VISTA, Calif. (KGTV) -- The San Diego District Attorney is expected to decide later this week whether there should be a new trial in the case of Kellen Winslow Junior.Tuesday morning, the judge declared a mistrial after the jury said it was deadlocked on eight remaining counts. The counts include kidnapping, forcible rape and forcible oral copulation involving a hitchhiker last year in Encinitas and forcible rape and rape of an unconscious person for an alleged attack on a teenager at a party in Scripps Ranch back in 2003 when she was 17 and Winslow was 19. The other counts the jury deadlocked on are willful cruelty to an elder and battery against an elder. The prosecutor said the jurors were leaning toward conviction. "On each one of the counts, there were a majority of jurors who voted in favor of guilt. They voted 10-2 in favor of guilt on forcible sodomy of Jane Doe 2. They voted 10-2 in favor of guilt for the forcible rape of Jane Doe 4. They voted 10-2 in favor of guilt on the counts of elder abuse and elder battery regarding Jane Doe 5 and then they voted 8-4 in favor of guilt on the rape of an unconscious person for Jane Doe 4 and they voted 7-5 in favor of guilt on the kidnap for rape, forcible oral copulation and and forcible rape of Jane Doe 1," said Prosecutor Dan Owens. Defense attorneys said the deadlocked jury shows there were credibility issues among the accusers. There was no corroborating evidence whatsoever, it's just people's word," said defense attorney Brian Watkins. The case involved 12 counts and the testimony of 5 women."We were always concerned about trying the cases together. Our position was always that these cases would not be able to stand alone. We fought to keep the cases separate. We lost that battle. We took on all these cases at once and we still prevailed to the point that we did not get convicted of everything and we have more litigation to do," said Watkins. Monday afternoon, the jury convicted Winslow of raping a 58-year-old homeless woman in Encinitas last year. Jurors also found the former NFL tight end guilty of indecent exposure and lewd conduct involving two other women. He was acquitted of a second count of lewd conduct involving one of those women. Watkins said they'll appeal the three convictions. "We won't be satisfied until he's exonerated and he's back home with his family," said Watkins. "Right now, he's facing eight years in state prison, life time sex offender registration for the forcible rape of Jane Doe 2. He'd be facing an additional 6 months for each 1 of the misdemeanor counts of indecent exposure and lewd acts committed against Jane Does 3 and 5, for a total of potentially 9 years in prison," said Owens. Sentencing is on hold until a decision is made about a new trial. Winslow's father, Kellen Winslow Senior, a Chargers Hall of Famer attended every day of the trial, but declined to talk to the media. A hearing is scheduled for 10 a.m. Friday on setting a new trial. "Ten jurors did feel very strongly that he had committed forcible sexual offenses against more than one victim, that would lead to a lifetime prison term and that will be another factor we will consider very strongly in determining how to proceed with the case," said Owens. 3618

WASHINGTON (AP) — Just 7 years old, Jackeline Caal was picked up by U.S. authorities with her father and other migrants this month in a remote stretch of New Mexico desert. Some seven hours later, she was put on a bus to the nearest Border Patrol station but soon began vomiting. By the end of the two-hour drive, she had stopped breathing.Jackeline hadn't had anything to eat or drink for days, her father later told U.S. officials.The death of the Guatemalan girl is the latest demonstration of the desperation of a growing number of Central American families and children showing up at the U.S.-Mexico border, often hoping to claim asylum, and it raises new questions about how well authorities are prepared.Customs and Border Protection said Friday that the girl initially appeared healthy and that an interview raised no signs of trouble. Her Spanish-speaking father signed a form indicating she was in good health, authorities said, though a Guatemalan official said late Friday that the family's native language was a Mayan dialect.CBP Commissioner Kevin McAleenan said agents "did everything in their power" to save her.The episode drew immediate questions from members of Congress and others about whether more could have been done. There were only four agents working with a group of 163 migrants, including 50 unaccompanied children, and only one bus to take them to the nearest station 94 miles away. Jackeline's father appeared to have signed the form, which was obtained by The Associated Press.The final question is whether she should be in a general population, referred for non-emergency medical care or referred for emergency medical care. The "general population" box is checked.Arresting such large groups poses logistical problems for agents, who have to wait on transport vans that are equipped with baby seats to take the migrants to processing facilities, some which are far from the border.There is a single bus that transports migrants to and from this area to the base in Lordsburg, and, following protocol, the other minors filled the first bus while the daughter and her father waited.It's not clear whether Jackeline ate or drank anything while in custody.The father and daughter did not board the bus until 4:30 a.m. She began vomiting at 5. The bus continued — there was no way to receive medical care where they were, officials said — and radioed ahead to have emergency medical technicians available when they arrived in Lordsburg. By the time they arrived, at 6:30, she had stopped breathing.Emergency crews revived her, and she was airlifted to an El Paso, Texas, hospital, while the father was driven there. The girl died at about 12:30 a.m. Dec. 8. Officials said she had swelling on her brain and liver failure. An autopsy was scheduled to determine her girl's death. The results could take weeks.CBP said Friday it didn't immediately publicize the death out of respect for the family but is reviewing its disclosure practices. Tekandi Paniagua, the Guatemalan consul in Del Rio, Texas, said the family's native language was Ki'che', a Mayan dialect spoken in the country's highlands.Arrests in the U.S. have surged since summer, with many prospective migrants coming from the highlands, where Mayan dialects flourish.In many ways, the group of 163 migrants that included the girl offers a snapshot of how dramatically the border has changed in recent years. In November, there were 51,001 arrests of people entering the country illegally from Mexico — the highest of Donald Trump's presidency — and more than half were traveling as families or unaccompanied children.It was unclear if any in the group expressed fear of returning home, but families and children increasingly seek out agents to pursue asylum or other humanitarian protection, avoiding an often life-threatening effort to elude capture in remote areas.The Trump administration has made curbing illegal immigration a signature issue — and some advocates say its policies are prompting more people to cross in perilous ways. Immigration officials say their system is strained and not equipped to handle such a high volume of families who can't be easily returned, but there is resistance to suggestions to change facilities to better accommodate families. (KGTV) - Kellen Winslow Jr. affirmed his innocence to 10News Thursday as he appeared in court to face a third charge of rape.The son of a Chargers legend, Winslow pleaded not guilty to the alleged rape a 17-year old girl in 2003.  10News was able to capture a few words with Winslow as he walked to his car in the parking lot outside court. When reporter Jim Patton asked about the new rape charge, Winslow responded it would all come out in court. Then asked if he was innocent of the other allegations of raping two women in Encinitas, Winslow said, "I'm advised by my lawyer to not speak on much. But yes, I am innocent." The new charge involves a woman who was 17 years old at the time. Winslow was 19. She claims he raped her while she was unconscious. Winslow Jr.'s attorney has previously said their relationship was consensual.  Thursday, the defense repeated a request for the woman's psychological history.Thursday's court hearing lasted no more than 15 minutes as attorneys debated whether this new case should be tried along with the other two rape allegations. Winslow Jr.'s attorneys argued the new charge could prejudice the other two.The judge allowed the cases to remain joined for now for efficiency but said the trial judge would make the ultimate decision.  Winslow is currently free on a million bond, while required to wear a GPS monitoring bracelet. His trial date was set for March 19th, 2019. 1507
