ongoing risk associated with this outbreak."Legionnaires disease is a severe form of pneumonia caused by Legionella bacteria, sometimes found in water systems. It is typically contracted by breathing mist from the water that contains it. The source of the mist can be air conditioning units in large facilities, showers or hot tubs. Legionnaires' disease is not contagious between humans.County health officials identified Disneyland Park as a common location of eight of the cases last month, and have been working to identify potential sources, Good said.Disneyland Park informed health officials this month that elevated levels of Legionella had been identified in two of its 18 towers, which were then treated and disinfected.Disneyland took the towers out of service on November 1 and told the health agency it had performed additional disinfecting and testing. It brought the towers back into service November 5, but two days later, they were taken out of service again,she said.Health officials subsequently issued an order that the towers remain shut down until they are verified to be free from contamination. EAST VINCENT TOWNSHIP, Pa. (AP) — Authorities say an armed man who held off SWAT members for 10 hours surrendered after one of them sang him a Christmas carol.Nathaniel Lewis, of Chester County, Pennsylvania, was taken into custody in East Vincent Township early on Dec. 26.The Reading Eagle reports the 34-year-old Lewis allegedly fired at police officers who had responded when a concerned relative reported him acting erratically Christmas night.The shots hit a police vehicle, a house and another vehicle. Police returned fire.Eventually a negotiator got Lewis to agree to surrender after singing "White Christmas" to him.Lewis was charged with multiple counts of attempted homicide, aggravated assault and other offenses. He was being held in Chester County Prison without bail. 791
