SAN DIEGO (KGTV) - A judge decided Friday to place a sexually violent predator in the East County community of Boulevard. Michael Joseph Martinez, 64 has multiple previous convictions including child molestation and lewd and lascivious acts upon a child under 14, according to County Supervisor Dianne Jacob’s office.The judge added Friday that the sheriff’s department will be extra vigilant and security will be heightened.The judge decided to place Martinez at the Department of State Hospitals recommended location of 2135 McCain Valley Road. The schools closest to the address include Clover Flats Elementary School and Jacumba Elementary School, according to the San Diego County Sheriff's Department.A mother of one of the victims from 25 years ago spoke at the hearing saying, “I know that you can’t change the order and I’m glad that there’s going to be very strict ordering, but I hope this doesn’t happen to another child or family.”RELATED: Dianne Jacob slams proposed placement of predatorJacob said the placement would put public safety at risk. She adds that several sexually violent predators have been placed in East County in recent years and in some cases, the convicts ended up violating the conditions of their placement.In a letter to Judge David M. Gill, Jacob recommended that Martinez be placed in a state mental hospital or, if necessary, released to a trailer next to Donovan State Prison in Otay Mesa.Jacob represents San Diego County’s District 2, covering most of the eastern two-thirds of the county.San Diego County is home to approximately 4,000 registered sex offenders. SAN DIEGO (KGTV) — A recent bout with the flu nearly turned deadly for a San Carlos man when it took an unexpected turn.Five weeks ago, the usually healthy 58-year-old Dave Truby came down with the flu."Fever, nausea, inability to sleep ... body soreness," said Dave's brother, Mike.Mike his brother says Dave tried to fight through it. Some five days later, Dave went to an ER, but left because of the wait for beds. That same night at home, his brother found him in bad shape."Literally shaking in a fetal position," said Mike Truby.At the hospital, Mike received some devastating news. His brother's kidneys were failing, and the MRI showed brain damage from a massive stroke. "The brain wasn't getting clean blood. It was shutting down. The whole body was shutting down. They said it didn't look good," said Mike.Loved ones and friends braced for the worst."I said my prayers and breathed deep," he said.Those prayers were answered in gradual fashion. His kidneys started working and Dave started responding."The last two weeks, he moved his head, blinked, and mouthed words. Wheeled my mom into the hospital room a week ago, and he looked up and mouthed, 'Mom.' Gives us a lot of hope," he said. "You never think the flu is going to impact your life in a possibly terminal way."Much of his prognosis remains uncertain, but Mike is optimistic, though he's still a bit in shock over how this came about.Two recent studies suggest the flu can trigger strokes and lead to a prolonged risk lasting months. In Dave's case, he will survive his stroke. "Very thankful and very grateful. My brother has always been a stubborn, forceful man ... SAN DIEGO (KGTV) -- A Point Loma woman said a man took photos of her chest as she was walking into the Ralphs grocery store on Rosecrans Boulevard on Tuesday morning. It was around 9 a.m. when Julie Buerckley noticed a man standing by the entrance and as she got closer she says he began snapping photos on his phone.  "He was taking pictures of me but it wasn't of my whole body, it was just of my chest," said Buerckley.Buerckley told 10News she ran inside to tell someone, but by the time employees came out the man was long gone. She said there's no telling how long he'd been there or who else he'd taken pictures of. "I'm worried about kids getting pictures taken when their parents aren't paying attention and stuff," Buerckley said. "That's what I'm worried about."She described the man as being tall, and wearing a red shirt, blue jeans and white shoes.  906

SAN DIEGO (KGTV) — A San Diego family is living in an empty home and says nearly everything they own is being held hostage by a moving company.They’re part of a growing group of people around the country who say they’re victims of a deceptive bait-and-switch operation. 10News has spoken to a representative of the moving company who denies wrongdoing.Over FaceTime, Brad and Vanessa Angle gave 10News a tour of their house in North Carolina. They recently moved there from their home in Poway. The family is sleeping on mattresses on the floor since their furniture and household items never arrived. The goal of relocating was to live a stress-free life, but the feeling of emptiness is driving them to tears.“It affects a lot it. It affects my daily life. I have to keep going, you know. I try to stand up every day for my kids. I have three kids that I have to be there for,” Vanessa said.What hurts the most is losing the memories. Her husband, Brad, says Titan Moving and Storage has the family’s irreplaceable belongings, like the photos and videos of their kids, and Vanessa’s wedding dress.On Titan Moving and Storage’s paperwork to the Angle family, it shows the company’s address is in Chantilly, Va.The Angles say the company had originally given them a binding estimate of ,300 with ,205 down. Yet after movers loaded everything up during the family’s moving day in July, the Angles say the movers claimed that the family had more items than what they were originally quoted for. The movers doubled the estimate.The Angles say the movers demanded a partial payment.“I think it was ,700-something dollars that we had to write a check for,” says Brad. He says his family was assured that any issues could be worked out with a company associate come Monday.Monday came and went. “[An associate] answered the phone on my first call and then immediately hung up and then wouldn't answer after that,” says Brad of his attempt to resolve the dispute with the company.The Angles stopped payment on the check and the situation went from bad to worse.The Federal Motor Carrier Safety Administration, or FMCSA, is the government agency that oversees interstate moving trucks. The agency reports that the carrier has never been authorized to move household goods. The FMCSA is currently investigating the carrier.This year alone, the FMCSA reports there have been 98 complaints filed against the carrier. Complaints have come in from customers like Chris Baumann in Florida. He says the company pulled a bait-and-switch operation on him.“If I didn't have a headset on, you'd hear this house echoing. It's empty,” he said over video chat about not receiving his belongings from the moving company.He and others say they had checked reviews before hiring the company. Titan Moving and Storage only has one star on Yelp, but there are other companies listed on Yelp with similar names and better reviews, causing confusion for customers. The Angles recently got what they call "hostage” photos from the carrier. They were sent pictures of their items that are being held at an undisclosed storage facility in California. The company tells us it won’t release anything until receiving a storage payment from the family.“They're trying to charge us over a thousand dollars a month for storage which is insane,” says Brad.Titan Moving and Storage’s website has been down for several days. A manager with the company told us they're not taking new customers. He declined a taped interview but acknowledged that the company does not have a license to move household goods.He claimed it was due to a “filing issue” and said the company works with licensed third-party movers. The FMCSA tells 10News that the company is still not authorized to use third-party movers for household goods. The manager also told us that the company tried to resolve the matter with the Angles last month by offering them a reduced moving fee.The Angles call that a lie.“I see it as a crime. They don't have a license,” adds Vanessa.According to the FMCSA, the FMCSA does not have the authority to resolve claims against a moving company. State law enforcement, transportation and consumer affairs agencies are responsible for pursuing suspected incidents of moving fraud and regulating the operations of intrastate moves.According to the California Department of Consumer Affairs, moving companies that operate within California are required to be licensed by the Bureau of Electronic and Appliance Repair, Home Furnishings and Thermal Insulation (BEARHFTI), part of the Department of Consumer Affairs.The BEARHFTI became the new licensing and regulatory home for household movers on July 1, 2018. The BEARHFTI is aware of the consumer complaints against Titan Moving and Storage but cannot comment specifically during the open investigation.A spokesperson tells 10News that the company is not licensed with the BEARHFTI.A sergeant with the San Diego County Sheriff’s Department tells 10News that its detectives are looking into the matter. 5031

SAN DIEGO (KGTV) - A Marine was honored Monday at Camp Pendleton for his bravery mid-September when he saved a choking baby.Private First Class Jonathan Lewellen was on leave after graduating boot camp before starting combat training. He was upgrading his phone at the Liberty Station Verizon store when he heard a mother screaming her son's name."She wasn’t hysterical but she was panicked," Verizon Store Manager Cecil Silva said. "He [Lewellen] looked and his instincts just kicked in, like he literally jumped over a desk we had, jumped over the railing, ran through the bushes and just attended to the baby."Lewellen asked the mother if he could help, then performed CPR, and scooped mucus out of the baby's throat."The baby was pretty pale, started getting a little blue-ish," Silva said he called 9-1-1 and was asked to stay on the line, saying several others calling couldn't hold a connection due to bad cell service."Once the ambulance was here they were just like, you’re lucky this guy was here," Silva said both parents were shaken from what happened. He added he has nieces and nephews of the same age and admired how Lewellen had the training and response to provide aide."That just shows, you never you never just turn that part of you off. Good people are just good people," he said, calling him a hero."I did what I was trained to do I don't think I'm a hero more than anyone else would be," Lewellen said. He was thinking of his own two children while saving the baby. He has a 3-year old and a 3-week-old.After combat training, he will go on to work as an aviation mechanic. 1637
