SAN DIEGO (KGTV) — The San Diego Symphony has overcome the last major obstacle to a permanent home along San Diego's waterfront.The Port of San Diego's Board of Commissioners has granted a 15-year lease for the Symphony's Bayside Performance Park project. The project will see the construction of a seashell-shaped concert venue at Embarcadero Marina Park South, as well as various improvements to the surrounding park.The lease also includes four options allowing the Symphony to extend their lease up to 50 years.The San Diego Symphony will invest a minimum of million toward those improvements, including 66 new restrooms, expansion of the current promenade, and improvements to the park's existing basketball courts and exercise equipment.RELATED: Margaritaville Island Resort coming to San Diego“We’re confident concert-goers will love the improved access and state-of-the art stage and sound system, and bayfront visitors will love the new and improved park,” said Board Chairman Garry Bonelli.The Symphony could begin construction of the venue as soon as September. It wasn't immediately clear when the venue would open.A permanent concert venue for the symphony has been on the organization's wish list for years now. Since 2004, the Symphony has had to assemble and disassemble its temporary venue for its Bayside Summer Nights concert series. The permanent concert stage will also provide four free public events each year."Our hope is that it will become a coastal destination for everyone, and an iconic landmark for the region and its coastline," said Martha Gilmer, San Diego Symphony CEO.The park's landscape will also change, with the Symphony adding a sloped lawn with temporary seating open to the public during non-event hours. SAN DIEGO (KGTV) -- There are more concerns about vacation rentals in the Bankers Hill area, following action taken by the City Attorney’s office to shut down what they called a COVID party Airbnb on 2nd Avenue.The civil enforcement action cited concerns over gatherings during coronavirus-related restrictions and numerous other violations, from lack of permits to not obtaining proper tax licenses. According to the complaint the homeowner David Contreras Curiel, did not pay required taxes or fees to operate a vacation rental. It also alleges Curiel illegally made numerous renovations to the home.“From packing a party house during a pandemic to illegally renovating an entire property, the conduct of the defendants in this case is egregious and unacceptable,” City Attorney Mara Elliott said in a news release Friday.On Monday, ABC 10News spoke to a neighbor who lives next to another Airbnb rental on 3rd Avenue. Records show the rental is also owned by David Curiel. The home is listed as The Alfred Mansion on Airbnb’s website.“It’s disruptive every weekend,” one neighbor told ABC 10News. He did not want to be identified, but he said the parties picked up at The Alfred Mansion a few months ago.“Two weekends ago, there was a wedding there with at least 40 people. Nobody had a mask on,” the neighbor said. He added that he has made several complaints to police and the City of San Diego, but nothing had been done. He also had not heard anything from Airbnb regarding his concerns.Curiel did not return requests for comment. Early Monday afternoon, ABC 10News contacted Alex Mendez, the person who helps manage the property and deal with guests.On Monday evening, Mendez called the allegations against the Airbnb properties “unwarranted.”Regarding the city action taken against The Ashley, Mendez said that he and the owner were willing to work with the city. When he asked to reschedule a meeting with code enforcement a couple months ago due to Curiel’s travels, Mendez said the city was not willing to be flexible.Instead of a code enforcement officer calling him back, someone from the City Attorney’s office contacted him, Mendez said.He and Curiel were both caught off guard by the city’s allegations.“We, by no means, have a party house. The house rules are very strict,” Mendez said.Mendez said he has been willing to work with any neighbors who have had issues with the Airbnb properties. “We’re very responsible,” he said, adding that it is also not fair for “neighbors to complain any time there’s any little noise and mischaracterize it.”A spokesperson for the City Attorney’s office could not say whether or not the property on 3rd Avenue was being investigated, but told ABC 10News that the case against The Ashley could affect the other rentals owned by Curiel.“If granted, our injunctive relief would apply to any properties within the county owned by Mr. Curiel that have one or more of the same-type violations that are listed in our complaint,” a spokesperson said.Airbnb has not responded to this latest allegation, but previously told ABC 10News that hosts are not allowed to authorize parties where current public health orders prohibit gatherings, like in San Diego County. 3217

SAN DIEGO (KGTV) -- The San Diego County Board of Supervisors Wednesday voted 4-1 in favor of Otay Ranch Resort Village 13, a mixed-use community to be developed near the city of Chula Vista.When completed, Otay Ranch Resort Village will feature 1,938 homes, a fire station, sheriff's station, trails, an elementary school, parks and open space, according to a county staff presentation."We must have more housing that is well-planned, that is walkable, bikeable, and smart net zero housing such as this proposal," said nearby resident Richard Richardson.Proposed by developers Baldwin & Sons and Moller Otay Lakes Investments, Otay Ranch Village is located less than a mile east of the city of Chula Vista and 12 miles southwest of the community of Jamul.The county Planning Commission voted 4-2 in favor of approval, and the county Planning & Development Services department also recommended approval.Several environmental groups urged the board to table the project until the county resolves issues over its Climate Action Plan, along with species protection concerns and wildfire hazards."The amount of greenhouse gas here is substantial," said Dr. Peter Andersen, a Jamul resident and member of the Sierra Club. Board Chairman Greg Cox said the project has "gone above and beyond" to address greenhouse gas emissions.Cox said the county is facing a housing shortage emergency, and Otay Ranch Resort Village is "one that's better designed than most I've seen" in terms of fire safety. "I believe this is a good project that checks all the boxes," he added.Although he praised the overall project, Supervisor Nathan Fletcher cast the lone no vote."My reluctance today is that we're very close to resolving a series of lawsuits and there's an effort to get a legally enforceable climate action plan, and then we can assess this project," he said.The county's plan has been the subject of several legal challenges. In June, a three-judge panel of the 4th District Court of Appeal in San Diego also found that reliance on carbon offsets was not legal, and shouldn't be used as a mechanism to allow general plan amendments to move forward.Fletcher said that while the Otay Village project is consistent with the density requirements in the county General Plan, his concerns over the use of carbon offsets prevented him from voting yes on Wednesday.Supervisor Jim Desmond said that despite problems with the Climate Action Plan, the county shouldn't have to stop all development.The board vice chairman also said that Otay Ranch Resort Village 13 complies with the county's Multiple Species Conservation Program, and received the blessing of San Diego County Fire Chief Tony Mecham. "This project of all the projects [brought] before this board is probably the safest from a fire safety standpoint," he said. SAN DIEGO (KGTV) — There are currently 34 active COVID-19 outbreaks at skilled nursing facilities (SNFs) across San Diego County.Dr. Wilma Wooten, the county’s public health officer, said from March 25 to Aug. 18, there were hundreds of cases reported at SNFs.“We have 86 skilled nursing facilities throughout the County of San Diego. In total, there have been 788 residents, and 515 staff members with laboratory-confirmed COVID-19 and this includes 153 deaths,” she said Wednesday.It’s a trend across the country, and as the nation deals with the pandemic, SNFs are reporting financial hardships.A recent survey by the American Health Care Association and the National Center for Assisted Living of 463 nursing home providers across the nation revealed that many say they’re facing a financial crisis.More than 55% reported operating at a loss, while 72% said they won’t be able to sustain operations for another year at the current pace.The report shows that most of the financial troubles were linked to the increase in costs due to COVID-19, including additional staffing, more personal protective equipment (PPE), and testing.“It could have and should have been avoided by simply adequately staffing and having appropriate PPE,” said Mike Dark, an attorney with California Advocates for Nursing Home Reform.For decades, the nonprofit based in San Francisco has fought for rights and better conditions for long-term care residents and their families in California.“At the beginning of this pandemic, nursing homes across the country had such terrible staffing and such thin PPE simply because money wasn’t being spent where it should have been,” said Dark. “It’s really up to the regulators to understand all the different sources of profit for nursing home owners and to make sure that when they hear that there’s just not enough money to pay for staffing or PPE, they really understand where those taxpayer health subsidy dollars are going.”He said the issues have been going on long before the pandemic. To avoid a disastrous situation in the future, Dark says changes need to be made at SNFs across the country immediately.“What nursing homes need to do, is staff up, train their staff, and make sure staff are adequately paid. SAN DIEGO (KGTV) -- The San Diego Unified School District Board voted Tuesday evening to support a package of bills making their way through Sacramento that would put a moratorium on new charter schools. There are four separate bills before the state legislature. Among other things, the measures would put a five year moratorium on new charter schools, increase local control by preventing charter schools from locating outside their district and put a cap on the number of charter schools that can open. San Diego Unified Trustee Richard Barrera helped draft the resolution in support of the bills. "We've got plenty of great examples of seeing laboratories of innovation that have happened over the past 25 years; however, what I think the law did not predict, was that charters have expanded very rapidly. There are organizations that kind of create chains of charter schools that go and pop up in different places around the state," said Barrera. He said the moratorium would not affect existing charter schools. "Let's think about the whole system; let's think about what's good for every kid, nothing in these bills affects existing charter schools. In fact, I believe these bills protect existing charter schools because they are as vulnerable to some new school popping up, that may or may not succeed, but in the meantime, you've got that movement of students back and forth," said Barrera. Barrera said roughly 16% of students in the district attend charter schools at a cost of approximately million dollars a year. There are nearly 50 charter schools in the district. Supporters of charter schools said the board's vote was motivated by politics and money. "I think they're kind of greedy, the public schools. They're wanting the money, for each student they get so much money," said Charles Taich, whose daughter attends a charter school. The California Charter Schools Association says the resolution the board passed isn't focused on students or families. "It really isn't about students. If you look at the resolution itself, it doesn't talk about parents and students. It just talks about districts and money and the information is not factual, so we want to address that," said Miles Durfee, Vice President of Regional Advocacy for the California Charter Schools Association. Durfee said they'll continue their fight at the state level. "The Charter Schools Association has worked really hard with members to really make sure we increase the quality of charter schools and we know schools need to continually improve, but we really believe that charter schools are one vehicle to do a great job to give choice to parents," said Durfee. 2667
