SAN MARCOS, Calif. (KGTV) - A local portable toilet rental company is charged with tampering with equipment on its trucks to skirt emissions regulations. Employees also allegedly faked some of the smog test results.Team 10 Investigative Reporter Jennifer Kastner went to San Marcos’ Diamond Environmental Services on Friday afternoon, but was asked to leave. 10News was looking for answers to the alarming accusations that the company and some of its employees were committing crimes against the environment. Part of a video on the company’s website states, “Diamond's dedication to doing the right thing goes above and beyond.” Yet prosecutors say Diamond was preparing false smog test results to get passing results. Additionally, executives were allegedly tampering with emission control devices on its diesel truck fleet, re-programming the emission monitoring devices to avoid extra costs that come with burning off dirty, soot-filled diesel filters. Ed Rodriguez is the owner of Auto Park Smog in Escondido. He says, “If you’ve ever seen a vehicle going down the road, like a truck, and it has black smoke coming out of it, that’s all soot and that's not good.” Rodriguez says he's worked on Diamond's smaller trucks but not the ones that are part of this new six count federal indictment. The U.S. Attorney’s Office claims that Diamond took the devices out of trucks and shipped them out of California to be re-programmed. Owner and manager Arie Eric De Jong III, manager Warren Van Dam and technician Jorge Leyva Rodriguez are facing time behind bars and thousands of dollars in fines.The company declined an interview during our visit to the headquarters on Friday afternoon. 1692

SAN YSIDRO, Calif. (KGTV) — One man was killed in a shooting involving a Border Patrol officer Friday near the Las Americas Premium Outlets.Just before 6 p.m., a Border Patrol agent assigned to the San Diego Sector shot an unidentified 30-year-old man in the area of Dairy Mart Rd. and Camino De La Plaza, close to the international border, according to Aaron Heitke, Chief Patrol Agent with United States Border Patrol in San Diego.Heitke said the man was illegally trying to enter the U.S. west of the San Ysidro Port of Entry.During the arrest, an altercation between the man and agent began, during which the agent fired his service weapon, striking the man in the torso, according to Heitke. The details surrounding what led to the fight haven’t been released at this time.The agent received minor injuries, according to San Diego Police. That agent is not being identified at this time, police added.At about 6:25 p.m., first responders pronounced the man dead, Heitke added. The victim has been identified but his name was not released. He was described as an adult Mexican national.SDPD officers were also called to the scene. Border Patrol told ABC 10News that SDPD will be handling the investigation.After SDPD's Homicide Unit completes its investigation, the U.S. Attorney's Office will review the case. (KGTV) -- Two people were injured after the driver of a Prius slid down the side of a hill in San Marcos Sunday morning.According to the San Diego County Sheriff’s Department, the crash happened around 9:20 a.m. at San Elijo Road and Schoolhouse Way.The department says an 84-year-old driver was traveling too fast when he tried to make a turn, hit a curb, and slid down the hill.Both the driver and a 77-year-old female passenger were taken to the hospital with serious, but non-life threatening injuries, the department says. 554

SANTEE, Calif. (KGTV) -- A victim was rescued following a crash in Santee Wednesday afternoon. According to the San Diego County Sheriff’s Department, the crash happened just after 4:30 at Mission Gorge Road and Cottonwood Avenue. Deputies responded to calls of a car hitting a motorcyclist. The victim was said to be conscious and breathing when they were taken to the hospital.
