PHILADELPHIA (AP) — Bill Cosby's lawyers are arguing in a new appeals filing that it was “fundamentally unfair” to let prosecutors use Cosby's damaging deposition from a sex accuser's lawsuit against him at trial. The filing made Tuesday largely focuses on what Cosby believes was a binding promise from a district attorney that he wouldn't be charged in the case. A spokeswoman for the Montgomery County district attorney's office isn't commenting but says prosecutors will file a response within a month. "He not only found it. He also called 911 and made sure we got our jewelry back."Joe and his wife Elif Fitzgerald attended an annual Denim and Diamonds charity event for Hands Across the Bay Saturday night. That's why Elif Fitzgerald had expensive pieces of jewelry with her.The Fitzgeralds were one of the sponsors for the event, and they had a lot to pack up at the end of the night. Joe Fitzgerald says he put most of the luggage in the back of his trunk, including his wife's luggage, with the jewelry in it."On my way home the back hatch opened and the bag fell out near West Bay Dr. and Indian Rocks Rd." he said.The Fitzgeralds had no idea the bag was gone, "until I looked at my phone."Elif Fitzgerald said she had dozens of missed calls and text messages telling her someone found their bag and the jewelry in it."I was completely shocked that they returned it," she said. "I have valuable jewelry. OTAY MESA, Calif. (KGTV) -- The piercing sound of a high-powered drill could be heard coming from the Otay Mesa border wall prototypes Tuesday morning. Journalist Jorge Neito captured the images from a neighborhood in Tijuana. Construction workers could be seen drilling more than a dozen holes into the concrete barriers.Customs and Border Protection officials confirmed to 10News last week that the prototypes were coming down to make space for a secondary border fence. That fence will strech 14 miles from the beach to Otay Mountain. Officials never specified when the prototype demolition would happen.The prototypes are 30 feet high and were built in last September of 2017. President Trump toured the barriers in 2018. Out of the eight designs there wasn't one specifically picked for the border wall. "There was never an intent to pick one and copy that along the entire U.S. border. The entire concept literally was how can we do this better," San Diego Sector Border Patrol Chief Rodney Scott told 10News in 2018. "But we're not picking one of these walls over the other walls, and we never planned on doing that. So, depending on the terrain or the environment, it could be any one of these? Correct."10News reached out to Border Patrol locally to find out if today's work is part of the prototypes' demolition and a spokesperson referred us to Washington D.C., so far we have not heard back. 1413

p.p1 {margin: 0.0px 0.0px 0.0px 0.0px; font: 14.0px Helvetica}span.s1 {font-kerning: none}San Diego law enforcement officers are tapping into a nationwide database that uses a bullet's ‘fingerprint' to track crimes.The distinct markings left on a shell casing after it's fired provide an image that can be traced back to the gun from which the bullet was shot.There's an Alcohol, Tobacco, Firearms and Explosives technology called National Integrated Ballistic Information Network, or NIBIN.The national digital database houses 3.3 million images of casings left at crime scenes all over the country.San Diego County, state and federal agencies can enter a casing and find out within 24 hours if there's a match in the system."We're catching the fingerprint from the firearm," said ATF Intelligence Specialist Tom Chimileski.If they get a hit, those identical spent shell casings have linked two different crimes to the same gun.ATF Special Agent Jeff Rice, who works with local police and Sheriff's units in San Diego County, calls the sharing of ballistic information "a game changer."Rice works with Escondido Police Gang Unit Detective Nicholas Rodelo on gun crime cases. They took 10News Anchor Kimberly Hunt to the scene of a March 2016 murder case in Escondido.Surveillance video caught the car in an alley off Escondido Blvd. creeping toward the street, as the shooter stalked a rival gang member.After the shooter got out of his car and gunned down the man in the middle of a busy street, there were 12 shell casings left at the scene.The casings were collected and put into the NIBIN system.In the 24-hour window before the digital search could reveal a lead, the pair got a tip on where the gun could be. They recovered it and found the serial number was obliterated.Rice and Rodelo went to San Diego Sheriff's Department Criminologist Scott Hoopes for his expertise in serial restoration.Hoopes told 10News the metal underneath the serial number still reacts to certain acids. Even though it's completely smooth on the surface, Hoopes can sometimes manipulate the acid reactions and bring the number back. That's what Hoopes did with the gun.These technologies are putting a bull's eye on the bad guys. The NIBIN system's images have led to 110,000 hits giving investigators a wealth of knowledge from seemingly unrelated crimes, sometimes from the other side of the country, now connected by a firearm."Jurisdictions can't talk to each other but within our NIBIN system we're able to figure that out," said ATF Special Agent Jeff Rice.These hits allow investigators to get surveillance video, the makes of cars, license plates, or other pieces of evidence from one scene and use it in the other cases involving that same gun.That gets law enforcement much closer to finding the shooter and making the arrest.  See Kimberly Hunt's full report: 2873

People with private student loans have been struggling during the pandemic. Their loans aren't eligible for the government's penalty-free repayment pause, which is in effect until at least Oct. 1 for federal student loans.About 70% of borrowers in a new survey from Student Loan Hero have been successful in getting their private lender to give them a break after they called to ask.Nearly three out of ten people in the survey with private student loans say they've thought about filing for bankruptcy over the last three months. Gen X has considered this the most.We talked to a certified student debt counselor and student loan lawyer, Christie Arkovich, who says a lot of people don’t realize you can discharge student loan debt in bankruptcy.“What we're targeting is someone who usually had federal loans and private loans and we are usually arguing that the private loans were taken outside the cost of education and therefor, they're just like any other debt, credit card debt and such, and they can be discharged,” said Arkovich.“Outside the cost of education” means more has been loaned out than what the person needed. Arkovich says her goal with bankruptcy cases is not to necessarily get rid of the entire debt, but to make payments sustainable and affordable, with an end date.Bankruptcy is an extreme measure and not for everyone.“Bankruptcy is a last resort option, because it will really force you not only as a student loan borrower but as a citizen and a consumer to start from scratch on your finances,” said Arkovich. “So, your student loan debt shouldn't be the only reason that you would consider bankruptcy.”One thing to consider first with private student loans is debt consolidation. You can work with a nonprofit credit counselor on that. There are also repayment assistance programs for private loans.Federal student loans have more options, including student loan forgiveness programs.For current students, make sure your FAFSA is up to date, so it reflects your family's current financial situations. After that, contact your school's financial aid office. Explain your situation if your family has lost income as a result of the pandemic.Colleges expect students to appeal their financial aid packages right now, and it may get you more money to help pay for school. 2304
