SAN DIEGO (CNS) - A gunman who allegedly tried to mug a man he met online under the pretense of buying a gold chain outside a Chula Vista Costco, was behind bars Wednesday, facing a robbery charge.Albert Molina, 30, was arrested Tuesday after a scuffle in which the 23-year-old alleged victim snatched away his gun, fired a shot and held him at gunpoint while calling 911, according to police.Prior to the confrontation, Molina and the other man had communicated via OfferUp, an online service that facilitates private sales of used goods, Lt. Dan Peak said.Meeting the seller outside a Costco store in the 1100 block of Broadway, Molina agreed to buy a gold chain and provided a money order to supposedly pay for it. The two men tried to cash the check together, but found it was no good, according to police.They went to Molina's car and were sitting in it when the seller asked Molina to return his chain, which Molina was wearing, Peak said, adding "the suspect refused and pulled out a gun."The two men wrestled over the gun, which ended up in the seller's possession as he fell out of the vehicle. Believing Molina was going to run him over, he fired a round in Molina's direction, then held him at gunpoint while summoning police.Patrol officers arrived shortly after 7:30 p.m. and took both men into custody. After being interviewed by detectives, the seller was released, while Molina was booked into San Diego Central Jail. Neither was reported to be injured. 1477

SAN BERNARDINO (KGTV) -- Park View's Green Monsters sprayed the toasty San Bernardino sky with a barrage of home runs on their way to a convincing victory Sunday night in the first round of the Little League West Regional baseball tournament at Houghton Stadium.The Southern California squad from Chula Vista powered their way to a win with a grand slam and a pair of back-to-back jacks from their two biggest bats in their rout over the Northern California champion Tri-City Little League team out of Rocklin, Calif., 16-8.The opening round match up saw the Green Monsters fall behind early in the bottom of the first on a long ball when Tri-City's Nathan Erickson cracked a low drive off Kainoa Baptista that hooked over the 225 marker just inside the left field foul pole.After hitting Aiden Weissenberg-Frost on a pitch then allowing him to advance to second on a passed ball, Baptista gave up a single to Adam Van Der Kamp that brought in Weissenberg-Frost giving Northern California a 2-0 lead.Weissenberg-Frost, whose recent no-hitter helped put TCLL into the West Region tournament, continued his dominance on the mound Sunday night.  The 5-foot-9, 170-pound right-hander relied on his searing 75 mph fastball to record his fourth and fifth strikeouts of the game in the second inning. According to announcers broadcasting the game on ESPN Plus, Weissenberg-Frost's fastball is equivalent to a mid-90s fastball in the Major Leagues.The Green Monsters struggled to locate Weissenberg-Frost's heat, but it was on his 40th pitch of the game in the second inning that saw PVLL get on the scoreboard.PVLL's Atticus Gates lined a 3-1 fastball over second base that got past center fielder Trajan Rogowski allowing Conner Alonzo to score from first base to narrow TCLL's lead, 2-1.Matthew Bjornstad took the mound for Baptista in the bottom of the second inning and turned in a commanding performance striking out all three TCLL batters he faced on 15 pitches.With Weissenberg-Frost still throwing 70 mph darts, Michael Rodriguez, a 5-foot-11, 160-pound right-hander, blasted a 1-2 fastball over left-center into a row of tents several feet behind the wall giving PVLL a 3-2 lead.TCLL's Tanner Dykstra came on to replace Weissenberg-Frost (59 pitches, 6Ks, 3 runs) only to face the Green Monster's cleanup hitter Jose Mendoza.Mendoza, a 6-foot, 193-pound center fielder, crushed Dykstra's first pitch into the souvenir shack beyond the right field wall.  Rodriguez and Mendoza's back-to-back big flies put PVLL up 4-2.Weissenberg-Frost's night on the mound may have been finished, but his bat wasn't done.  With two outs in the bottom of the third, the pitcher-slash-power hitter stopped Bjornstad's streak of five consecutive outs with a homer of his own.  Weissenberg-Frost struck a moon shot over the scoreboard in the left field gallery to cut PVLL's lead, 4-3.PVLL would go on to race around the bases in the top of the fourth led by a second round of back-to-back homers from Rodriguez and Mendoza, giving the SoCal Champs an 8-3 lead.Northern California got help in the bottom of the 4th inning after Rodriguez, who took over pitching duties, walked in a couple of runs to make the score 9-5. SAN DIEGO (CNS) - A former La Jolla Country Day School teacher pleaded guilty Thursday to having sex with a 17-year-old female student and faces up to one year in local custody.An Oct. 21 sentencing date is scheduled for Jonathan Sammartino, 37, who also could face lifetime sex offender registration and be prohibited from teaching again at any school.San Diego County Superior Court Judge Charles G. Rogers, who took Sammartino's plea to a felony count of unlawful sexual intercourse with a minor, said he was "not inclined" to impose sex offender registration, but still might do so at the sentencing hearing.As part of the plea agreement, felony counts of oral copulation of a minor and digital penetration of a minor were dismissed.Sammartino, the son of U.S. District Judge Janis Sammartino, remains out of custody, pending the sentencing hearing.The victim, identified only as "Jane Doe" in court proceedings, testified earlier this year at Sammartino's preliminary hearing that the first sexual encounter happened in the early part of 2016, when he arrived at her home unannounced around midnight. She said she went outside to meet with him in his car, at which point he told her he didn't trust himself around her.Sexual encounters occurred that night in his car and on several other occasions in his vehicle and his house over the next few months, she testified.The victim, who went on to attend UC Berkeley, filed a report with campus police in the summer of 2018. Charges were filed later that year.In a recorded phone call played during the preliminary hearing, Sammartino admitted to the past encounters with the victim."Why did you do it? You knew I was 17," Doe says on the recording. "You knew I was your student. You knew it was my first time and I lost my virginity to you.""I don't have a good answer, because I wasn't thinking through what I was doing," he replied, apologizing to her several times throughout the call. "I can't believe that I did that."At the preliminary hearing, defense attorney Eugene Iredale unsuccessfully argued to have the charges reduced to misdemeanors, and introduced evidence regarding a 2015 bicycling accident in which Sammartino hit a pothole while riding in La Jolla and landed on his head. Sammartino was hospitalized and had to re-learn some functions before going back to the classroom, according to the defense attorney.Iredale argued that the brain injury affected his emotions and ability to make reasonable judgments, playing "a significant factor" in the commission of the charged acts.Rogers ruled against the defense request in January. Though he said he believed Sammartino had been affected by the injury and was unlikely to re- offend, he stated that the sexual nature of the defendant's relationship with the teen was entirely his idea."She wanted an emotional relationship with Dr. Sammartino. That is abundantly clear, and frankly, I think it's also clear that he wanted and needed an emotional relationship with her. But the sex was not her idea; the sex was his idea," Rogers said. June had reached its own high mark, with a more than 20 percent increase in sales over May.Existing homes are defined as single-family homes, townhomes, condominiums and co-ops.With July’s increase, to a seasonally adjusted annual rate of 5.86 million, purchases are now up 8.7% from a year ago. In July 2019, there were 5.39 million sales.“The housing market is well past the recovery phase and is now booming with higher home sales compared to the pre-pandemic days,” said Lawrence Yun, NAR’s chief economist. “With the sizable shift in remote work, current homeowners are looking for larger homes and this will lead to a secondary level of demand even into 2021.”Total housing inventory at the end of July totaled 1.5 million units, a year ago there were 1.9 million available units.“More homes need to be built,” Yun said in a statement on NAR’s website.Properties are staying on the market for an average of 22 days. SAN DIEGO — A new political ad is pushing a proposition it says will eliminate a "tax penalty" on homeowners whose homes burn down in wildfires.That measure, Proposition 19, would allow homeowners who lose their homes in a wildfire or natural disaster to transfer their property tax base to a replacement home anywhere in the state. That's important because in California, homeowners pay their property tax based on the value of a home when they buy it, under 1978's Prop 13. It only increases incrementally after. Therefore, buying a new home could cause a family's property tax bill to skyrocket. A new ad released by the Yes on 19 campaign, funded largely by the California Association of Realtors and California Firefighters Association, emphasizes that point. "It limits property taxes on wildfire victims, so families can move to a replacement home without a tax penalty," the ad says. Truth be Told, the benefit currently exists in California, but only in the county where a governor-declared disaster happened, or counties that accept transfers, which San Diego County only began doing two years ago. Prop 19 opens it to the whole state. Anurag Mehrotra, a professor of finance in San Diego State University's School of Business, said being unable to transfer the property tax basis does equate to a tax penalty."The person did not light his own house on fire, he was continuing to live there. I lost my house, now I have to buy a more expensive house," he said. "And when I get reassessed I'm basically going to be charged a higher amount." Proposition 19 does more than just allow the transfer for wildfire victims. It also allows up to three property tax base transfers for homeowners 55 and older, and those who are severely disabled. They can use it for any property, anywhere in the state. Another change, however, is that inherited properties are reassessed unless the recipient uses it as his or her primary home. Currently, heirs benefit because the property tax base transfers with the property, making for a big tax break. Under the proposition, there would be an adjustment upward, no matter the situation, if a market value of a home is above million. 2184
