SAN DIEGO (CNS) - A man who was operating a panga boat carrying several undocumented immigrants when it capsized off the coast of southern San Diego County earlier this year, killing two men aboard, was sentenced today to nearly seven years in federal prison.Julio Cesar Murillo-Arce, 42, pleaded guilty earlier this year to federal charges stemming from the Feb. 3 boating accident off the coast of Imperial Beach.He was sentenced to 78 months in prison in connection with the boat fatalities, and an additional five months for violating the terms of his supervised release stemming from a separate maritime alien smuggling conviction last year, according to the U.S. Attorney's Office.According to court papers, Border Patrol agents spotted the boat in the early morning hours of Feb. 3. It began experiencing engine trouble about 150 yards off the coast, prosecutors said, then eventually became inoperable.Prosecutors say Murillo-Arce told the others aboard not to identify him as the boat's captain, then dove into the water.The boat was capsized by a large wave, sending all six occupants into the sea. Four were able to make it to shore, but Ramon Ponce-Rodriguez and Modesto Rodriguez-Ballesteros did not.Ponce-Rodriguez was pronounced dead on arrival at a hospital, while Rodriguez-Ballesteros was initially hospitalized in critical condition and died Feb. 4.The surviving occupants of the boat told investigators that the boat's captain abandoned the vessel and swam away, despite being told some of the people aboard could not swim. The boat's occupants -- or someone else on their behalf -- paid between ,000 to ,500 each to be smuggled into the United States from Mexico, according to the criminal complaint.``This is yet another tragedy that never should have happened,'' said U.S. Attorney Robert Brewer. ``This defendant and others like him care only about their bank accounts and their own safety. Because of his callous disregard for the passengers he attempted to smuggle, two lives were lost.'' 2028

Pollack ruled both the project's proposed bond funding mechanism and an agreement of cooperation with the Plaza de Panama Committee to be legal, allowing the city to proceed with the plan to reduce traffic congestion in the park, according to the city attorney's office.San Diegans for Open Government argued that the city should have allowed voters to decide whether the city should rely on million in bonds to help fund the project.The City Council approved the project by a 7-1 vote in 2012, but six years of challenges and litigation stalled its implementation.The project will limit vehicle access and improve parking in order to restore the Plaza de California and Plaza de Panama as dedicated pedestrian areas."Balboa Park truly is the jewel of San Diego, and I am excited that the city can finally move forward with its plans to revitalize the Park for the enjoyment of San Diegans and tourists alike," City Attorney Mara W. Elliott said after the ruling.The Plaza de Panama project will also include improvements to more than six acres of park space and improved park access. Jerry Brown today appointed a former Del Mar councilman to the 22nd District Agricultural Association Board of Directors and reappointed two other San Diego County residents to the panel.Brown named Del Mar resident Donald Mosier, 74, to a four-year term on the board that governs the Del Mar Fairgrounds on behalf of the state via a nine-member board of directors. The governor appoints each member of the board to serve a four-year term.The District Agricultural Association is a subdivision of the California Department of Food and Agriculture, charged with holding fairs and exhibitions that highlight "various industries, enterprises, resources, and products of the state," according to the CDFA.The governor reappointed attorney Frederick Schenk, 65, and Lisa Barkett, 59, who have served since 2011.Mosier is the Climate Action Plan facilitator for the city of Del Mar and is a member of multiple governing boards, including the Del Mar Community Connections Board, the American Association for the Advancement of Science and the Climate Action Campaign Board of Directors. He served on the Del Mar City Council from 2008 to 2016 and was a professor at the Scripps Research Institute from 1992 to 2016.Barkett, who was vice president of Merjan Financial Corp. from 1989 to 2013, is a member of the Board of Trustees for both the University of Southern California and Rady Children's Hospital.The appointments do not require confirmation by the state Senate. SAN DIEGO (CNS) - Authorities Friday publicly identified a 20-year-old man who was found dead of an apparent homicide in a car parked on a Southcrest- area roadside.Patrol officers responding to a report of a possible traffic accident in the 4000 block of Boston Avenue around 11:50 a.m. Wednesday found Ismail Abouabid mortally wounded behind the wheel of the parked vehicle, bleeding from the head, according to San Diego police.Abouabid, who had recently relocated to San Diego from Erie, Pennsylvania, was pronounced dead at the scene, Lt. Matt Dobbs said. Police initially reported that the man apparently had been shot to death but later backed off from those statements.RELATED: Police investigating after man found dead in car in Southcrest``It is very early in the investigation, and little is known about the events leading to (his) death,'' Dobbs said. ``The mechanism for the man's injury is not being released at this time.''Witnesses told investigators three male teenagers had been with the victim shortly before his death.``The group of teenagers walked away towards a nearby park just before the victim was discovered with the injury,'' the lieutenant said. 1182
