Kyle Rittenhouse's attorney has filed a motion to dismiss two charges late Tuesday.According to court records, they seek to dismiss Possession of a Dangerous Weapon by a Person Under 18, and First Degree Recklessly Endangering Safety, Use of a Dangerous Weapon.Rittenhouse is facing a total of six charges, including two counts of 1st-Degree Reckless Homicide after prosecutors say he shot and killed two people and wounded a third during protests in Kenosha.Attorney Mark Richards argues in Tuesday's filing that possession of a dangerous weapon by a person under 18 should be dismissed because "the complaint [filed against Rittenhouse] fails to allege facts which could allow a reasonable person to conclude that a crime was committed."In regard to first-degree recklessly endangering safety, Richards writes that "no reasonable person could find that this crime was ever committed. Thus, the criminal complaint is defective and Count 2 should be dismissed." BOULDER, Colo. — The COVID-19 outbreak at the University of Colorado Boulder is now the largest in the state, with 1,198 positive cases among students and 104 with probable cases of the virus, according to the latest outbreak data released by state officials Wednesday.Twelve staffers have tested positive for COVID-19, according to the data.CU Boulder on Wednesday switched to fully-remote classes for at least the next two weeks, as university officials work to curb the spread of COVID-19 among students, with cases on the rise and isolation spaces dwindling on campus.Philip DiStefano, CU Boulder chancellor, said in a statement Monday that the move was "in the immediate interest" of the campus community's health. Students are being asked to remain in university housing, and employees will work remotely, if possible.University provost Russell Moore said in a news conference Monday that officials have seen fewer COVID-19 cases in recent days, but "unfortunately, the number of cases is not dropping enough."Students can now face a 10-day suspension — or longer — for violating COVID-19 protocols. Interim executive vice chancellor Patrick O'Rourke said 14 students are currently suspended as they go through the discipline process for health violations. The increased enforcement, O'Rourke said, has led to some change in behavior among students off campus, with fewer violations over the weekend.CU Boulder wasn't the only university to appear on the state's updated outbreak list Wednesday, though it was, by far, the largest.Eight outbreaks were reported at the University of Denver, including several sororities, the gymnastics team and a residential building. The case numbers in those outbreaks ranged from 3-9.Two sororities and a fraternity at Colorado State University also reported outbreaks, with the Kappa Sigma fraternity having the most cases at 13 confirmed and four probable. While Colorado has seen a large spike in cases among 18-25-year-olds over the last two weeks, State Epidemiologist Dr. Rachel Herlihy said there was also “concerning” increases among other age groups that are more vulnerable to more-severe bouts with the virus.“Even among other age groups, we’re seeing rapid acceleration of the virus,” Herlihy said.She and Gov. Jared Polis said that the increases in cases – 12 of the last 14 days have seen increasing case numbers in the state – were similar to the spike seen after the July 4 holiday but that they were still investigating the exact cause and if the Labor Day holiday gatherings were attributable.But Polis also said that it was possible that Coloradans had again reduced their caution in wearing masks, staying 6 feet apart and not attending large gatherings. ARLINGTON, Va. – Within an hour of a food bank’s opening came a delivery organizers have been counting on: frozen chicken by the pallet. “Two weeks ago, we began preparations for the future,” said Charles Meng, director of the Arlington Food Assistance Center in Virginia. Meng remembers the last time they encountered a sudden spike in need – right after 9/11. “We saw a very significant increase at that time,” he said. “And so, this is just that on steroids.” The center typically serves about 80,000 pounds of food to 2,400 families a week. One-third of those they help are children under 18, but the numbers are starting to climb. “We expect to see is many more of those families come to us. That's really going to be the first bump up,” Meng said. Like many food banks across the country, the economic conditions brought on by the coronavirus are stretching their resources and those of families all over the country. “It will last them until we come back on Friday and I don’t have to worry about what they’re eating,” said one parent, Sarah Baldrick, who was in Ohio picking up food, during a distribution at a local school there. There is some cause for concern, though, when it comes to food bank donations. So far, the food assistance center says they are still getting help from corporations, companies and individuals. However, they are seeing trouble from some supermarkets. “That amounts, in our case, to about 40-percent of the food we distribute -- have all but dried up,” Meng said of the food bank’s supermarket donations. “So, we're going to have to significantly increase the purchasing of food for our families.” That means they now have to count on monetary donations to buy food for those in need, at a time when people’s pocketbooks are taking a hit. “I'm relying on the generosity of this community,” Meng said. “We all have a need to survive this time.” It is a time that’s now filled with uncertainty.For more information on the Arlington Food Assistance Center, 2004
