SAN DIEGO (KGTV) - The Medical Board of California (MBC) has filed an order to revoke the license of Dr. Jeffrey Lovin, a San Diego County radiologist who’s facing charges related to prowling and peeking.ABC 10News first reported on Dr. Lovin last year after his ex-girlfriend shared home security video of a man lurking in her North County backyard while she and her fiancé were inside. She said the man in the video is Dr. Lovin.He’s been charged with multiple counts related to prowling and peeking and violating a protective order. He’s pleaded not guilty and will stand trial next March.Dr. Lovin was already on probation with the MBC for other criminal activity.The Board has now issued an order to revoke his license on Dec. 18 for mental or physical impairment and unprofessional conduct by failing to comply with the terms of his probation.“We never know if we're safe,” his ex-girlfriend told ABC 10News on Tuesday. We’re not using her name or showing her face. She said that she and her fiancé Frank Zeigler still live in fear. “I hear any noise at night and I'm out front seeing what's going on at my home,” he said and added, “We lock all our doors and keep all our blinds closed around the clock.”“We want him to lose his license so he doesn’t do this to anybody else and we feel like this is the first step toward a little justice,” Zeigler later added.On Tuesday, ABC 10News spoke to someone at the law office that has represented Dr. Lovin. She declined to connect us to with him to see if he wanted to offer any comment.On Tuesday, a spokesperson for the Board wrote to ABC 10News, “Dr. Jeffrey Lovin may practice medicine under the terms of his current probation until the revocation of his license takes effect on Dec. 18, 2020. Dr. Lovin may petition the Board for a stay and reconsideration of the decision to revoke his license or file a writ in superior court to challenge the decision before it comes effective.” 1945

Starting October 1, 2020, U.S. residents will need a REAL ID to fly domestically or enter secure federal facilities and military bases. The new ID is the result of the 9/11 Commission's recommendation to establish standards for identity verification and security features. In California, a gold bear and star indicates REAL ID compliance. The DMV is also reminding residents about requirements to obtain a REAL ID. SAN DIEGO (KGTV) -- The Carlsbad Police Department released body camera footage Saturday night in response to public concerns over officer misconduct during an incident involving a 27-year-old black man.The June 11 incident gained attention after cell phone video surfaced showing officers using a Taser on the man and pressing his head into the pavement in an attempt to subdue him."A video is circulating showing a police use of force incident from Thursday night. Open lines of communication between the Police Department and the community are more important now than ever," Carlsbad police said in a statement."As with all uses of force, we fully investigate incidents to ensure the officers’ conduct is consistent with the Police Department’s policies," police said.The cell phone video doesn't show the start of the incident. The witness video begins with the man on the ground surrounded by paramedics and two officers lying on top of him.The newly released six-minute body cam video starts from the moment two officers respond to the scene. According to the department's timeline of the incident, officers and paramedics responded to a call at 8:48 p.m. about a man found face down on a sidewalk at Ponto Road and Carlsbad Boulevard."Two officers arrived and found the firefighters evaluating the man, who was now standing," police said.Bodycam footage shows the man talking with paramedics, and the group appears to disperse. With the officers approaching, the paramedics step away from the man. The man tells the paramedics, "I'm not complaining about anything else."The man appears to hear something from the group of paramedics and screams out, "are you mocking me?"A paramedic tells the man, "No, I'm not mocking you at all."One officer says, "Hey, they're just here to help you, man."The man stands face to face with the paramedic telling him, "the way he said it is different from how you said it. Because I understand how the f--- you say it. But what do you mean when you say it?"According to the police timeline, "The man walked quickly toward the medics while continuing to yell profanities. Officers, fearing for the safety of the medics, interceded."The report says, "Officers reached out to the man and told him to stop."A struggle ensues and the body cameras are knocked to the ground leaving only an audio recording of the incident for about two minutes. The officers pick up the cameras and resume video recording the scene about two minutes later.The department juxtaposed three camera angles of the confrontation with the man -- two from officer body cameras, and one that was recorded by an unidentified "resident." The witness video fills in a section of lost body cam footage.Carlsbad police said the investigation is still ongoing and are asking the public who may have witnessed the incident to contact the department at their non-emergency line at 760-931-2197.The man in the video, Marcel Cox-Harshaw, 27, of San Diego, was cited and released for resisting arrest. Police also charged him with being drunk in public. He was not injured, but he continued to shout angrily. Officers asked him to calm down, but he refused to comply and continued shouting.At 9:03 p.m. Officers considered the man detained.A mesh bag called a spit mask was placed on the man’s head to protect the officers and paramedics from coming into contact with droplets coming from the man’s nose and mouth This bag is porous and does not restrict breathing.At this time, paramedics were able to place the man on a gurney, where he continued to yell and struggle.At 9:07 p.m. Paramedics transported the man to a local hospital where he was sedated, assessed and released.The man, 27-year-old Marcel Cox-Harshaw of San Diego, was cited and released for resisting arrest. An additional charge of drunk in public has been presented to the District Attorney's Office. The initial investigation indicates that drugs and or alcohol played a role in the incident.The investigation is still ongoing. We are asking any community members who may have witnessed the incident to call the non-emergency police number at 760-931-2197 to share their accounts.Here are some of the department’s policy that pertain to the incidentOfficers shall use only that amount of force that reasonably appears necessary given the facts and totality of the circumstances known to or perceived by the officer at the time of the event to accomplish a legitimate law enforcement purpose.When determining whether to apply force and evaluating whether an officer has used reasonable force, a number of factors should be taken into consideration, as time and circumstances permit. These factors include but are not limited to:o The apparent immediacy and severity of the threat to officers or others – Mr. Harshaw charged unarmed fire personnel while yelling profanities.o The individual’s apparent ability to understand and comply with officer commands – Mr. Harshaw would not comply with officer commands.o The conduct of the individual being confronted, as reasonably perceived by the officer. Mr. Harshaw was yelling and behaving aggressively toward fire personnel.o Proximity of weapons or dangerous improvised devices. – Officers had no way of knowing what was in Mr. Harshaw’s backpack or baggy pants.o The effects of drugs or alcohol. Mr. Harshaw appeared to be under the influence of drugs and or alcohol.o Whether the person appears to be resisting, attempting to evade arrest by flight, or is attacking the officer. Mr. Harshaw was at no time compliant.The TASER device may be used in any of the following circumstances, when the circumstances perceived by the officer at the time indicate that such application is reasonably necessary to control a person:o The subject is violent or is physically resisting. Mr. Harshaw was physically resistant and behaved aggressively toward fire personnel.o The subject has demonstrated, by words or action, an intention to be violent or to physically resist, and reasonably appears to present the potential to harm officers, him/herself or others. – Mr. Harshaw charged fire personnel, while yelling profanities and he was not compliant with officer commands.Supervisory notification shall be made as soon as practicable following the application of force. A supervisor was immediately called to the scene and an investigation was opened. SAN DIEGO (KGTV) -- The leader of a San Diego motorcycle gang pleaded guilty Tuesday to participating in a scheme to seal dozens of Jeep Wranglers in San Diego County. Jimmy Josue Martinez, a leader of the Hooligans motorcycle gang, pleaded guilty Tuesday, admitting to participating in the scheme. According to court records, the gang is responsible for the theft of more than 150 of the vehicles since 2014, totaling about .5 million. Records show that the Hooligans used high-tech methods to disable security systems and steal the Jeeps before taking them to Tijuana to be sold or stripped for parts. RELATED: Three arrested, 6 sought in San Diego Jeep Wrangler theft ringAs part of the plea agreement, Martinez admitted to stealing the Jeeps in Pacific Beach, Serra Mesa, Chula Vista, Mission Valley, Ocean Beach, Hillcrest and North Park. Martinez and members of his crew would obtain the vehicle identification number in advance before getting secret key codes which allowed them to create a duplicate key for a particular Jeep. “The joy ride is over for Mr. Martinez,” said U.S. Attorney Robert Brewer. “These thefts were audacious and sophisticated and created hassle and heartache for scores of Jeep owners. I congratulate prosecutors Andrew Galvin and Joseph S. Green, the FBI and members of the Regional Auto Theft Task Force for putting together a strong case against a gang that, unfortunately, has lived up to its name.”Along with Martinez, eight other members of the gang were charged in a grand jury indictment in 2017. SAN DIEGO (KGTV) -- The California Department of Public Health made a quiet announcement late Monday night that could be a welcoming relief for families all over the state looking for outdoor activities amid the pandemic.Health officials are allowing counties to reopen outdoor playgrounds located in parks, campgrounds, and other publicly accessible locations.But guidance is firm and strict as the state continues to battle the deadly coronavirus pandemic."COVID-19 continues to pose a severe risk to communities and requires all people in California to follow necessary precautions and to adapt the way they live and function in light of this ongoing risk," state health officials said.At the top of the list of requirements is the rule on face coverings. "Face masks over the mouth and nose are required for everyone 2 years of age or older with caregiver supervision at all times to ensure face mask use," officials said.Other rules include a 30-minute limit on visits when others are present, no eating or drinking in playgrounds, and elderly persons and others with underlying medical conditions should avoid playground when others are present."This guidance does not apply to indoor playgrounds or family entertainment centers," the state said.San Diego County has not yet issued a timeline for when the caution tape wrapped around local playgrounds since March will finally come down.Last Tuesday, a group of two dozen state lawmakers sent a letter to Governor Gavin Newsom asking him to create clear guidelines for reopening. San Diego Mayor Kevin Faulconer tweeted his support for the letter.A recent report from the American Academy of Pediatrics reinforced guidelines that say kids 3-5 years old should get three hours of physical activity every day. Provide directions on how to wait in line when maximum playground occupancy has been reached.7. Mark playgrounds to help children and adults maintain 6 foot distancing.a. Mark spaces for families to stand while waiting to enter the playground. The spaces should be far enough apart to allow 6 feet of distance between households.b. For play structures or play areas that can hold more than one child while allowing 6 foot distancing:i. Post the maximum number of children allowed on each structure/in each area to allow 6 foot distancing vertically and horizontally.ii. For play structures or areas that can hold more than 1 child, consider marking with tape or other visual indicators to help children assess whether they are 6 feet apart.c. Mark designated spaces 6 feet apart for children to stand while waiting to use a play structure/area.Additional ConsiderationsIf there is a pre-scheduled activity that will access the playground, the playground must be closed to the broader public during that time.Child care programs, schools, out-of-school time programs and other programs for children and youth where children must remain in cohorts may not use playgrounds during times when they are open to the public. However, if the playground operator permits, the childcare, school or other program may reserve a time for the exclusive use of the playground by the program.
