SAN DIEGO (KGTV) — A San Diego-area man and his grandmother filed a federal lawsuit against two San Diego County Sheriff's Deputies.The lawsuit alleges deputies responded to the wrong address and pulled a then-17-year-old out of his apartment. "I've never experienced something like that," said Cesar Jaramillo.Jaramillo says last October he was watching TV on the couch when he heard a knock at the door. He says deputies asked if someone from the residence called 911.According to his lawsuit, "Cesar informed defendants the call was not from his residence. When defendants asked Cesar if there was a young black female in the apartment, Cesar said 'No,' and informed defendants that they were at the wrong apartment building. Cesar knew who defendants were referencing and knew they lived in the other building. Cesar informed the deputies over half-a-dozen times that defendants were at the wrong building."Jaramillo tells 10News he complied with everything the deputies asked but felt like they didn't believe him."That's when I started closing the wide door, that's when he just reached in and grabbed my hand," Jaramillo said.The lawsuit claims, "Without warrant or probable cause, both defendants unreasonably lured Cesar to unlock and open the door, then entered into Plaintiff's residence and forcibly pulled Cesar by the forearms into submission, leaving instant bruises on both arms."Jaramillo's grandmother was in the back of the house at the time and said she woke up to the commotion."I saw my grandson laying on the ground, in handcuffs and I went crazy, and I said, what is happening," said Teodora Villalobos.According to the lawsuit, "Due to unreasonable seizure and force used on her grandson Cesar, as well as defendants' indifferent attitude, Teodora began having heart complications on scene."Jaramillo's lawsuit alleges negligence, battery, and unreasonable search and seizure, among other things.10News reached out to the San Diego County Sheriff's Department for comment, but a spokesperson they can't comment on pending litigation. 2066

SAN DIEGO (KGTV) - A shopper at Westfield UTC mall got a disturbing surprise while going to the bathroom, in the form of a cell phone's camera lens.Around noon on Saturday, amid a busy holiday shopping day, Mike Gonzalez went to the bathroom. His wife and 5-year-old daughter were waiting for him in the nearby food court."The urinals were taken so I went into the stall," said Gonzalez. Gonzalez went inside the stall at the far end."I'm finishing up my business, and I see a cell phone pop out of the stall next to me and pop back like that," said Gonzalez.He says the phone slid against the back wall just enough for the camera lens to be visible."Wow, did that actually happen?" said Gonzalez. Gonzalez' confusion quickly gave way to action."I was angry and felt violated," said Gonzalez. He told another man to get mall security before turning his attention to the stall."When you looked at the stall, he had it blocked with paper towels. You couldn't see in, top to bottom. Kicked the door a little and told him to get out," said Gonzalez.Gonzalez says the man that emerged was in his early 20s, about 5'10", 175 lbs, with curly, light brown hair. Gonzalez told him what he saw and the man denied it all."I was pushing him back, holding him in place so he couldn't leave," said Gonzalez.The shoving moved into the hallway, before the man slipped away and raced off. Gonzalez says what makes his skin crawl the most is the paper towel setup, which may mean the man had been in there awhile, taking photos. "The scariest thing is probably what if there were kids in there. You can put photos and videos online. SAN DIEGO (KGTV) – An annual toy giveaway for San Diego military families looked different this year because of the coronavirus pandemic, but the reason for the event remains the same.For this year’s Operation Holiday Joy, the San Diego Armed Services YMCA chose hundreds of local military families who needed a little extra help this holiday season.On Wednesday, at the Murphy Canyon Chapel on Santo Road, the YMCA handed out boxes of gift-wrapped toys, and even bicycles, to more than 1,000 kids.Families were given books, a mini Christmas tree, and a gift card.Tim Ney, executive director of the San Diego Armed Services YMCA, said that now more than ever it’s important to support military families, as they too must deal with the additional challenges brought on by the pandemic.“Spouse employment is 30 percent, it’s really high. The online education and we’re doing the Achievement Academy where we’re taking the kids during the day. And doing the online learning, then we do STEM activities with them afterwards,” said Ney.It’s a little bit of extra help these military families are extremely thankful for.Emily, who is a military wife, told ABC 10News, “We’re so grateful and we’re thankful and blessed that everyone is so generous to give military families support, especially during this pandemic. SAN DIEGO (KGTV) — A Scripps Ranch woman who contacted Team 10 about problems with her Samsung refrigerator is now receiving a full refund after Team 10’s story aired.Stephanie Nivinskus bought her Samsung french door refrigerator in December 2014. It cost her nearly ,000. She said she had issues roughly six months after she bought it. "It's been a headache since the beginning," Nivinskus told Team 10 in September.The first problem was the ice maker does not function properly, according to Nivinskus."The ice just gathers and collects up there. It makes it so it doesn't work," Nivinskus said.She also has issues with the temperature of the refrigerator. The FDA says a safe temperature inside a refrigerator is 40 degrees or below. During the initial interview with Team 10, the thermometer inside of Nivinskus' refrigerator read about 56 degrees."Having spoiled food is a real problem," she said.
