ENCINITAS, CALIF. (KGTV) -- The return to in-person instruction for some north county students appears to be in legal limbo.Friday, the California Teachers Association filed a legal petition on behalf of the union representing the teachers in the San Dieguito Union High School District. The union wants the district's reopening plan blocked, saying, among other things, it violates the state's public health rules concerning the pandemic.Last Tuesday, the school board voted to give students the option of returning to in-person instruction five days a week on January 27th. Previously, the board voted to return to campus one day a week beginning January 4th.Lori Laroque has two boys in eighth grade at Pacific Trails Middle School. She applauds the board's decision."I was elated, and this was something that should have happened a long time ago," said Laroque.Ann Cerny has been teaching U.S History at Earl Warren Middle School for twenty-seven years. She also has a high school daughter in the district.Cerny says she would love to see kids return to campus, but she says now is not the time."Yes, in-person learning is best, but it's not going to be that 2019 in-person situation, and people aren't seeming to accept that reality," said Cerny, who has been teaching remotely from her classroom.Union leaders estimate up to 20% of teachers won't return if the plan for five days a week in-person instruction goes through.Cerny says she has concerns about exposure to COVID-19, but that isn't her biggest fear."It's the academic chaos that we find ourselves heading towards. I'm just worried that it's not going to roll out well. I'm worried for equity for students. I'm worried for the many, many teachers going out on leave and having subs for classes," said Cerny.The school board president said the district is actively recruiting for teachers and substitutes.No one from the board was available to comment on camera, but President Maureen Muir sent 10News a lengthy statement explaining the reopening plan."The health and safety of our students and staff is the District's highest priority. The District's Safe Reopening Plan follows the guidance issued by the California Department of Public Health and includes detailed protocols for distancing and ventilation.Staff will be encouraged to maintain 6 feet of distancing, as practical, from one another at all times, and teacher desks will be at least six feet away from students. Students will maintain distancing as practicable and in compliance with guidance from CDPH, including arranging desks in a manner that minimizes face-to-face contact. We have evaluated all of our classroom spaces and planned to maximize distancing. We have also planned carefully to maximize distancing for students and staff outside of our classrooms, including before, after, and between classes.The District consulted with ventilation and filtration experts to determine the maximum efficiency our units can handle. MERV 8+ filters were installed in all of our units, which achieves MERV 11 efficiency. Additionally, we purchased and installed HEPA filters in our classrooms, common areas, and offices. We have CO2 sensors in our newer buildings that monitor indoor air quality and we are purchasing more for other spaces.To ensure the continuity of teaching and learning, the District is allowing teachers who are in a high-risk group, or who have a household member in a high-risk group, to teach from home for the remainder of the second quarter, which ends on January 22, 2021.We have also informed teachers who have childcare needs due to COVID-19 that they may also work from home during this same time period. The District has made every effort to work with our teachers to keep them safe and to address their concerns about returning to work. The District is continuing to evaluate potential staffing shortages and has been actively recruiting teachers and substitute teachers to address this issue.The District is aware that the San Dieguito Faculty Association filed a petition for a peremptory writ of mandate on Friday that seeks to prevent the District from providing in-person instruction to students in January. (KGTV) - With studies showing San Diegans are spending more time than ever stuck in traffic, we're listening and looking for answers to your travel headaches.A new technology being hailed as a "game changer" by some experts takes aims at those achy, tiresome commutes.  Cadillac's Super Cruise, the only hands-free semi-autonomous driving feature on the highways, is now on local roads. 10News reporter Michael Chen went to North County Cadillac and took a long for a test drive in the CT6 sedan on I-15.Once on the highway, the feature was activated with the push of a button on the steering wheel.  The feature allows the driver to go feet- and hands-free as long as you stay in one lane. "If someone slows down in front of me, it will slow down our speed," said Drew Doran.While other driver-assistance systems use cameras to center a car, Doran says General Motors has extensive laser mapping of US highways that leads to better accuracy."It actually knows what is ahead of the vehicle," said Doran.  On the hour-long drive, we tracked every curve and every time, it stayed in the center of the lane. The driver still expected to be on standby.  A camera on the steering wheel watches for distractions.  If the driver is doing something like reading and blocking that camera, it will warn the driver.When we blocked the camera, a green light flashed - the first of several alerts - before Super Cruise disengaged.  Doran says he recently went on a trip to Los Angeles with his wife.  He says he used Super Cruise for about 80% of a drive that left him feeling relaxed.    "Not the usual back pain.  I actually felt wonderful," said Doran.The Cadillac CT6 will cost you about ,000, but industry experts says GM could deploy the well-received Super Cruise in vehicles priced around ,000 starting next year.AUTONOMOUS VS. (KGTV) - A set of triplets took sibling rivalry to new heights in this year's spelling bee at O'Farrell Charter School.Seventh graders Miguel, Maya and Mia Brizuela finished 1st, 2nd and 4th in the school competition, respectively. Miguel advanced to the County-wide bee, held Thursday at Town and Country Hotel in Mission Valley."I'm very good at grammar, so it's really easy for me," says Miguel, when asked how he managed to win. But he also admits he got help from his sister, Maya."We were going back and forth, back and forth. And then, finally, Maya just decided to give up because she said that she didn't want to go to the county," he says.Maya confirmed the story that she let her brother win."Like, 1% of me wanted to win," she says. "But I have stage fright. I didn't want to go up there in the auditorium and spell words in front of a lot of people," she says.But it's Mia, who finished 4th at the school, who believes she's the best speller of the three."I felt like I needed to raise myself to their level of spelling," she says of her finish in the competition. "And I like to correct their grammar a lot."The three say they practice by holding mini-spelling bees at home, where their parents give them words to spell. They also study for 1-2 hours each night before bed.Now that Miguel had advanced to the County-wide competition, his sisters say they'll be there to cheer for him."He's my brother, I love him," says Maya. FALLBROOK (KGTV) - One person is dead after she was hit by a vehicle while walking along the shoulder of a road in Fallbrook with her husband.CHP officers say the 60-year-old woman was walking with her husband just after 5 p.m. northbound on the east shoulder in the 2700 block of Gird Road north of Laketree Drive. An approaching pickup truck heading northbound left the roadway and struck the woman. The truck stopped for a moment before fleeing the scene northbound on Gird Rd.North County Fire Protection District and CHP responded and crews began life saving measures at the scene, but the woman was pronounced dead. Her 60-year-old husband was not injured.The truck involved in the crash is described as an older model pickup truck that's dark in color. The truck will likely have damage to the right front side.Investigators were reviewing surveillance footage from the area to learn more about what happened.Anyone with information on the whereabouts of the suspected vehicle or information about the crash is asked to call CHP at 858-637-3800. 1060
