SAN DIEGO (KGTV) - Newly unsealed court documents reveal how investigators were able to identify the suspected Church's Chicken shooter.Albert Lee Blake, 49, was arrested weeks after the shooting erupted inside of the Otay Mesa West restaurant. Blake is accused of shooting three employees and killing Maribel Ibanez. The shooting happened after an argument stemming from Blake allegedly trying to use a fake 0 dollar bill to purchase food. A number of witnesses gave similar descriptions of the man seen shooting inside of the Church's Chicken. Witnesses reported the man coming back into the restaurant after the argument, standing in line, then shooting at employees. They also said he calmly walked away after and got into a blue sedan.RELATED COVERAGE: Court documents reveal details in Church's Chicken murder investigationAccording to search warrant affidavits, surveillance footage from the area revealed the car used by the alleged shooter. Police ran the license plate through their database and found a match. The same vehicle was connected to a stop in September and the driver then was Albert Blake. Armed with Blake's name, investigators received “call data records” made from Blake’s cellphone on Nov. 6, the day of the shooting.The documents reveal the calls were made in close proximity to the Church’s Chicken on Del Sol Blvd.Surveillance footage showed a blue Dodge Charger in the area, matching the one Blake was stopped in before, at the same time the calls were made.RELATED COVERAGE:-- TIMELINE: Events that led to Church's Chicken shooting-- Worker dead, two employees shot at Church’s Chicken in Otay MesaOn Nov. 7, investigators traced the cellphone to Pomona where it was found abandoned. Investigators say Blake used the phone to contact his wife and a woman he was dating, right after the shooting.The car he was driving was registered to his wife. In the documents the wife, Amy Collins, says the two have been separated for three years, but she allowed him to use the car.She also told investigators that when she asked for the car back, Blake told her she would never get it back and that he would "blow the vehicle up."According to the documents, investigators later went to the girlfriend's apartment in Spring Valley. Blake was captured in Memphis, Tenn., and brought back to San Diego where he was formally charged.The documents don't reveal how he was tracked down to Tennessee.He was charged with one count of murder and two counts of attempted murder. He faces up to 114 years to life in prison. Blake is due back in court for a preliminary hearing in February. 3040

SAN DIEGO (KGTV) -- Police have identified the man who died following a stabbing in the Midway District in late November. According to police, 55-year-old Robert Frank Erbe, who police say was a transient, died after suffering trauma to his neck. Officers were called to the 3100 block of Sports Arena Boulevard around 8 a.m. on November 28 after receiving reports of a man with serious injuries. He was last seen wearing a dark hooded sweatshirt, blue digital camouflage pants and a blue hospital surgical mask. SAN DIEGO (KGTV) - Police are searching for a man who reportedly grabbed three women on three separate occasions before running away.The most recent incident was reported on Feb. 25, at about 7:30 p.m. near the intersection of Iris Ave. and Oro Vista Rd. A 22-year-old woman was walking when an unknown man walking in the opposite direction grabbed the woman's breasts and ran away, San Diego Police said.The incident is similar to two others reported in the same area.The first one, on Oct. 30, 2017, happened at about 7:30 p.m. and the second on Jan. 17, 2018, at about 9:30 p.m. Both occurred in the 1500 block of Oro Vista Rd. with a similarly described suspect who grabbed the women and ran away.The suspect is described as a Hispanic male in his early 20s, about 5-foot-6, and weighing about 220 pounds. SAN DIEGO (KGTV) - Owners of sportfishing and diving charters in San Diego expressed their grief and condolences Monday after learning of the deadly boat fire near Santa Cruz Island. John Conniff, the owner of Islander Charters, was at sea guiding a trip when he heard chatter over the radio. "It was in the middle of the night, and I could actually hear it from where I was sleeping, but we could only hear the Coast Guard side of things, at first I heard that there was a fire on a boat," said Conniff. "We couldn't hear the Conception side of the story, but I could hear Coast Guard responding to a serious mayday outside of Santa Barbara."It wasn't until Conniff returned to San Diego that he learned just how devastating the fire was. "My heart goes out to them… my first thought when I heard it on the radio was my own family and then of the families of the 25 people sleeping below decks on our boat," said Conniff. Coniff runs sportfishing and dive trips anywhere from one-and-a-half to five days. He says the whole industry is grieving. Patrick Douglas, with Horizon Charters, posted this message on their Facebook page. "Like many of you in the California dive community we woke up to the devastating news of the Truth Aquatics dive boat fire off Santa Cruz Island last night. Sending our deepest condolences and love out to the families impacted, this is a very sad day for the industry. #prayers"By phone, Douglas told 10News that dive boats in California operate at a higher level than any other state. He says they maintain the highest standards and an incident like this is an anomaly. In his 30 years of experience, Douglas has never seen an incident so severe. Both Douglas and Conniff acknowledge incidents like this are a reminder to double down on safety operations. "I would imagine that everybody is going to take a close look at what they do and how they do it and make sure that 'we're all in good shape."As crews continue searching for the Conception's missing passengers, flowers and other memorials are being set up at the Santa Barbara Harbor. 2079

SAN DIEGO (KGTV) - Point Loma neighbors are rallying to save a beloved bike track - a track they've built with their own hands, but no permits. The track on Famosa and Nimitz Boulevards was threatened on Monday. “I rushed over here as quick as I could,” Darren Miller said.  “I stood in front of the tractor and said, “I’m sorry I can't let you keep doing this.”It’s still unclear who sent the bobcat to level the track. But - the land belongs to the San Diego Housing Commission.Miller is a parent of two boys and says he started building the track last March after coming across the empty land. He added the jumps and curves, thinking it would become a sort of secret playground.“I thought myself and a couple of other dads involved would have a small little track that or six or seven kids knew about. I had no idea that this many people loved it,” he said.Monday night several families showed up for a rally to save the park, expressing their affinity for the neighborhood track. “This is the most awesome-est place in the world,” eight-year-old Jude Hudson said, “So much fun because there are some bumps and curves.”Parents agree.“We don’t want this to go. This a good place to be and to exercise and to keep them off their phones." Jon Erb said. "You got parents that come out here on a daily basis, so you got chaperones down here and keeps them away from drugs.”When 10News asked what the deal with the empty land was, the San Diego Housing Commission sent the following statement:“An unauthorized and unpermitted makeshift bike park was set up by unknown individuals on the undeveloped property that is owned by the San Diego Housing Commission (SDHC) at the corner of Famosa and Nimitz Boulevard.Some of the no trespassing signs placed on the property by SDHC have been removed. Without sufficient insurance, SDHC, a public agency, cannot allow the property to be used as a bike park.The property is being planned to be developed as affordable housing.  We are pleased to be working with the Community Planning Group on the future development of affordable housing at this site.” 2143
