VISTA, Calif. (KGTV) - Kellen Winslow Jr. affirmed his innocence to 10News Thursday as he appeared in court to face a third charge of rape.The son of a Chargers legend, Winslow pleaded not guilty to the alleged rape a 17-year old girl in 2003.  10News was able to capture a few words with Winslow as he walked to his car in the parking lot outside court. When reporter Jim Patton asked about the new rape charge, Winslow responded it would all come out in court. Then asked if he was innocent of the other allegations of raping two women in Encinitas, Winslow said, "I'm advised by my lawyer to not speak on much. But yes, I am innocent." The new charge involves a woman who was 17 years old at the time. Winslow was 19. She claims he raped her while she was unconscious. Winslow Jr.'s attorney has previously said their relationship was consensual.  Thursday, the defense repeated a request for the woman's psychological history.Thursday's court hearing lasted no more than 15 minutes as attorneys debated whether this new case should be tried along with the other two rape allegations. Winslow Jr.'s attorneys argued the new charge could prejudice the other two.The judge allowed the cases to remain joined for now for efficiency but said the trial judge would make the ultimate decision.  Winslow is currently free on a million bond, while required to wear a GPS monitoring bracelet. His trial date was set for March 19th, 2019. 1507

(KGTV) -- After a trip to visit their grandma in Ohio, eight year old Lilly and 12 year old Zachary were driving back to California with their mom and grandma when a wrong-way driver hit their car head-on in Oklahoma, killing all four of them. The wrong-way driver, identified by Oklahoma authorities as 33-year-old Ashley Louise Ricks, survived the crash.Monday, Oklahoma authorities gave an update, saying witnesses smelled alcohol at the scene of the crash. Witnesses and 911 calls also reveal the woman was driving at a high rate of speed and in the wrong direction for at least nine miles before the fatal crash occurred. Authorities said they’re currently investigating her medical history, driver history and taking blood samples before making any charges.The family was driving back to Vista, near San Diego, so Lilly could make it back home in time for school to resume. A GoFundMe created by a family friend shows the kids called their dad and stepmom every day while on vacation, telling them about the fun they’d had on their trip.Sam Homant, the kids’ dad, and their stepmom Melissa Starnes said the last time they talked to their son, it was the night of the crash.“He was excited to come home. We had just got him a brand new bed, a brand new bed that he was just so excited for, this pillow top mattress and he was so excited. And that was the last thing that we said to him,” said Starnes.They described the kids as family oriented and special. Zachary had a creative and kind heart.“He could take Legos and create anything out of Legos. He loved to build, just a smart smart little boy. Very creative. Wanted to be an architect. His imagination was off the rack,” they said.Lilly had similar passions to many little girls her age, but also loved to ride her dad’s motorcycle with him.“She loved makeup and dancing and her dolls. VISTA (CNS) - A man was shot in the knee by someone in a passing car while walking in a Vista neighborhood, authorities said Saturday.The 38-year-old victim said he was walking at about midnight Friday in the 1100 block of North Santa Fe Avenue and looked down to retrieve an item from a bag, according to Sgt. Adrian Moses of the San Diego County Sheriff's Department.As he looked down, he heard a loud bang and fell to the ground with a gunshot wound to his knee, Moses said.A witness heard the gunshot and saw a white Nissan Sentra driven by a woman with a male passenger leave the area on North Santa Fe Avenue, the sergeant said.The victim was taken to Palomar Medical Center for treatment of injuries that were not considered life-threatening, Moses said.There was no surveillance video immediately available and detectives from the Vista sheriff's station were investigating the shooting. 903

VISTA (CNS) - A former speech therapist at Rancho Buena Vista High School, who allegedly threatened co-workers while working at the northern San Diego County campus, pleaded not guilty Tuesday to charges of burglary, making criminal threats and vandalism.Arturo Avina, 33, was taken into custody by a SWAT team last Friday morning in connection with a series of menacing messages he allegedly sent to co-workers. The victims began receiving the messages last month, according to sheriff's Sgt. Shane Watts.Authorities released no details on the nature of the purported threats and did not specify the number of alleged victims. However, no students were involved in the threats, according to Lisa Contreras, director of communications for Vista Unified School District.RELATED: Former speech therapist at Rancho Buena Vista High School arrested``At no time were there any students who were in danger,'' Contreras said.
