Many businesses across the country have been working to safely reopen their offices. From disinfecting desks to implementing social distancing guidelines, some employers are learning it still might not be enough to bring people back to their desks."There are people who have fears of returning back to work due to safety concerns. Maybe they might be at a higher risk due to a compromised immune system or someone else within their family so they have some concerns about returning. Some employees don’t want to return-- and some employees want to continue to work from home when they were able to do it during this period of COVID," says Amber Clayton, the Knowledge Center Director at the Society for Human Resource Management.Clayton says some reasons for an employee refusing to come back to the office are protected under law. For example, if the employee, or someone the employee lives with, has underlying health conditions that would make them at higher risk for being affected by COVID-19, or they're unable to return due to childcare reasons. Employment lawyers like Ruthie Goodboe agree, citing OSHA and the National Labor Relations Act."An analysis needs to be done by the employer to determine, ‘Am I able to separate that employee if they’re unwilling to return to work, am I required to do or take certain steps’ and then if I do that and they still don’t come to work, do I have a right to separate them," said Goodboe, an employment lawyer with Ogletree, Deakins, Nash Smoak & Stewart.Employers must also make sure they're following regulations under the Americans with Disabilities Act and Family Medical Leave Act."If employers are following guidance from the CDC and from OSHA and limiting their exposure in the workplace, that should be satisfactory. However, there may be times that someone may be infected in the workplace and that employer may be held liable depending on the situation," Clayton said.But for those employees who simply have a general fear of COVID and despite any accommodations the business is taking, still don't feel comfortable coming back to work, it may be a breaking point."There's no federal or state laws that I’m aware of that requires an employer to provide leave based on someone’s fear that they may contract some type of disease whether it’s COVID-19 or something else. But employers should, through their policies and practices, determine what they’ve done in the past and ensure they’re being consistent and fair in their policies," says Clayton.Perhaps the biggest key for employers and employees in getting through this is communication."Stay calm, take a breath and make sure you’re communicating well with your employees to get all of the information. Do you understand what all of their concerns are? Because once their concerns are understood, it may be easy to resolve," says Goodboe.Employees and employers could ultimately find a mutually agreeable working situation to keep everyone comfortable and healthy at work. 2994
MIAMI, Fla. – Norwegian Cruise Line announced Tuesday that it would be keeping its ships docked even longer amid ongoing COVID-19 concerns.The cruise line said it’s extending the suspension of its 2020 cruises to include all sailing through August 31, all sailing in September except Seattle-based Alaska Cruises, and select October sailing.The select October cruises include two trips to Alaska, as well as two trips to Canada and New England.The company is offering guests who had an active reservation on a suspended cruise a refund of their cruise fare in the form of a future cruise credit (FCC) for 125% of the amount paid to date on June 25.The FCC must be used one year from the date issued for any Norwegian Cruise Line voyage embarking through 2022, according to the company.Norwegian says guests who prefer to not take advantage of an FCC can elect to receive a lesser refund equal to the amount paid to date to the original form of payment 90 days after form submission for sailings originally scheduled to embark anytime from July 1 onward.For suspended cruises that were set to embark between July 1 and July 31, this form must be submitted not later than 11:59 p.m. ET on June 19, 2020. For later cruises, a refund form will go live at 9 a.m. ET on July 6 and it must be submitted no later than 11:59 p.m. ET on July 17. 1343

Lowe’s, in partnership with a group of NFL players, says it is contributing million in Christmas trees to needy families and facilities in “need of extra cheer” this holiday season.All told, Lowe’s will deliver 13,000 pre-lit trees to homes and organizations throughout the country. Among the facilities to receive the donated trees will be childcare centers, youth centers, first responder stations and nonprofit housing organizations.Top NFL players including Dak Prescott, Jared Goff, Adam Thielen and Andy Dalton are joining the project. Lindsay Clowes and Alex Leckie decided to take their ceremony to the edge in order to get married while guests stayed safe.The edge being the border between the United States and Canada, which is closed while coronavirus cases continue to climb.The Canadian couple held their October 10 ceremony on the water between the two countries, so friends and family from both sides of the border could attend.Some watched from St. Stephen Wharf in New Brunswick, Canada, while others were on the banks of the St. Croix River in Calais, Maine.Clowes’ grandparents got VIP seating, on a boat in the middle of the river. 710
MARSHALL, Ark. - The chief of police for Marshall, Arkansas, has resigned from his position after posting online threats of violence directed at Democrats.Marshall Mayor Kevin Elliott announced in a statement on Saturday via Facebook that Police Chief Lang Holland had resigned effective immediately."The City of Marshall strongly condemns the actions of Mr. Holland in his posts to social media," Elliott said in the statement. "His remarks in no way reflect City Government or the people of Marshall, Arkansas.
