SAN DIEGO (KGTV) — A judge has issued a temporary restraining order against the City of San Diego, barring them from removing pepper trees in Kensington.The trees are more than 100 years old, planted when the neighborhood was first marketed as a housing development in the early 1910s. While the neighborhood was once filled with them, resident Maggie McCann estimates there are only about 33 left.“I think they are pretty looking,” said McCann. “They’re part of the fabric of the neighborhood.”McCann was one of the residents who filed the TRO against the city. She said she has been working for more than a year to designate the remaining pepper trees as “Heritage Trees” and “Parkway Resource Trees” under the City’s Conserve-a-Tree program.When she heard a pepper tree on the 4500 block of Edgeware Road had been cut down on Monday, she rushed to process the TRO.“We don’t know why these trees are being cut down,” said McCann.McCann suggested it may be related to a plan to bury SDGE utility lines in the neighborhood, but the City of San Diego denies that claim.In a statement to 10News, a city spokesperson said the tree that was cut down Monday had been “evaluated more than a year ago as part of a project to repair a damaged and uneven sidewalk caused by the tree’s growth. Noticeable decay and deteriorating tree structure were also observed during the evaluation and the adjacent property owner was notified at that time.”On Tuesday, the remnants of the trunk remained on Edgeware Rd. Decay could be seen in the interior part of the tree, though much of the large trunk appeared to be healthy.“The tree really didn’t need to be removed,” argued McCann.But the city said their decision was more about damage to the sidewalk than whether the tree could have survived a few more decades.“In this instance, the imperative to make the sidewalk safer for residents was weighed against the city’s desire to preserve neighborhood trees and continue to grow our urban canopy. Due to the tree’s damaging impact to the adjacent sidewalk and its decaying state, the decision was made to remove it in order to preserve public safety,” wrote the city spokesperson.A resident on the block said the sidewalk had been recently replaced. The new pavement had been cut around the tree and was undamaged.Several other pepper trees in Kensington have been marked for removal. On Tuesday, McCann walked the streets, posting copies of the TRO on the trees.The fate of those trees remains unknown. SAN DIEGO (KGTV) – A man was fatally shot by San Diego Police as officers responded to calls of vandalism in the Mountain View neighborhood early Monday morning.According to police, officers were called to the 300 block of South Pardee Street just before 4:30 a.m. after receiving reports of “a violent disturbance involving a weapon.”Residents at the home were woken up by a man they say ripped a metal curtain rod from the window and began breaking windows and other objects.“Fearing for their safety, they asked another resident to call 911. A neighbor also heard the commotion and called 911 reporting it sounded like someone was being tortured,” police said.When officers arrived, police say they gave the man directions in English and Spanish but received no response. According to police, that’s when the man crawled through a broken window before running towards officers with a metal pole.“Fearing for their safety, one officer fired a bean bag round, one officer fired a Taser, and one officer fired several rounds from his service pistol. SAN DIEGO (KGTV) - A juvenile was arrested Wednesday for allegedly making a threat against a San Diego Unified School District high school.The juvenile was arrested at Serra High School for the alleged threat, according to SDUSD. The suspect told school police the comment was not meant to be taken seriously. While police deemed the threat non-credible, they determined the comment meant the definition of a criminal threat.The language of the threat and how it was issued was not immediately clear.RELATED: DA: Nine minors charged in recent threats to local schoolsClasses at Serra High were held on a normal scheduled Wednesday despite the report. There was reportedly no increase in police presence on the campus either.SDUSD official called for a press conference on Friday at 10:15 a.m. at the Education Center to address the increasing number of local school threats over the past month.Since the Parkland, Fla., school shooting in February, at least 24 school threats have been investigated at county schools.Of the threats, District Attorney Summer Stephan has charged at least nine juveniles."We can't assume that the threat is a joke," Stephan said. 1208

He’s known for backing progressive candidates and shaking up elections, usually with controversial ads.The ad lays out Geneviéve Jones Wright’s qualifications to be San Diego County’s next District Attorney. It does not attack her opponent Summer Stephan, which is what most politicos expected.Jones Wright told 10News she had not seen the ad.Stephan’s campaign manager said he’s surprised the ad is more of an introduction than an attack. For a Better San Diego initative.The initiative, which will appear on the March ballot, has bipartisan support and seeks to address the city's homelessness issues, street repairs and job creation with a hotel tax increase. Supporters say the initiative would generate 7 million in the first five years. According to San Diego Mayor Kevin Faulconer, the highest hotel tax increase would be in downtown San Diego at 3.2 percent, with 2.25 percent for hotels on the outskirts of downtown and 1.25 percent for hotels on the outskirts of the city.San Diego's current transient occupancy tax is 10.5 percent."It's not only about the thousands of jobs that you just heard, the infrastructure and the roads, the most important issue that is facing our city the issue of homelessness and for the first time a dedicated funding stream," said Faulconer.He said the initiative would also expand the San Diego Convention Center and create 7,000 new jobs.Some tourists tell 10News raising the hotel tax could backfire and make some visitors simply stop coming to San Diego on vacation."It probably means I'll choose somewhere else next time I travel, somewhere more affordable for me," said one tourist who did not want to be identified."I definitely think it's important to deal with the homeless population and expand your economy, but I don't think that should happen with your tourism dollars.
