In the summer of 2013, Aimee Stephens sent her employer a letter explaining she was about to change her life. She was a transgender woman, and she intended to start dressing as such at work.She never expected then that she was about to enter into a yearslong legal dispute, one that might soon become a litmus test for lesbian, gay and transgender rights before the next US Supreme Court.Stephens had spent months drafting the message to management at R&G and G&R Harris Funeral Homes, a family-owned business in the Detroit area, she says. She was 52 years old at the time, and she had spent her entire life fighting the knowledge she was a transgender woman, to the point that she had considered ending her life.Now that she was coming out at work, she hoped her nearly six years of positive performance reviews, which had earned her regular raises, would count in her favor.But her boss, a devout Christian, told her the situation was "not going to work out," according to court documents. Thomas Rost offered her a severance package when she was fired, but she declined to accept it.She filed a complaint with the Equal Employment Opportunity Commission, the Department of Labor's enforcement agency, and the government sued the funeral home. The department accused the funeral home of firing Stephens for being transgender and for her refusal to conform to sex-based stereotypes.A district court agreed with the funeral home that the federal workplace discrimination law known as Title VII did not protect transgender people. But it found that the funeral home did discriminate against Stephens for her refusal to conform to its "preferences, expectations, or stereotypes" for women. The EEOC appealed.The 6th Circuit Court of Appeals ruled in favor of Stephens and the EEOC in March. The funeral home's lawyers accused the court of exceeding its authority by expanding the definition of sex in a way that threatens to "shift" what it means to be a man or a woman.In July, lawyers representing the funeral home asked the Supreme Court to take up the case to determine if transgender individuals are protected under Title VII's sex-based provisions. If the court takes up the case, it could have broader implications for the definition of sex-based discrimination. And it could impact case law that precludes firing anyone -- gay, straight or cisgender -- for not adhering to sex-based stereotypes."The stakes don't get much higher than being able to keep your job," said Harper Jean Tobin, director of policy for the National Center for Transgender Equality. "Harris Funeral Homes is a stark example of the job discrimination that so many transgender people face."Advocates say it's one of the most important current civil rights issues for the transgender community, along with similar considerations in education and health care. And they say it has been settled by years of case law. In the past two decades, numerous federal courts have ruled that federal sex discrimination laws apply to transgender and gender-nonconforming people, including Title VII, the Title IX education law, and Section 1557 of the Affordable Care Act.But lawyers from the Alliance Defending Freedom, the conservative Christian nonprofit representing the funeral home, say it's far from settled."No court or federal agency has the authority to rewrite a federal statute. That power belongs solely to Congress. Replacing 'sex' with 'gender identity,' as the 6th Circuit and the EEOC have done, is a dramatic change," senior counsel Jim Campbell said in a statement."What it means to be male or female shifts from a biological reality based in anatomy and physiology to a subjective perception. Ford beat Republican incumbent state Senator Mike Delph.As of Wednesday morning, Ford had a six-point lead on Delph for Indiana's Senate District 29.Ford is the first openly gay person elected to the Indiana General Assembly. "I think it's really time for us LGBTQ+ Hoosiers to have a voice in our General Assembly," Ford said.In 2014, Ford lost to Delph by about 2,300 votes for the District 29 Senate seat. Delph had been serving in the Indiana state Senate since 2005. In November 2017, he was sent to Puerto Rico to help with the recovery from Hurricane Maria. In 2014, Delph tweeted his frustration about a delayed vote on a gay marriage ban. Delph championed the ban, which included language that would also bar civil unions. Delph lashed out at members of his own party, the media and the "self absorbed Godless culture that is fast tracking our nation to ruin."LGBTQ Victory Fund, an organization that works to increase the number of openly LGBTQ officials in government, released a statement celebrating Ford's win.“The Rainbow Wave has arrived in Indiana in a spectacular way,” said Annise Parker, president and CEO of LGBTQ Victory Fund and the former mayor of Houston. “Tonight JD made political history in becoming the first openly LGBTQ person ever elected to the Indiana General Assembly – a milestone moment for a state that was one of the few to have never elected an openly LGBTQ state legislator."According to the LGBTQ Victory Institute, there are currently four openly LGBTQ elected officials in the state: South Bend Mayor Pete Buttigieg, Indianapolis City-County Council Zach Adamson, Monroe County Circuit Court Judge Elizabeth Cure and Monroe County Community School Corporation Board of Trustees member Sue Wanzer.Ford will be the fifth."Yes, this is a historical moment, but it's not about me," Ford said Tuesday night. "It's about the LGBTQ+ Hoosiers and generations to come that can be proud of what we attempted to do and did do." 2136

It is a county-approved program that is supposed to help you pay for energy efficient home improvements, but some homeowners blame the program for big tax increases they cannot pay. At least three homeowners who received financing through the PACE (Property Assessed Clean Energy) program say they were misled. The PACE program allows you to pay for home improvements, like solar panels, through your property taxes.  Maria Silva said her Del Cerro home is her life. “It’s very important… it’s my home for 28 years,” Silva said.  It is a home she is in danger of losing. Silva said it started with a man coming to her doorstep about two years ago. Silva said he offered a deal on home improvement projects like double pane windows.  At first, she said no. However, she said the salesman was persistent. For Silva, it was more than a money problem.  She is legally blind. She wanted to wait for her son.  “He told me well, this promotion ends,” Silva said of the salesman.  She said she told the man she was visually impaired, but he told her not to worry and he “was going to read everything for [her].” She did not want to miss out on what she thought was a good deal. At the time, Silva said she was told she would be paying no more than ,000 a year. Silva said she understood the payment would be going on her property tax, but when she got the bill, it showed an increase of more than ,000 this year.  “It seems very predatory,” said her son, Allan Silva.  On top of that, Allan Silva says the company who upgraded their air conditioning unit never removed the old one like promised. “It kind of seems like some shady things happened to my mom,” Allan Silva said. Carolyn Reilly with Elder Law and Advocacy has heard of deception with this program.  “They're telling them it's a free product, it's a free government program,” Reilly said. Reilly said loans are approved for seniors on fixed incomes who cannot afford them and she’s handling many cases from the elderly who say financing was not explained.  “They're desperate because at some point, it's going to lead to foreclosure for them,” Reilly said. One Poway woman, who did not want to use her name, said she wound up with a ,000 bill added to her taxes. She said A1 Solar sold she and her husband on solar panels, but she had no idea a lien would be placed on her home in addition to increased taxes. She also alleges that her husband was not the one who signed the documents. “I was not happy with the salesman coming in and going to the computer and signing Jim's name to the documents. I don't think Jim fully understood what was happening,” she said. Her husband, Jim, is dealing with numerous medical issues. Michele Glen is their caretaker and also signed on with A1 Solar. Team 10 examined the contracts, which say the amount would be added to the homeowner’s property tax. However, Glen said the salesman “rushed [them] through it.” “He says, everything is fine,” Glen said.  Team 10 called the salesman they say went to their home. He said he had nothing to do with A1 Solar and hung up before Team 10 could ask any more questions. According to the Contractors State License Board, A1 Solar’s license was suspended for multiple complaints, including misrepresentation to obtain a contract. A lawyer who worked for the company says A1 Solar is now out of business. San Diego County Supervisor Dianne Jacob said the PACE program has generated about 0 million in projects and has created thousands of jobs. She has received a few complaints, but believes overall, the program is working. “Frankly, if there are bad apples in the barrel, you need to get them out of the barrels,” Jacob said. She told Team 10 the county will continue with the PACE program because overall it has “been very helpful to a lot of people.” Experts at the Approved Home Pros, a contractor’s association, say the PACE program can be a good fit for some homeowners, but it is important to be educated before committing to it.  Recently, Governor Brown signed legislation that aims to provide more oversight and strengthen consumer protections with the PACE program.     4297
