SAN DIEGO (AP) — A military judge on Monday took the rare step of removing a prosecutor accused of misconduct from the war crimes case of a decorated Navy SEAL.Capt. Aaron Rugh ordered Cmdr. Christopher Czaplak removed from the case of Operations Chief Edward Gallagher after defense lawyers accused the prosecution of spying on their emails, according to the ruling.The defense asked Rugh to dismiss the case or remove prosecutors because of a surreptitious effort to track defense emails without court approval in an effort to find the source of news leaks.Rugh said it was not in his power to determine prosecutorial misconduct, but there was the possibility of a conflict of interest that required Czaplak to be removed, the ruling said.Rugh has not yet ruled on whether to dismiss murder and attempted murder counts against Gallagher.Last week, Rugh unexpectedly released Gallagher from custody as a remedy for interference by prosecutors.The removal could delay the trial scheduled to start June 10.Republicans in Congress have rallied in support of Gallagher, saying he has been mistreated. President Donald Trump, who intervened to move Gallagher to better confinement, has considered dismissing the charges.Gallagher pleaded not guilty to murder in the death of an injured teenage militant in Iraq in 2017 and to attempted murder for picking off two civilians from a sniper's perch.It is extremely unusual for a military judge to remove the prosecution or dismiss a case only days before the start of a trial. SAN DIEGO (CNS) - A 28-year-old man was behind bars Friday on suspicion of stabbing his girlfriend multiple times inside a Colina Del Sol apartment, police said.Dispatchers received multiple calls shortly before 10 p.m. Thursday from neighbors who reported hearing screaming coming from one of the apartments in a complex on 49th Street just south of El Cajon Boulevard, San Diego police Officer Tony Martinez said.Officers responding to the scene found that a woman had been stabbed multiple times and the suspect had fled, Martinez said.The victim, whose age was not immediately available, was taken to a hospital for treatment of her wounds, which were not believed to be life- threatening, the officer said.Around 10:35 p.m. Thursday, the suspect apparently called 911 and told a dispatcher his location, and that he was going to surrender, the San Diego Union-Tribune reported.The 28-year-old man, whose name was not immediately available, was taken into custody around 10:45 p.m. on El Cajon Boulevard near El Cerrito Drive, Martinez said. 1053
SAN DIEGO (CNS) - A 41-year-old La Vegas man was killed when he crashed his motorcycle into a concrete guardrail on a freeway connector ramp in La Mesa, authorities said Thursday.The crash happened around 5:55 p.m. Wednesday on the connector ramp from eastbound Interstate 8 to northbound state Route 125, California Highway Patrol Officer Jeff Christy said.A man was riding a Harley-Davidson motorcycle when he allowed the bike to veer to the right and strike a concrete guardrail, Christy said. The impact ejected the rider off of the motorcycle, over the guardrail and onto the traffic lanes of westbound I-8.The rider, whose name was withheld pending family notification, was pronounced dead at the scene, the officer said. 735
