CARLSBAD (CNS) - Attorneys for the alleged victims of a former Carlsbad military boarding school headmaster whose molestation conviction was overturned last week by a state appellate panel asked the San Diego County District Attorney's Office Wednesday to appeal the ruling or retry the case against him.Jeffrey Barton, 62, was convicted in 2017 of five felony counts of forcible oral copulation and one felony count of forcible sodomy for allegedly molesting a cadet at the Army and Navy Academy beginning in 1999, when the alleged victim was 14 years old.Barton was sentenced to 48 years in state prison.A three-justice panel from the Fourth District Court of Appeal agreed with Barton's contentions that the trial judge should not have dismissed one of the jurors during the trial and reversed the conviction on Friday.RELATED: Appeals court reverses molestation conviction for former Carlsbad boarding school headAttorney John Manly, whose firm represents four alleged victims in civil suits filed against Barton and the academy, said, "We disagree with the ruling of the court of appeal. Jeffrey Barton is a serial sexual predator who is known to have sexually molested at least six boys in horrific ways. The evidence against him is overwhelming and we ask District Attorney Stephan to appeal this decision and, if necessary, retry this case in the interest of justice and public safety."So far, two of those civil suits have been settled and two are pending.A District Attorney's Office spokeswoman said, "We have contacted the victims who testified in the case and are working to provide them support. At this time, we are exploring our appellate options, which include retrial."The convictions came in Barton's second trial.In his first trial, almost two years before, a different jury deadlocked on the charges involving the alleged victim.Two other former Army and Navy Academy students testified in the first trial that they were molested by Barton, but the defendant was acquitted on all but one of the counts involving those victims.The appellate panel ruled that Barton's second trial could have concluded differently had one juror not been excused, allegedly for refusing to deliberate with her fellow panelists.The justices wrote in their ruling that the other jurors appeared to disagree with Juror No. 12, but did not provide enough of a showing that she was actively stalling deliberations.The ruling indicates the juror did not appear to find the alleged victim credible."The trial court's error in discharging Juror No. 12 warrants reversal," the panel wrote. "She was the lone holdout juror who consistently held to her belief Barton was not guilty and, had she remained on the jury, it is reasonably probable the case would have ended in a mistrial, a more favorable result for Barton than conviction."The panel wrote that Barton was convicted "within hours" of the juror being discharged. 2921

  

CHANDLER, Ariz. - A woman in the East Valley of Arizona was stung by bees more than 200 times and a few fellow runners just happened to be in the right place--and the right time--to help.Usually cooler weather keeps bees away, but with more trees and flowers in bloom after the recent rain, experts say the bees are sticking around."I was taking my dog out for a walk, it's a normal route," said Marisa Brazil.Her daily routine along Paseo Trail in Chandler took a terrifying turn Monday morning."She was starting to flail her arms and I kind of looked at my best friend, Julie, and said, 'she's either having a really good time or something's happening,'" Brazil said.It did not take long for both women to realize something terrible was happening to the runner ahead of them on the trail."She was really screaming, like loud," said Julie Sternberg. The trained lifeguard ran to help while Brazil called 911."I tried to run up the other side and then some bees came at me," Sternberg said.Sternberg was stung on her head as the bees forced her back. She then saw two other strangers battling their way forward."They kept retreating. So at that point once I figured out there was bees, I figured out that's why. I saw one guy kept moving back," said Sternberg. "She was still screaming the whole entire time, so it was pretty scary," said Brazil.First responders eventually took over. The woman who was stung posted to Facebook from her hospital bed, thanking the strangers who tried to help. The woman who was stung is expected to recover. Her family said she was released from the hospital Monday afternoon.Now Brazil is warning others to be on alert."Just letting people in my community know that there is something going on there," Brazil said.A technician at The BEEHIVE Bee and Wasp Removal in Gilbert said if you find yourself surrounded by a swarm, swatting is the worst thing to do because that only agitates the bees. He says the best thing to do in a similar situation is remain calm, cover your face and nose, and run as fast as you can away from the area. 2126

  

CARLSBAD, Calif. (KGTV) — Three people were treated for gunshot wounds and one person was taken into custody in Carlsbad following a shooting Saturday morning.Carlsbad Police responded to calls of shots fired at the Pacific View Apartment Homes complex in the 5100 block of Whitman Way just before 6 a.m.Officers arrived to find a man and woman with gunshot wounds in a courtyard area of the complex. Both were treated by Carlsbad Fire crews and taken to a nearby hospital.MAP: Crime happening in your neighborhoodPolice later located another man with a gunshot wound in the apartment complex. He too was taken to a nearby hospital for treatment.Carlsbad detectives were on the scene Saturday investigating the shooting. They believe the three knew each other and the shooting was not a random act.Police said one person is in custody but did not say whether that person was one of the three who were shot. Investigators don't believe there are any outstanding suspects. 998
