SAN DIEGO (KGTV) - The trial for a former San Diego County sheriff's deputy accused of sexual misconduct while wearing his uniform began Monday in Vista.More than a dozen women claim Deputy Richard Fischer made unwanted advances."I think he's a bad guy," a San Marcos woman, who filed ,000,000 claim against the County, said.She said in August of 2017 two sheriff's deputies knocked on her door in the middle of the night for a welfare check. There was no problem and they left but she said Fischer returned alone an hour later, saying he needed to use her restroom; then told her she was cute and hugged her, several times."I was stunned shocked, it was very fast and confusing...I felt very vulnerable, intimidated, felt weak. I felt little." She said, next to tears. "It's just a mess! Everything is a mess! This is hard to do. He shouldn't have come back to my house and I don't ... Everything's a mess!"Similar instances were described by other women. In October of 2017, near the entryway of a 64-year-old woman's condo, Fischer took her report for a domestic violence incident and then made his move."His hands went all the way down to her butt and he squeezed both of her buttocks... he took her hand and pulled it down to his groin area," Lawyer Dan Gilleon said. He represents several women who filed claims against Fischer.Gilleon made a theme apparent, "he knows that she's alone, and she's vulnerable, and she's scared." Another victim called him a predator.Some women who came forward claim Fischer became more brazen, forcing sexual acts.Wednesday a plea deal fell through. The deal would mean Fischer would plead guilty to four felony charges -- down from more than 12 felonies -- and serve no more than five years in prison.10News learned that Fischer would also have to register as a sex offender for life under the plea deal.Fischer faces more than 25 years in prison if convicted of all charges. SAN DIEGO (KGTV) - This holiday season, shopping local is what will keep San Diego small businesses alive.The US Census conducted a small business survey showing a third of San Diego businesses were negatively impacted by the pandemic. The effect is visible downtown."The pandemic has definitely taken a toll on the neighborhood, I mean we've had some closures," Gaslamp Quarter Executive Director Association Michael Trimble said.Trimble said four to eight restaurants closed since March in the Gaslamp Quarter alone."Not a large percentage but still any business lost is unfortunately a business that we mourn is not here," he said.While the holiday sale signs are out, the usual crowds brought in with conventions and tourism are nowhere to be seen.Trimble said locals are vital to keeping retail and restaurants alive this holiday season."Watching all these small businesses shut down or close forever during the pandemic, it's just been really sad. So, I don't have a ton of money but Amazon doesn't need my money. You know what I mean? Like, if I can help these little shops with my or my that's just a much better use of my time," Pacific Beach Resident Bree Steffen said.When the pandemic started Steffen pledged to only shop small. She deleted her Amazon app and started exploring her neighborhood, "I feel like this whole underworld of San Diego opened up for me once I started looking at the smaller shops."She said it was a more personal experience, where she found unique gifts that had more emotional value from being hand-crafted.She launched her own small photography business in October.Now she relies on people like her to change their habits and think small."I feel like each time I at least give them a little business it just gives them a little more hope to keep going on and it's like if 100 people give them then that's enough for them to try to weather this storm," she said hopeful it will end soon.Trimble said on November 28th, also known as Small Business Saturday, if you take a picture while shopping or in the area and tag @GaslampQuarter on Instagram you will be entered to win a gift card from local establishments.Trimble said there has been one silver lining of the pandemic and that was testing the outdoor dining concept on Fifth Avenue out of necessity.That paved the way for a long coveted project to turn Fifth Avenue into a promenade. SAN DIEGO (KGTV) -- This Veteran's Day hundreds gathered at the Mt. Soledad National Veterans Memorial, honoring those who've selflessly served and sacrificed for the nation.Wayne Thompson, who served in the Navy for 30 years, says he attends the Mt. Soledad ceremony every year.“This world would be a lot different if we didn’t have the people that are on this wall. If they didn’t give their lives for the people in this country," said Thompson.Thompson did three tours in Vietnam and now suffers from health complications due to Agent Orange. He's had 11 seizures but says he would serve all over again if asked.“I kept wanting to serve, I don’t know, I just felt like I was doing something for the country, it’s hard to understand, but you get a fulfillment out of serving somebody," said Thompson.He says he's grateful for those who served before him and those serving now.Col. Charles B. Dockery, commanding officer of Marine Corps Air Station Miramar, was the keynote speaker at Monday's event. 1009

  

SAN DIEGO (KGTV) - The only child to live through the Paradise Hills murder-suicide, died Saturday, relatives told 10News. Nine-year-old Ezequiel Valdivia passed at 11:23 Saturday night at Rady Children's Hospital after his family made the difficult decision to pull the plug."He's probably been gone from us for a while," said Karl Albright, Rosario's brother-in-law. "We were just using the machines to keep his body with us. But he has been upstairs with his family, watching us."Ezequiel's father, Jose Valdivia, also shot and killed his sons, Enzi, 3, Zuriel, 5, and Zeth, 11, and their 29-year-old mother, Sabrina Rosario. Valdivia then turned the gun on himself.The muder-suicide happened on Saturday, November 16 at the family's home on Flintridge Drive in Paradise Hills.The Paradise Hills community and the Twin Hills Little League came together to host this month's "Cruise Reo Car Show" as a fundraiser to help the family."The whole community of Paradise Hills came out today, and the Twin Hills Little League. They are our family forever," Vanessa Pash said. She, like Sabrina Rosario, is a Twin Hills Little League mom. Albright said Baby Enzi was the shy one, Zuriel was playful. Ezequiel was the athlete and Zeth was a sensitive sweetheart. All of them poured their love for baseball into the Twin Hills Little League."The little one was only three, and he wasn't old enough to play, but the coaches would let him go out there and practice, and make him feel like he was part of the team," Pash said. To honor the three players, the league decided to retire each child's jersey number. They also agreed to play in the boys' honor for all future games. Albright says he is overwhelmed with what the community continues to do for their family. "It's amazing how many people are coming together to do all of these things for complete strangers," Albright said. The family is now in the process of donating Ezequiel's organs. The boys and their mother will be buried together. "There's no pain, there's no suffering, no anguish, no anxiety. There's nothing. Pure peace," Albright said. Officers received another call en route to the home from a neighbor who said they heard arguing and what they believed to be a "nail gun firing." Three of the boys were found dead in the home. Ezequiel survived for one week, but was taken off life support November 23 after the doctors said he was brain dead, according to Rosario’s brother-in-law. The boys lived in the home with their mother and other relatives, but not Valdivia, who was in the process of divorcing Rosario.
