SAN DIEGO (KGTV) - A Marine Corps. family won a -million lawsuit against Lincoln Military Housing after they say mold sickened their children.The Charvat family moved to San Diego's military housing near the Marine Corps. Recruitment Depot in April 2015. Father and husband Matthew worked at MCRD.The lawsuit lists disturbing symptoms the family dealt with, including "diarrhea, dizziness, drowsiness, irritated eyes, watery eyes, fatigue, stuffy nose, sinus congestion, itchy skin, sneezing, sore and dry throat, chest tightness, runny nose, lethargy."Anna, 9, was brought to tears when she described what she and her family endured, "my breathing was bad, I got sick a lot and my brother," she said choking up.Her mother, Leigh, said she had to take Anna to the emergency room after Anna woke up in the middle of the night gasping for air.When it came to her 6-year-old son Johnathan, "you could hear him breathing downstairs, it was very loud we used to say he sounded like Darth Vader."She said she tried everything from a different diet to going to doctors to try and figure out why her family was sick."I felt everyone thought I was crazy. Doctors, family thought I was crazy," she said in anguish. Then, the family found vents covered in black mold."It was shocking, I was disgusted," Leigh said, but she was also relieved to find an answer."Okay this is it, let’s get rid of it and let’s get on with our lives so we can get back to the way things were," she said.The lawsuit stated the defendant, Lincoln Military Housing, "negligently, improperly, recklessly and in a non-controlled manner, exposing Plaintiffs to excessive moisture, dampness, and humidity, as well as microbial contamination."Leigh said the company tried to "put a band-aide" on the situation and didn't try to find the source of the mold, "we were still sick after all their attempts to clean."The family moved out and had to throw away toys and furniture to keep from contaminating their new home. SAN DIEGO (KGTV) - A landmark Supreme Court ruling today extended workplace protections for LGBTQ workers nationwide.Years ago, and a few months into a new job in San Diego, Lina Craychee says she came out as transgender and was promptly transferred from a store location to a corporate job."My boss told me I had to. They wouldn't let me present as female in the store level, because it would hurt business," said Craychee.Craychee says she kept silent and accepted the transfer because she needed the job. It's the type of silence she hopes will fade away after an historic Supreme Court ruling. By a 6-3 majority, the court extended 1964 Civil Rights Act protections to LGBTQ employees, who now can't be fired or discriminated against in the workplace because of their sexual orientation.While California protects LGBTQ workers against discrimination, nearly 30 states do not."Huge feeling of relief and victory," said Eddie Reynoso, executive director of the Equality Business Alliance in San Diego.Last fall, Reynoso camped for 72 hours on the Supreme Court steps for the opportunity to witness the arguments."In terms of impact, this will be bigger than the marriage equality ruling," said Reynoso.Reynoso says the ruling sends a powerful message across the country."Ultimately it means the workplace is going to be a safer place. LGBT workers will have an affirming work environment," said Reynoso.While this ruling is directed at the workplace, experts say this could open to door for other challenges involving LGBTQ discrimination. SAN DIEGO (KGTV) -- A parole board Tuesday granted parole to an actor previously convicted of stabbing his ex-girlfriend nearly two dozen times.Shelley Malil, who had a supporting role in the movie “The 40-Year-Old Virgin,” was convicted seven years ago of repeatedly stabbing Kendra Beebe in San Marcos.Beebe spoke to 10News after Malil was granted Parole. “Why are we letting out this person who’s going to go back out and go back on the internet and date and possibly relapse and hurt somebody else.” RELATED: 40-Year-Old Virgin actor deemed suitable for parole, 10 years after brutally stabbing ex-girlfriendAs of this year, Malil had served 9 years of his 12-years-to-life sentence. SAN DIEGO (KGTV) - A sailboat and power boat collided near the Coronado Bridge Sunday afternoon, injuring four people, according to San Diego Harbor Police.A good Samaritan drove by and noticed people floating in life jackets as their boat took on water. He picked up nine people and ferried them to Pepper Park. "It's just what you do you're a boater, it's what you're supposed to do, you help out on the water, people have helped us and we've helped other people," Kary Brownlee said.The damaged powerboat, a Bayliner, was towed back to the Pepper Park launch ramp where four passengers were evaluated for minor injuries. No one was taken to the hospital.The sailboat cruised back to Coronado on its own power."All it takes is a split second, when the captain is not paying attention that could cause a collision," boat safety advocate Amos Zolna said. He explained sail boats generally have the right of way, as they are harder to maneuver, compared to a power boat. Zolna said it's hard to navigate near the bridge, due to the large pillars that create blind spots.Harbor Police reported the 911 call at 1:28 p.m. They are investigating the cause of the crash and if any alcohol was involved. 1204

  

SAN DIEGO (KGTV) - A man involved in a DUI hit-and-run crash that seriously injured a young boy in the South Bay started his sentencing hearing Wednesday for violating federal immigration laws.Constantino Banda Acosta, a Mexican national who had previously been deported from the U.S. at least 15 times in the past, has been in federal custody since March over federal criminal re-entry charges.He was transferred to federal custody after charges against him stemming from a 2017 crash were dismissed.Banda faced charges in the May 6, 2017, crash in San Ysidro that sent young Lennox Lake to the hospital with serious injuries, including head trauma.Banda was initially charged with drunk driving and hit-and-run after authorities said he ran a stop sign at Dairy Mart Road and slammed his pickup truck into the Lake family’s car as they were heading home from a Disneyland trip.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152.Following a mistrial, a judge dismissed the case against Banda in March, saying there was no clear evidence that showed he was behind the wheel at the time of the crash.Banda’s lawyers had argued that another man in the truck, Jorge Adame Ariza, may have been driving the truck after a night of drinking with Banda.Adame said Banda got into a fight with another man outside a Chula Vista restaurant before the crash.
