SAN DIEGO (KGTV) - A final report from the National Transportation Safety Board points to the probable cause of a 2016 crash into the Navy Pier and dock in downtown San Diego.The Adventure Hornblower collided with the seawall sending people on shore scrambling for safety.According to the August 2017 report, the probable cause is listed as “failure of the port transmission to disengage from the forward propulsion position due to the operating company’s lack of adherence to the transmission manufacturer’s recommended periodic maintenance schedule and the lack of routine maintenance and upkeep of the propulsion system’s equipment.”It also says that the lack of instrumentation to provide a positive indication of thrust direction or an alarm to indicate the propulsion control system was not responding properly to the captain's commands."it was shocking,” said passenger Susan Pendergast. “I mean it was just shocking.”Pendergast says when the vessel hit the dock she was thrown to the ground, re-injuring an already bad back.She eventually had surgery in two different places.“It’s left me certainly not with the life I once had,” she said.Following the collision, an official with Hornblower told 10News it could be related to a possible mechanical failure.A few months later court documents pointed toward an unforeseeable and unpreventable mechanical failure despite proper maintenance, the fault was caused by the neglect of others.The NTSB report disputes that finding.When talking about the collision, the report states,  “As the Adventure Hornblower approached the pier on the accident date, the port transmission failed to respond to the captain’s helm orders. Investigators believe that the fault occurred between the servo-actuator, the mechanical linkage, and the control unit, most likely due to neglected maintenance to the port transmission and control system.”In a statement, a spokesperson for the Hornblower disputes the NTSB’s findings writing, “Hornblower Cruises & Events continues with safe, daily operations, following the allision of Adventure Hornblower back in 2016. On that day, the initial response of our captain and crew to address all immediate safety concerns and ensure the well-being of all guests aboard, was exceptional. Hornblower has noted several inaccuracies in the NTSB report on this matter, and therefore disagrees with its determinations as to the probable cause of the allision.  Due to ongoing product defect litigation, Hornblower cannot comment further at this time. Hornblower, deeply appreciates the amazing loyalty of our customers and guests over the years, and we continue to work with care and diligence, every day, to deliver on that trust.” 2739

SAN DIEGO (KGTV) - A Chula Vista World War II veteran celebrated the 100th birthday of a lifetime, with help from hundreds of strangers.The celebration was made possible through Arthur Brook, a 9-year-old dedicated to preserving the stories of WWII veterans. He's been interviewing veterans living at the Veterans Home of California, Chula Vista"Since they were at least in their 90's, to be registered in the military during WWII, they wouldn't be here for much longer," said Arthur.When Arthur learned Army veteran Edwin Schwimmer was turning 100 in September, he wanted to give him a special gift. "We quickly made a decision to make it the most special birthday in a long time!" the 9-year-old added.Arthur put out a call requesting birthday cards and received hundreds from around the country. "So many people thought to send him cards, I just wanted to thank them all, who sent cards to Edwin Schwimmer to thank him for his service to our country," said Arthur. Schwimmer was stunned at the number of people who took the time to write him a letter. "There's no words I can express how I feel," said Schwimmer, "I'm the luckiest guy in the world, the luckiest guy in the world."Arthur says he'll continue his mission to interview as many WWII veterans as possible. 1277

SAN DIEGO (CNS) - The Surfrider Foundation released its annual Clean Water Report Friday, detailing the measures the organization has taken to improve water quality in San Diego County and quell sewage contamination of local shorelines. The report gives an update on the organization's Blue Water Task Force as well as analysis of water quality case studies in Depoe Bay, Oregon; Oahu, Hawaii; Palm Beach County, Florida; and San Diego. The Blue Water Task Force, Surfrider's volunteer water testing group, has increased its number of water tests by at least 12 percent each of the past seven years, according to the report. Task force volunteers conducted 6,826 water quality tests across the country in 2018. Last year, the Surfrider San Diego chapter's Blue Water Task Force focused primarily on ending sewage runoff into the Tijuana River, which subsequently flows into the Pacific Ocean and affects the county's beaches and coastline. According to the report, sewage contamination caused closures of Imperial Beach's shoreline for roughly half of each year from 2015 to 2017. In 2018, Surfrider San Diego established Blue Water Task Force testing labs in Imperial Beach, Coronado and at the chapter's office west of Mira Mesa to improve local water testing efforts. According to the report, the organization's volunteers collect and test water samples each Thursday along the shoreline from Imperial Beach to Pacific Beach. ``In areas like San Diego, California, where communities are impacted year-round by cross-border water pollution ... Surfrider's work to protect clean water is more critical than ever,'' said Mara Dias, the organization's water quality manager. ``Our chapters are tackling regional water quality issues by testing for pollution, building ocean friendly solutions, and informing the public where it's safe to surf, swim and play in the ocean." Surfrider San Diego filed a lawsuit against the U.S. section of the International Boundary and Water Commission last year, alleging that the body has repeatedly violated the Clean Water Act and put the health and safety of local residents in jeopardy by improperly managing the pollution from the Tijuana River. The cities of Imperial Beach and Chula Vista and the Port of San Diego have joined Surfrider's lawsuit, while the city of San Diego and California Attorney General Xavier Becerra have filed a similar suit against the IBWC. SAN DIEGO (CNS) - Virulent Newcastle disease was detected this weekend at a property in central San Diego County, a state veterinarian said Sunday. Friday's detection was identified when a private veterinarian submitted dead birds to the California Animal Health and Food Safety Laboratory System, according to state veterinarian Dr. Annette Jones. Response team members from the California Department of Food and Agriculture and the U.S. Department of Agriculture are working through the Labor Day weekend on control measures, including restriction of bird movement, mandatory euthanasia of infected and exposed birds, and surveillance testing near the property where infection was detected. "We are moving quickly to investigate the origin of disease as well as any movement of birds or equipment that could carry infection," Jones said in a statement. Detections of virulent Newcastle disease have decreased greatly over the last few months, she said. "Our priority remains to stop the spread of the virus and eradicate the disease," Jones said."We have made significant progress toward this goal by identifying and clearing remaining pockets of disease, but this case reminds all bird owners in Southern California to remain aware of VND signs, practice good biosecurity, stop illegal movement of birds from property to property, and report any sick birds immediately to the Sick Bird Hotline, 866-922-2473."Members of the 'home flock' community encourage keeping your birds where they are, wash your hands, change your clothes and shoes after contact with the birds to prevent the spread of the disease.The disease put California on a quarantine, keeping businesses from buying new chickens, leaving cages empty. SAN DIEGO (CNS) - Two women were arrested and nine people were detained Friday morning following a break-in at a nearby liquor store, police said.Dispatchers received a call shortly before 3:30 a.m. from a person who reported seeing video of people breaking into the Valley Liquor store in the 1200 block of Hotel Circle, San Diego police Officer Scott Lockwood said.Officers responded to the scene and learned the suspects were possibly in a room at a nearby hotel, Lockwood said.They went to contact the suspects at the hotel room and ended up detaining 11 people for questioning.One male detained became unruly with officers and was placed into the back of an SDPD vehicle, where he continued to act out.Two women were eventually arrested on suspicion of burglary, but their names and ages were not available, Lockwood said. 835
