VISTA, Calif., (KGTV) — The man and woman accused of fatally stabbing a Carlsbad woman in March appeared at their preliminary hearing on Wednesday. Ian Bushee and Malissa James pleaded not guilty to all charges, including murder and burglary. The District Attorney called several witnesses, playing 911 calls and never-before-seen police body camera footage in the courtroom. The 911 call was from the victim, Marjorie Gawitt.Dispatcher: 911. What's your emergency?Marjorie: (inaudible) I've been attacked. That was the beginning of Gawitt's dying message on the morning of March 11, 2019. The 63-year-old woman was sleeping in her Carlsbad home alone when police said Bushee and James tortured and stabbed her fifty times in the face, neck, and back. Dispatcher: We've got help sent out to you, Marjorie. Who did this?Marjorie: I don't know. It took everything Gawitt had left in her to make that 911 call. The call was so tragic, officers testifying on the stand became choked up while listening to Gawitt's voice. Because of her final act of courage, Officer Randy Noa found her minutes later, still alive. On his body camera video, you can hear him trying to speak to Gawitt."You okay ma'am? Oh. Ma'am. Is he still in here or did he leave? (PAUSE) I can't hear you, ma'am," Officer Noa said, breathing heavily."It looked like she was trying to say to me that he was gone. But it was hard," Officer Not testified inside the courtroom. The District Attorney also played a second body camera video, worn by Officer Derek Harvey. On it, you can hear him trying to console the victim. "Ma'am, you're going to be okay. The paramedics are going to be here, any second, okay?" Officer Harvey said. Minutes later, Harvey's camera recorded him finding what looked to be the weapon on the counter."Her eyes were clouded, dilated and fixed," Officer Harvey said. "I knew she was... probably not going to make it." He was right. Despite the paramedics arriving quickly, Gawitt died at Scripps La Jolla Hospital. With the only eyewitness now gone, investigators were back at square one. What they did know was that the victim's gold car was missing, so they worked to track that down. Hours later, surveillance video captured the victim's stolen car in San Marcos. The suspects were taped walking around near a masonry warehouse and at a 7-11 store. Investigators said the two later ditched the stolen car in San Marcos, and for some reason, rode a bus back into Carlsbad. The two were later arrested near the original crime scene. Police said it turns out Gawitt's home was not the first the pair had ransacked that day. "I looked up, and I said something is missing here," neighbor Patricia Gapik said. That same morning, Gapik noticed her sewing basket and her daughter's flute were gone. Random items were also scattered near her sliding glass door. "I then realized that someone was in my house," Gapik testified. "I was scared."Luckily, Gapik was asleep the entire time, and never confronted the burglars. But investigators later found that the two cases were connected. They found some of Gapik's belongings inside the car left in San Marcos. The suspects, Ian Bushee and Malissa James were the same. Thursday morning, the Medical Examiner will be giving his testimony on Gawitt's fatal injuries. 3303

WARNING: Some information in this article is disturbing.LEBANON COUNTY, Penn. – A Pennsylvania father and his fiancée have been charged with the killing of the man’s 12-year-old son, whose body was found in horrific conditions earlier this year.The Lebanon County District Attorney’s Office said in a press release Monday that police found the body of Max Schollenberger on May 26, completely naked and sprawled across a bed on the second floor of his family's home in Lebanon County.The DA says Max’s body appeared malnourished, and the boy and the bed he was on were completely covered in fecal matter. Detectives reported claw marks in the sheets and said the marks made indentations on the stained feces.Max’s bedroom was entirely devoid of light and furniture, aside from the bed where he died, according to the DA. Shades were reportedly taped to the room’s windows and doors were screwed shut over them, so the child couldn’t see out.The DA says the door to the room had three metal hooks, which Max’s father, Scott Schollenberger, and his fiancée, Kimberly Maurer, admitted to using to lock the boy inside.During an investigation of Max’s life and ultimate death, detectives learned Kimberly had acted as the victim’s mother for the past decade and that she had other biological children with Scott. The DA says those kids lived in the same house, but they were “healthy, well-adjusted and cared for.”When the other children were interviewed, they reportedly described the stench that emanated from Max’s room and how their parents refused to let the boy out.“One child specifically remembered the defendants would enter the victim’s room and Max Schollenberger would scream and cry,” the DA said. “The child also recalled the defendants discussed bruises on the victim’s body.”The DA says family members and acquaintances reported they had not seen Max in quite some time, and certain people connected to the family were entirely unaware of the boy’s existence.At 12 years old, the DA says Max was never registered for or attended school, and he also hadn't received any medical care since was 2 years old.A forensic autopsy led to multiple findings compatible with starvation and malnutrition and multiple blunt force traumas throughout the child’s head, face, and body, according to the DA. Specifically, a doctor found Max weighed just 47.5 pounds at his death and was only 4 feet 1 inches tall.“He was nowhere near the size, weight, or stature appropriate for a child of his age,” said the DA. “All four of the child’s limbs showed a severe lack of muscle mass; his bones themselves showed a weakened state.”The doctor concluded that Max died as a result of blunt force head trauma complicating starvation/malnutrition, and his death was ruled a homicide.Scott and Kimberly are accused of starving, neglecting, abusing, and ultimately killing Max. They’ve been charged with criminal homicide, conspiracy to commit criminal homicide, endangering the welfare of a child, and conspiracy to commit endangering the welfare of a child.“Today marks the first step in the long path of justice for this little boy. Max Schollenberger existed – I will not call this living – in a state of perpetual suffering; he existed in the most egregious and foul of conditions. He remained starved, locked away, and isolated until his killing. This child never looked forward to his first day of school, blew out candles on a birthday cake, or experienced the unconditional love of family. Max Schollenberger died in soiled sheets, covered in his own feces,” said District Attorney Hess Graf. “Murders such as these are haunting, both for the community and for the law enforcement involved. I want to commend our Detective Bureau and the Annville Township Police for their thorough and detailed investigation. Our Office will always fight for vulnerable, defenseless victims. The utter despair that was Max Schollenberger’s life begs for justice for his death.” 3961

  

Walmart is going into the health insurance business.The company announced on Tuesday that they are launching Walmart Insurance Services to "assist people with enrolling in insurance plans—and simplify what's historically been a cumbersome, confusing process.""We want customers to feel confident in selecting a Medicare plan that best fits their needs, budget, and lifestyle," David Sullivan, general manager of Walmart Insurance Services, said. "And we want to be a trusted partner on their health care journey. Helping customers select the right Medicare insurance plan to meet their needs aligns with Walmart's mission of helping people save money and live better."The Bentonville-based retail giant said they would begin selling Medicare insurance plans starting Oct. 15 through Dec. 7.The agency is licensed in all 50 states, plus Washington D.C.It will provide Medicare plans (Part D, Medicare Advantage, and Medicare Supplement plans) through Humana, UnitedHealthcare, Anthem Blue Cross Blue Shield, Amerigroup, Simply Health, Wellcare (Centene), Clover Health, and Arkansas Blue Cross and Blue Shield, the company said.Walmart might add more carriers in the future, Walmart said. 1195

  

VIENNA (AP) — Officials say at least two people were killed and 15 others wounded in Vienna after multiple gunmen opened fire on people enjoying a last evening out before lockdown in the Austrian capital. Austrian Chancellor Sebastian Kurz confirmed that one attacker was killed in what security officials were calling a terror attack. Austria’s top security official said authorities believe there were several gunmen involved and that a police operation was still ongoing. Interior Minister Karl Nehammer told public broadcaster ORF that the perpetrators were armed with rifles. He said the army had been asked to guard key locations in the city to allow police officers to pursue the suspected attackers." 717
