SAN DIEGO, Calif. (KGTV) – A prominent harbor cruise company is continuing to operate despite being cited for violating a County health order. Tuesday afternoon, 10News took video of Flagship Cruises & Events taking passengers aboard for bay tours even after the company was cited by San Diego Harbor Police over the holiday weekend for violating the County's health order 14C which bans recreational boating unless all the passengers are from the same household. Tuesday, a company spokesperson sent the following statement to 10News.“We are part of the Passenger Vessel Association, not recreational boating. They are classifying us under a charter business which is still banned. We DO have a charter business but are not operating any charters at this time. Only public tours and maintaining all safety guidelines set by the city & CDC. We didn’t receive a cease & desist, and will continue to operate our harbor tours & patriot jet boat this week. We open up our dining cruises starting this Friday with Hops on the Harbor – pairing with local brewery, Pizza Port.”Monday night, the company told 10News it's part 14E of the County health order, not 14C. That section states in part, "other public or private outdoor recreational facilities (other than community pools per State order), including recreational equipment (such as bicycle, boat, kayak, equestrian and surfboard) rentals may be open for limited use."During Tuesday’s County press conference, Supervisor Nathan Fletcher told 10News, “The rental items that they're alluding [are for] individual use type things like a bicycle or a kayak or a surfboard and so they are not covered under the current public health order,” and added, “If they continue to operate, they are going to continue to be cited.”Harbor Police say the citation comes with a fine of up to ,000 and up to a year in jail. Harbor Police say they're documenting each sail the company is doing and incorporating those into the original citation that it sent to the City Attorney's Office. 2046

San Diego (KGTV)- In honor of Dr. Martin Luther King Jr. Day, hundreds are giving back in the best way they can. This morning volunteers rolled up their sleeves to clean up Balboa Park. 14-year-old Maya Hundley spent the morning planting flowers with her family at the MLK Day of Service Interfaith Project. "I think it's important any day to help out, especially today," says Hundley. "Instead of being lazy or taking it as an extra day off, you can use that time to make a difference in the world." More than 300 volunteers spent the morning cleaning up Balboa Park. "People are doing anything from planting trees and flowers to raking leaves and hauling brush," says Melissa Spence with First United Methodist Church of San Diego. The city's parks and recreation department was on hand, showing volunteers which areas needed the most care. The MLK Day of Service Interfaith Project includes Christians, Jews, Muslims, and Unitarians working together. This is the 11th year the group has come together for the event. "As people of different faiths, we recognize that God gave us this earth we're being called to care for it in the best way that we can," says Spence. Volunteers say they believe this work would have made Dr. King proud."We all look so different, but we're all helping for a common cause," says Hundley. 1330

SAN DIEGO, California — One year ago, life forever changed for Navy EOD technician Kenton Stacy and his family.He was in a Syrian hospital clearing IEDs when one exploded, leaving him with a two percent chance of survival. His comrades fought to save his life and did, but Kenton was left paralyzed and unable to talk.He's now receiving care at the VA Medical Center in La Jolla.“We’re all ready for him to come home, it's just been hard juggling being here, being with the kids," said Lindsey Stacy, Kenton's wife.The couple has four children, one with special needs.As they work through Kenton's recovery, the family was hit with yet another unexpected hardship.They've been renting their Chesapeake, VA home for the last two years, not realizing tenants were destroying the house.The carpet and blinds were destroyed as well as much of the hardwood floors. The tenants also smoked cigarettes in the home."I just couldn't believe that people would destroy someone else’s property like that, shocking and it hurt,” said Lindsey.She shared what happened on their Facebook page #StacyStrong.It didn't take long for the community to step up and help make it right, with members of the EOD community spending hours to repair the house.Real estate agent Julie Fish, wife of an EOD tech, also stepped up to help.She's going to help sell the house without taking a commission and has enlisted help for labor and needed repairs. "The EOD community, they really have made it that they're taking care of it and it's one less thing I have to worry about," said Lindsey. SAN FRANCISCO (AP) — A federal count shows the number of homeless people increased by double-digit percentages in three San Francisco Bay Area counties over two years as the region struggled to tackle the growing problem, including 17% in San Francisco and 43% in the county that includes Oakland.More than 25,000 people were counted as homeless during an overnight tally conducted in San Francisco, Alameda and Silicon Valley's Santa Clara counties in January. San Diego Unified School Board president and math teacher Kevin Beiser will introduce a resolution at Tuesday night's meeting demanding action from state and federal lawmakers pass stricter gun control laws."It's an opportunity for us parents students and teachers to speak in unison and call on our elected officials to do what we know is right and implement reasonable gun reform now, said Beiser ahead of the meeting. The board did something similar after the Sandy Hook school shooting back in 2012 but Beiser thinks it's worth stating again. And although it's not included in the resolution, Beiser expects the issue of arming teachers to come up at the meeting.Last week President Trump said he favored arming teachers to protect students. 763
