The officer who fired the gunshots in a deadly swatting prank will not be charged as a Wichita, Kansas prosecutor ruled that the officer "acted reasonably," the Wichita Eagle reported on Thursday.Andrew Finch was killed on Dec. 28 after a prankster called the Wichita Police claiming that Finch was holding the caller hostage, and that multiple others had been shot. When police entered the home, they did not know at the time that the call was a prank. District Attorney Marc Bennett said Thursday that officers believed that Finch was reaching for a gun at the time of the shooting. Officers claimed that Finch was reaching for his waistband, and did not follow instructions to keep his hands up. "This shooting should not have happened," Bennett told the Wichita Eagle. "The officer's decision was made in the context of the false call."Finch was shot roughly 10 seconds after he opened the door. An autopsy confirmed that Finch was wounded by multiple bullet fragments, the Eagle reported. "The family's devastated and the family is disappointed by the decision of the district attorney today," Finch's family attorney told the Eagle. The mother of a Florida child who was punched in the face by an adult is wondering why the man was not arrested. “He was screaming at us, cursing at us, calling us the 'n-word' and he came down to the middle of his yard, and I was like 'who are you talking too,' and he said 'come within arm's reach and I'll show you who I'm talking to,'" said Malikai Villatte, the 12-year-old boy who was punched.  A picture of Malikai after the incident showed his two front teeth were knocked out. The young boy also received stitches to heal a gash on his mouth. “When I realized my teeth were dangling in my mouth it was kind of shocking, I didn't know what was going on," Malikai said. “It was like a nightmare, I just knew I had to get there and I had to get there fast," said Malikai's mother Brittany Graham. His parents are upset because the man who punched Malikai was not arrested. Lataevion Graham, 13, says he witnessed the incident and claims Cerfalo spat on them after punching Malikai. Graham's father says he wants justice for the children. “Where it is okay for an adult to take the law into their own hands, and to strike a kid hard enough to knock out his teeth. Where is that acceptable, in what country is that acceptable?" said Larry Graham. According to a Charlotte County Sheriff’s Office incident report, the man who punched Malikai was 27-year-old Vincent Cerfalo.“Originally this is where the altercation took place, right here," Cerfalo said.“I told them to back off and if they come on my property I'm going to defend myself. They said, 'you won't hit us, you won't hit us,' and they started to surround me," said Cerfalo. He says it all started when he yelled at the kids to get out of the road because they were blocking traffic.A cellphone video captured the moments after Malikai was punched. Cerfalo claims he was acting in self defense.“He touched me and I lifted my hand out, and I ended up hitting him. It was not my intention to hit anybody that hard, it was not my intention to knock teeth out or do harm, or cause any kind of trouble,” Cerfalo said.The children say no one touched Cerfalo at any time during the incident. Cerfalo says he never expected things to escalate to violence. He now plans to press charges against 12-year-old Malikai for assault, which the child’s parents can’t understand. “He's not going to jail, nothing is happening to him and he's basically getting away with it right now," Malikai said.“I want the man in jail," said Brittany Graham.  The case has been sent to the state attorney’s office, which will determine if a summons will be issued to Malikai for assault.  2750

The parent company for Gap and Banana Republic announced Friday that they would close more than 225 stores globally to "further advance its long-term strategic priority of a smaller healthier fleet."The closures are expected to occur this year with more stores closing in 2021, Gap Inc. said in its earnings report.According to the New York Post, many of the stores closing are located in malls.Also stated in its earnings report, the company closed 25 Old Navy's, 87 Gap's, 50 Banana Republic's, two Athleta's, one Intermix, and eight Janie and Jack stores in the quarter ending Aug. 1.Aug. 1 had 3,814 stores worldwide, which is 100 fewer stores that they had on Feb. 1, which was 3,919.Due to them temporarily closing their stores due to COVID-19, the company stated that they began the quarter with an 18% decline in net sales. 839

The NFL is further limiting player access to team facilities as it attempts to enhance safety measures during the pandemic.In a memo sent to the 32 clubs and obtained by The Associated Press, teams must close their facilities for two days after games, with some exceptions.Beginning Monday, all teams playing on a Sunday must close those facilities for the next two days.Only players needing medical attention for injuries or in rehab programs may enter the team complex.Coaches can access the facility but must work in their own offices and can't conduct meetings except virtually.The Associated Press reported that players that play on Monday couldn't access their facilities until Thursday, and facilities must remain closed until Sunday to players who play Thursday.According to USA Today, who was the first to report the memo, the league is also lifting its 62-player road game limit for teams, which will allow teams to fill its 48-man gameday roster with practice squad players in case issues arise with the coronavirus.
