ENCINITAS, Calif. (KGTV) -- The San Diego Sheriff's Office is investigating an incident involving Phil Graham, a candidate to represent the 76th district in the California Assembly. Niki Burgan filed the battery case with the Sheriff's Office Sunday, May 20.  She accuses Graham of forcibly kissing her at an Encinitas Bar. Burgan told 10News that it happened at 1st Street Bar on S. Coast Hwy 101 on the evening of Sunday, May 13, into the early morning of Monday, May 14 as the bar was closing. She said that Graham had initially been flirting, even mentioning that he was running for office and asked whether she would vote for him. After finding out that he was a Republican candidate she said, no she was a Democrat. At some point, she says his talk turned into aggression and Graham grabbed her hair, pulled her in, and started to kiss her. She said she had to push him off. Burgan also said she remembers that Graham had so much to drink that night that she had to help him sign his tab. The next morning Burgan says she learned that he was related to former Governor Pete Wilson and she was worried about repercussions. That's why she didn't file right charges right away.  1259

Ever since their older brother competed in the Scripps National Spelling Bee years ago, twin brothers Garrett and Pierce Bryner have dreamed of making it to the bee — together.This year, they’ll see that dream become reality. “It’s kind of historical, I guess you’d say,” said Garrett, who made it to the national bee — without his brother — last year.Previously, twins would never have been able to make it to the bee together, as one would have always beaten the other out. But thanks to new qualifying rules put in place this year which incorporate a point system, two sets of twins are now going to be on the national stage for the first time in the spelling bee's 91-year history: the Bryner twins, and another set of twins from Mississippi.Garrett’s brother Pierce will become the third sibling in the Bryner family to attend the bee.Their mom, Liz Bryner, who has shepherded her kids through her share of bees, says that while the two will be nervous, for the parents, its on a whole other level.“I think nothing compared to the Bee in terms of the stress level,” Liz said from her home in Utah. “If you look around at the parents they’re often more nervous than the kids. I think it’s really a nail-biting experience.”Garret and Pierce say they can be competitive when it comes to studying. "Sometimes the other one jumps in tries to spell the word before the other one,” Pierce said. Ultimately they hope for the best for each other.“I just cheer him on,” Pierce said.They’ve been studying as much as they can, Liz said, but as eighth grade boys, surrounded by the rugged landscape of Utah, their attention span only lasts so long before they want to get back outside and hop on their bikes.“I don’t think we’ve ever gone longer than probably 90 minutes at a time,” she said. “That’s about as long as anyone’s been willing to do.”“To know that they can both understand what it’s like to be there at the national bee to compete, and it’ll be something they share,” she said. “The fact that they can share this experience is just incredible as a mom.”ESPN, which broadcasts the bee, has seen viewership numbers for the annual contest that have hovered around one million people. (KGTV) — Encinitas leaders will consider developing a parking lot for the homeless next week, but the idea is already receiving pushback.If approved, the parking lot would be the first for homeless use in North County and modeled after other similar lots in San Diego.The location, at the Leichtag Commons agricultural property on Saxony Road, would be operated by Jewish Family Services. Some locals have already submitted letters to Encinitas City Council against the idea: "While a homeless parking lot may sound like a compassionate idea, it will be problematic for the area," wrote one resident."I am not opposed to helping, I am opposed to the location," said another, citing safety concerns."I wonder who is going to pay for the added police patrol/protection when this upscale neighborhood becomes a hep-c ghetto like parts of downtown San Diego," wrote another resident."There's something a bit crazy about allowing homeless people to live in one of the most desirable towns in the world for free, no strings attached," another local wrote.Much of the money to be used for the program comes from a state grant. Hopkins added that the grant includes money for security, but other lots have had minimal problems."We hope when City Council gets together, they'll understand the urgency of families and individuals living in cars," Hopkins said.Encinitas' leaders will hold their first vote on the plan Wednesday. 2130

ENCINITAS, Calif. (KGTV) -- Encinitas lifeguards are investigating after a Panga Boat washed ashore Friday afternoon.According to lifeguards, the 20-foot boat washed ashore around 4 p.m. on the 300 block of El Portal Street and about 11 people ran from the vessel.Lifeguards say they don’t believe anyone was injured or needed medical attention.Border Patrol, Homeland Security, and the Sheriff’s Department were all notified about the incident. Multiple agents have responded and are combing the area. 510
