SAN DIEGO (CNS) - San Diego County public health officials Sunday reported 373 new cases of COVID-19 and no new deaths, bringing the county's totals to 52,355 and the death toll remaining at 853.Officials are imploring San Diegans to maintain vigilance as positive case rates for the coronavirus continue to increase in the region."We are now concerned about the trends and we are concerned about the likelihood we could tip back to purple, Supervisor Nathan Fletcher said on Twitter today. The county is now in the red tier and the limit for the next tier is seven cases per 100,000 residents.Fletcher pointed to positive unadjusted case rates over six days (Oct. 11-16): 6.9 out of 100,000 residents, to 7.2 to 7.3 to 7.4 to 7.7 and 7.8.The county will be in the red, or "substantial," tier for at least another two weeks.But Fletcher and Public Health Officer Dr. Wilma Wooten held an emergency meeting Friday to "sound the alarm" as the future case rate appears to cross into the purple tier of the state's four-tier reopening system.With the state's monitoring system having a seven-day lag, the adjusted case rate of positive COVID-19 tests is 6.8 per 100,000 residents, up from 6.5 in the previous assessment.Nearly all non-essential indoor businesses would close under the purple tier."We are still in the red tier, but it is too close for comfort," Wooten said.The California Department of Public Health will update the county's data Tuesday.One new community outbreak was confirmed Saturday in a business. In the past seven days, 32 community outbreaks were confirmed, well above the trigger of seven or more in a week's time.A community outbreak is defined as three or more COVID-19 cases in a setting and in people of different households over the past 14 days.The county uses community outbreaks to get a larger sense of the pandemic locally, but the state does not include the statistic in its weekly report.Wooten said 95% of the county's cases were not related to a marked community outbreak, a clear indicator the illness has spread throughout the county.A total of 12,233 tests were reported to the county Saturday and the percentage of new laboratory-confirmed cases was 3%.The 14-day rolling average percentage of positive cases is 2.7%. SAN DIEGO (CNS) - The family of a 19-year-old San Diego State University student who died after falling from his bunk bed and striking his head following a night of drinking has filed a wrongful death lawsuit against several defendants, including the university, the fraternity he was pledging for, and the manufacturer of the bed he fell from.The lawsuit filed last week in San Diego Superior Court alleges Dylan Hernandez was hazed by members of Phi Gamma Delta just prior to his death, and that fraternity members not only failed to obtain medical attention for him after he became extremely intoxicated, but also attempted to hide evidence of misconduct following his fatal fall.Hernandez fell from his bed on Nov. 7, 2019, and died in a hospital the following day.RELATED: Investigation completed into death of SDSU student who died after fall from bedThe lawsuit alleges he attended a "Big Brother, Little Brother" fraternity event that had pledges "screamed at and demeaned, beaten with paddles and hands, and forced to consume shots of vodka and rum to the point of intoxication."Following his hospitalization, the lawsuit alleges Phi Gamma Delta members instructed others to remove incriminating material from their cell phones and in group chats, members were told to "Keep your mouths shut!" and "Just remember, Silence is Golden!"Representatives with Phi Gamma Delta did not respond to a request for comment.RELATED: Autopsy report of SDSU student who died after fall from bed releasedIts national office permanently suspended its SDSU chapter in August and SDSU expelled the fraternity until 2030.In July, it was announced that no criminal charges would be pursued in connection with Hernandez's death, which was ruled accidental. A joint statement released by the university's police department and the San Diego County District Attorney's Office stated there was "no basis" for manslaughter or hazing charges.Investigators said there were no injuries on Hernandez's body "that appeared consistent with hazing, and no evidence of student group activities likely to cause serious bodily injury or death, which is statutorily required to prove hazing." Other than Hernandez's "devastating head injuries," the only other wound to his body was an abrasion on his thigh, officials said.RELATED: San Diego State suspends 14 fraternities after student is hospitalizedOne month after that statement was released, Rob Caudill, the fraternity's executive director, sent SDSU a letter announcing the chapter's closure, stating the SDSU chapter had been found guilty of violating fraternity bylaws, including hazing, drug use and violations related to alcohol misuse.SDSU representatives said the university could not comment as it had not yet seen the lawsuit, but pointed to steps the university has taken to combat hazing activities on campus in the wake of Hernandez's death. These include the formations of two task forces examining student activities and alcohol/substance abuse. Task force recommendations led to the implementation of a Good Samaritan Policy, in which student organizations are encouraged to report concerns about student health and safety, and a Hazing Prevention Task Force that held its first meeting this fall.Hernandez's family alleges SDSU was aware of prior hazing issues involving Phi Gamma Delta and failed to properly discipline the fraternity for such activities. The family alleges SDSU was aware of prior instances when Phi Gamma Delta pledges were hazed or hospitalized for excessive drinking.The family also alleges the school created an unsafe environment in the Tenochca Residence Hall where Hernandez suffered the fatal fall by furnishing its rooms with bunk beds that didn't meet minimum safety standards.In suing SDSU and the bunk bed manufacturer, Foliot Furniture Pacific, the family alleges the beds featured "safety rails" that were defective, and contributed to 550,000 deaths nationwide over a 16-year period and 10 injuries at SDSU between 2017 and 2019. 4015

SAN DIEGO (CNS) - The Board of Supervisors today extended a state of emergency over a hepatitis A outbreak in San Diego County that has killed 20 people, amid a declining number of new cases.Health officials told the supervisors at a special meeting that the drop in case numbers is a sign that efforts to fight the outbreak are working.RELATED: Governor Jerry Brown declares state of emergency over Hepatitis A outbreakThey stressed the need for the county to continue vaccination, prevention and educational efforts that have been put in place since the emergency was declared in September. There were 31 confirmed cases of hepatitis A last month, compared to a peak of 94 cases in August.There have been 544 cases as of Monday in the nearly year-old outbreak, an increase of 28 cases since data was last released on Oct. 24, according to Dr. Wilma Wooten, the county's public health officer.She said some of those 28 cases include ones from as long ago as April that were newly confirmed by the U.S. Centers for Disease Control and Prevention. Due to the disease's long incubation period, there could potentially be more confirmed cases from October. Wooten said the initial decline is a good sign, but not a reason to declare victory."We could potentially have a second peak," she said. "That's why it's very important for us to continue our vaccination efforts."In San Diego, nearly two-thirds of the victims have been either homeless, users of illicit drugs or both. Much of the county's efforts have focused on those populations, but Wooten said an outbreak in Michigan that has affected men who have sex with men underscores the importance of targeting that community here.Local efforts include holding vaccination events at LGBT centers and distributing educational information to clinics that serve that community, she said. Around .5 million has been spent by the county to fight the spread of the disease, including administering over 90,000 vaccinations and spreading awareness among the public, according to county documents.Hepatitis A is usually transmitted by touching objects or eating food that someone with the virus has handled or by having sex with an infected person.The disease doesn't always cause symptoms, but for those who do, they could experience fever, fatigue, nausea, loss of appetite, yellowing of the eyes, stomach pain, vomiting, dark urine, pale stools and diarrhea, according to the HHSA.The county and city of San Diego have taken several steps to address the outbreak, including the spraying of a sanitizing formula on streets and sidewalks, the placement of portable hand-washing stations and restrooms in areas where the homeless congregate, and the stepped-up immunization campaign. 2740

  

SAN DIEGO (CNS) - The San Diego City Council voted unanimously Monday to amend an agreement between former Mayor Bob Filner and the developer Carmel Partners over the development of an apartment complex that drew criticism.The development's current owner, Trea Blvd63, LLC, sought to nullify the agreement, which required the development's owner to rent apartments to tenants by the room rather than by the bed. When it was being built in 2013, opponents of the apartment complex argued that it more closely resembled a dormitory rather than the luxury units it was billed as.``I applaud my council colleagues for correcting these corrupt mistakes of the past, and moving forward from Filner's blatant misuse of power,'' Sherman said. ``This is a good reminder that big problems happen when elected officials abuse the power of their office.''Carmel Partners began work on the CentrePoint apartment complex, located in Rolando, in 2013. The city ordered the stoppage of construction of the complex, citing the need for additional construction permits. According to City Councilman Scott Sherman's office, Filner also ordered San Diego's Development Services Department to not conduct inspections on the development's completed phases, keeping construction workers from continuing with the project.At the same time, the Rolando Community Council demanded that the CentrePoint project, and the developers of any other new projects in the area, pay for improvements to the neighborhood. The CentrePoint development offered to pay 0,000 for improvements.Then-City Councilwoman Marti Emerald, representing the area, suggested that the project needed additional changes regardless of the funding. CentrePoint subsequently sued the city in U.S. federal court, arguing that Filner, Emerald and the rest of the city government had illegally stanched the development. The city and CentrePoint eventually reached a settlement, in which the development's backers.Sherman framed the dispute as an overreach by Filner and called it a victory for property rights.
