SAN DIEGO (KGTV) - In a downtown courtroom on Friday afternoon, attorneys battled over a request to halt the shutdown orders for San Diego bars, restaurants, and gyms.Attorney Bruno Katz is representing a group of local businesses like Cowboy Star restaurant and Bear Republic Crossfit gym, which are seeking an emergency injunction. He told the judge, “What I do want to say, your Honor, is that the temporary restraining order is based on data. It’s based on facts. It’s based on science and it's based on the state not showing why it has targeted these industries when the science and data doesn't support it.”The state argued that the damage to businesses pales in comparison to the damage on human life. “There's nearly a thousand dead San Diegans and the numbers are getting dramatically worse and have been for the last couple of weeks,” said state Deputy Attorney General Jonathan Eisenberg.Restaurants and gyms were open for indoor operations with limited capacities under the red tier. However, last Saturday’s move to the purple tier forced them to shutdown indoor services completely and move outside. They're suing Governor Newsom and San Diego County, arguing that the closures go against their rights and are causing financial devastation.The suit was filed on behalf of all restaurants and gyms.Local owner of The Studio SD fitness studio Rachel Racz spoke to ABC10 News before Friday’s hearing. She told ABC10 News in part, “It's been rough to shut down business again when people were feeling normal and then we see the County of San Diego's Department of Health say that gyms are only point .4% of cases in San Diego and it's really frustrating as a business owner where we have these ebbs and flows- where we can be open and then we can’t.”Superior Court Judge Kenneth J. Medel stated that he would have a ruling by 5 p.m. on Friday. If not, he said he would issue his decision on Monday. 1916

SAN DIEGO (KGTV) - Mayor Kevin Faulconer is proposing new regulations for dockless scooters around the city.Faulconer, Council members Lori Zapf and Chris Cate, and representatives from the scooter companies held a press conference Monday morning at NTC Park, in Liberty Station to address growing concerns over the safety of dockless scooters. “We want to make sure that its safe, that there are clear rules of the road and regulations that make sense.”Faulconer is proposing to “geo-fence” certain areas around the city. SAN DIEGO (KGTV) - In an exclusive interview with ABC10 News, a firefighter shared his heroic story of helping battle the massive fire that erupted aboard the USS Bonhomme Richard this past July.“It was a crazy situation,” said Deputy Fire Chief Robert Sepulveda with Navy Region Southwest Fire Emergency Services. “We [had] about 400-plus firefighters on-scene at the time,” he stated and added, “I was on the front lines with the firefighters and was directing the fire attack on the forward side of the ship at that time.”His first shift lasted for 30 hours. It took almost a week to knock it all down. “What I was feeling at that time was obviously fear and wanting to make sure that everyone was safe on-scene and make sure I had that command presence to be able to unify everybody,” he told ABC10 NewsHe has now received a civilian of the year award for his heroic actions.On Monday, Navy officials announced that the warship would be decommissioned after it was gutted this summer during the explosive fire at Naval Base San Diego. The Navy reported that it’s not cost effective to bring the ship back, which could require up to billion and seven years to restore.At the time of the fire, more than 60 personnel including sailors and civilians were treated for injuries like heat exhaustion and smoke inhalation.In August, ABC10 News was the first to report that the fire was being investigated as an arson and the lead suspect is a navy sailor, according to multiple sources with close ties to NCIS.To date, the Navy will only confirm that the cause is still under investigation.Sepulveda remains grateful to the many sailors who ran to help just minutes after the flames erupted. “These ships are like homes to them and to see them in action and put everything on the line to make sure that their home was safe at the end of the day [was] incredible,” he added.The time lines for towing and dismantling the decommissioned ship are still being finalized. 1973

The company claimed in a press release it’s exploring several options to “maximize shareholder value.”Several of the options include the sale of the company or a previously announced plan to increase its leverage.
