SAN DIEGO (KGTV) — A San Diego judge says police departments must release records related to officer misconduct.The decision comes after local media groups, including 10News, sued to keep some police unions from blocking departments from following a groundbreaking new law in California.“This court finds that Senate Bill 1421 applies retroactively, to all, keyword, all personnel records of peace officers not only now but prior to January 1, 2019,” said San Diego County Superior Court Judge Eddie Sturgeon.Senate Bill 1421 requires departments to release records of officer-involved shootings and major uses of force, officer dishonesty and confirmed cases of sexual assault to the public.Several police associations in San Diego County sued to block the release of records, arguing Senate Bill 1421 doesn’t contain any express provision or language requiring retro-activity or any clear indication that the legislature intended the statue to operate retroactively. They claimed the bill eliminates the longstanding statutory confidentiality of specified peace officer or custodial officer personnel records.“These records have been under seal for 45 years, and when you have that kind of duration, and decisions are made for that long than it is going to create substantial disruption when the law changes, and all of a sudden these things have been under seal for four and half decades are available for public perusal,” said Richard Pinckard, attorney for the unions.An attorney for the ACLU argued they intervened in the case to defend the public right to know saying the law was designed to be retroactive.“These are fundamental matters that the public has a right to know,” said David Loy, attorney for the ACLU of San Diego & Imperial Counties. “To restore public trust the public has to have the right to know and observe what the officers have done and what the agencies have said about it.”The Judge ruled no records could be released before March 29. SAN DIEGO (KGTV) -- A jury Tuesday found a man guilty of beating and raping two women on consecutive days in 2016. Jeremiah Ira Williams, 26, was found guilty on multiple charges Tuesday, including forcible rape and false imprisonment. Williams now faces 100 years to life in prison. His sentencing will be on May 30. A prosecutor Monday urged the jury to convict Williams, who is accused of choking and raping two women in different parts of San Diego on consecutive days in 2016.A defense attorney argued that police infused suspicions from the second case into the initial attack and mishandled evidence.Williams is charged with 13 counts including forcible rape, false imprisonment, sodomy and making a criminal threat.Earlier in the trial, Williams was removed from the courtroom for being disruptive and was not present Tuesday as attorneys presented their final arguments.Deputy District Attorney Trisha Amador told jurors that Williams followed Jane Doe #1 from a parking structure to her University City apartment on August 13.With her keys in the door, she was knocked down, robbed at gunpoint and choked to a point where she thought she was going to die, the prosecutor said.After being taken inside the apartment, Williams beat and raped her, Amador argued. The next day, Williams beat and raped a woman working as a prostitute after meeting her in a motel in Grantville, Amador said.Jane Doe #2 was reportedly so terrified that she broke a window and jumped through it to get away.Deputy Public Defender Thomas Bahr told the jury that a detective had a feeling the two sexual assaults may be connected and jumped to conclusions in an attempt to solve the first attack.Bahr also told the jury that Jane Doe #2 lied throughout the investigation and said her story contained inconsistencies.Bahr said Jane Doe #1 was a “true victim,” yet she couldn’t assist police in making a composite sketch of her attacker. 1943

SAN DIEGO (KGTV) — A new report from the Auditor of the State of California questions whether the San Diego County Sheriff's Department has implemented recommendations outlined in a previous audit.The report "Recommendations Not Fully Implemented After One Year" presented the status of recommendations that are more than one year old and have not been fully implemented by the audited entities.According to the report, a 2017 audit about Concealed Carry Weapon Licenses, made several recommendations regarding the San Diego County Sheriff's Department's program.The recommendations included, "To ensure that it follows state law's requirements for revoking licenses, San Diego should immediately revoke CCW licenses and should then inform Justice that it has revoked licenses whenever license holders become prohibited persons. Additionally, San Diego should notify Justice when it suspends a license, or a license is surrendered."The 2017 audit also recommended, "To ensure that it maximizes allowable revenue from its CCW program, San Diego should immediately pursue increasing its initial, renewal, and amendment fees to the maximum amounts allowable under state law."According to the Auditor's newly released report, the estimated date of completion of those recommendations is unknown.10News contacted the San Diego County Sheriff's Department to ask about the status of the recommendations. It turns out the Sheriff's Department did make changes.In a statement, a spokesperson for the department wrote: "In 2017, the San Diego County Sheriff's Department was made aware of the findings and recommendations by the State Auditor from the report on Concealed Weapons Licenses. The recommendations that were suggested were taken into account and changes were implemented in 2018. The changes reflected all of the recommendations except for the proposed increase of fees. The Sheriff's Department did not agree on placing a high fee that would otherwise prevent the issuance of a CCW for a qualified and genuine necessity solely because of financial hardship. The adjustment of those fees is now mandated by the state with the passage and implementation of Assembly Bill 1297 this year. Sheriff's Financial Services is currently looking at our business practice for reviewing the fees collected. That fee will ultimately need to be approved by the Board of Supervisors."The San Diego County Sheriff's Department is the local agency tasked with approving or denying CCWs.Team 10 previously reported about a spike in CCW permits.In 2017, the department approved 171 licenses. In 2018, the department approved 707, a more than 300 percent increase from the year before. In the first seven months of 2019, the department has already authorized 767. 2754

SAN DIEGO (KGTV) -- A local father is recovering from stab wounds after getting attacked by an intruder in his home. The man's 20-year-old son shot and killed that intruder according to San Diego Police. It happened just before 6:30 Tuesday morning at a home in the 6300 block of Lake Shore Drive in San Carlos. Neighbors heard the violence. "I heard the gunshots, it was like three or four gunshots, then screams for help immediately after," said Denise Rolla. When police got to the home, they found the suspect dead in the pool and the 54-year-old homeowner with stab wounds to the upper body. Police say the homeowner's son shot and killed the intruder, who stumbled out the back and landed in the pool. "I heard what turned out to be the suspect fall into the pool and then a couple minutes later, you could see the blood start to spread out through the pool," said Andrew Grogg, who lives right next door. There are walking paths and Mission Trails Golf Course is located behind the homes which are just southwest of Jackson Drive. Neighbors say they don't have a problem with transients in the area, but police say so far, it appears the 38-year-old suspect is homeless. His name hasn't been released. The family owns a tire shop in La Mesa. They are well known and liked in the community. "They're local business owners in the community. They're great neighbors. They're kind, they're nice," said Grogg. Police say so far, the attack appears to be random. 1472

SAN DIEGO (KGTV) - A little more than a year in, homeless people using the new storage lockers in Sherman Heights are still having trouble finding homes.According to new numbers released by the San Diego Housing Commission, 895 people have used the storage lockers since they opened last June. But only 9%, 79 of them have been able to find longer-term or permanent housing.Lisa Jones, the Senior Vice President of Homeless Housing Innovations for the SD Housing Commission, admits that number is low. But she says people should not look at it as a condemnation of the project. She says the locker facility isn't designed to help people find housing, but to direct them to resources that can."If this were a shelter program, that's a number we'd expect to be higher," Jones says. "But we see it as a positive number, considering the fact that we don't actually have case management services on that site."However, the storage facility seems to be struggling to connect homeless people with those resources. According to the same study, only 22% of the people using the shelters are currently working with a case manager or social service provider. Of those, only 45.5% met with a case manager in the last week before the survey.But, Jones says the storage site still serves as a critical gateway for homeless people to get help."It's an engagement opportunity that's unique because they're building relationships with the folks as they come in," she says. "They can help reorient them and get them reconnected to services if they're not. And if they are in services, they can make sure they're accessing them to the best effect."Jones also says the new numbers show that neighbors fears of the facility bringing more homeless people to the area are unfounded. An average of 120 people visit the site each day, but they rarely stay in the Sherman Heights area.Before the storage facility opened, 12.5% of the people who answered the survey said they slept in Sherman Heights or Logan Heights. That number has since dropped to 10%. Meanwhile, the number of people sleeping downtown has gone up from 66% to 69.5%.RELATED: Timeline shows history of San Diego's Homeless Storage CentersJones says one of the most significant bright spots from the survey is the fact that 68% of the people using the lockers say they're still actively looking for a place to live. She says that's particularly encouraging because 73% of the facility's users say they are chronically homeless."When you get into that chronic homelessness, your challenges get greater," says Jones. "To some degree, you get disenfranchised or frustrated with the experience. It's the kind of thing where the longer you're homeless, the more challenging that life back into housing can become."Jones also says the lockers have allowed more homeless people to be able to work and go to school. Because of the lockers, they don't have to bring their belongings with them everywhere they go or worry about them being stolen overnight."We have people in these programs that are employed, that are bringing in work boots and tools at night because they don't want to store them on the street," says Jones. "We have people that use the programs that are in school, and they keep books and laptops and things like that in there."There's a value to the safety and security that you can't see in numbers." 3361
