SAN DIEGO (CNS) - A former member of the U.S. national wrestling team, who was severely injured during a training camp exercise held at Camp Pendleton, has filed a lawsuit alleging the Marine Corps and USA Wrestling encouraged him and other civilians to take part in a military-style exercise involving weapons that the participants weren't adequately trained to use.Richard Perry and his wife Gina Cimmino filed the lawsuit Tuesday in San Diego federal court against the United States and Armament Systems and Procedures Inc., a company that manufactured and sold a padded baton used in the exercise that resulted in Perry's injury on Aug. 27, 2018.Perry and another civilian attendee of the training camp were provided batons and helmets with facemasks and given "instruction to strike, thrust and jab at the opponent's head and face to score a `kill shot,"' according to the complaint.As Perry's training partner jabbed with the baton, the weapon passed through a gap in Perry's facemask and shattered his eye socket and skull, pushing shattered bone fragments into his brain, the suit alleges.The injury nearly killed him and left him with multiple traumatic brain injuries, skull fractures and "permanent, disfiguring, disabling injuries" which "will require extensive future medical care, vocational rehabilitation, and life care for the rest of his life," according to his court papers.Perry and the other wrestlers were invited to Camp Pendleton as part of a joint event held by USA Wrestling and the Marine Corps that was partly intended as a Marine Corps recruitment initiative, according to the suit.Perry's attorneys allege National Team members were required to attend the camp, as non-attendance resulted in "adverse consequences, including losing a monetary stipend they otherwise earn as National Team members."The lawsuit alleges the Marine Corps and USA Wrestling "placed Richard Perry and other civilian Camp attendees into a `fight club'-style full- speed, full-contact military weapons training exercise," and that Marine Corps and USA Wrestling members "recklessly encouraged head shots and baton jabs by the inexperienced participants" during the exercise in which Perry was injured.The helmets provided to Perry and other wrestlers were "grossly unsuitable for the baton striking drills and posed a clear risk of serious injury," according to the suit. The plaintiff also alleges the Marine Corps and USA Wrestling failed to inspect or maintain the equipment used during the exercise and the batons were "dangerously unprotected," with the padding only held in place by duct tape.Robert J. Francavilla, the lead trial attorney on the case, said his client "suffered a traumatic injury that has affected his life, his livelihood and the lives of those who love him. We intend to hold those responsible for this injury, accountable." 2863

SAN DIEGO (CNS) - A drunken driver who crashed into a Lyft vehicle at high speed on state Route 163 in Balboa Park -- killing one passenger and injuring the other two occupants -- pleaded guilty Wednesday to gross vehicular manslaughter while intoxicated and DUI causing injury. Alondra Selena Marquez, 22, of San Diego, faces up to 13 years and four months in prison, with sentencing slated for Sept. 24 at the downtown San Diego courthouse. Prosecutors say Marquez had a .25 percent blood alcohol content -- more than three times the legal limit -- at the time of the March 23 crash that killed San Francisco resident Giao Pham. RELATED: 1 dead, 3 injured in crash along SR-163Pham, 40, was in San Diego to attend a wedding when the vehicle he was riding in was struck from behind by Marquez's car about 2:30 a.m. on SR 163 near Laurel Street. Deputy District Attorney Cally Bright said Marquez was traveling somewhere between 101 and 108 miles per hour at the time. The other passenger -- Pham's friend, Andy Lynn -- was hospitalized with a traumatic brain injury, which still affects him to this day, the prosecutor said. The Lyft driver suffered minor injuries in the crash, but has had to seek counseling due to the emotional after-effects of the crash, according to Bright. 1289

SAN DIEGO - A landlord in the College Area near San Diego State says the homeless problem is getting worse, and it's keeping people from renting in the neighborhood.Suhail Khalifeh owns six homes near El Cajon Boulevard and Montezuma Road. He says one of them has sat empty for six months because renters are worried about the sight of homeless people in the area."When people come and see the scenes of homeless all around and smell the urine in the atmosphere, they leave and never come back," says Khalifeh.Khalifeh says he finds trash, drugs and feces in the bushes near his properties.The neighborhood has dealt with the problem for months. Last July, neighbors complained that a nearby vacant lot was becoming a camping ground for homeless people. She has to give them rides to the library next door," he says. "It's 50 feet away, and she doesn't feel safe for her kids to walk to the library."Khalifeh showed surveillance video to 10News of a homeless man threatening one of his neighbors. He also has video of people meeting in the middle of the night for what he thinks are drug deals.A search of the website crimemapping.com shows 46 criminal reports filed in the area within the last month.Khalifeh says the police do an excellent job at responding, but they can only offer short-term solutions. He wants the city to do more to address the bigger issue."They live in the street," he says. "In the daytime, they're in the street, and at night they go to the parking lot of the library." 1764

  

SAN DIEGO (CNS) - A former biologist at the San Diego Zoo was sentenced Wednesday to six months in federal prison for embezzling hundreds of thousands of dollars by cashing payments for false invoices he created.Matthew John Anderson, 50, of Ramona, pleaded guilty earlier this year to a theft charge for taking more than 6,000 from the zoo over the course of eight years. The U.S. Attorney's Office said that as a citizen of the United Kingdom, Anderson will likely face deportation once his sentence is completed.He has paid the full restitution amount back to the zoo, the U.S. Attorney's Office said."For years, this defendant took advantage of the trust of one of our city's most beloved institutions," said U.S. Attorney Robert Brewer. "His theft compromised the San Diego Zoo's world-renowned conservation work, made possible by government grants, charitable donations and the work of thousands of unpaid volunteers."Prosecutors said Anderson created dozens of fake invoices -- often using the name of fictitious vendors -- then submitted the invoices to the zoo for payment for products that were never purchased or received. Additionally, he submitted invoices for his personal expenses.The zoo sent payments to accounts he controlled or to other third parties, who sent the bulk of the payments to Anderson, prosecutors said.Anderson worked at the zoo for more than 17 years and served as the director of behavioral biology for the zoo's Institute for Conservation Research. He was fired in late 2017, according to the U.S. Attorney's Office. 1563
