SAN DIEGO (KGTV) - A man from El Salvador has been granted asylum in the United States after having been sent back to Mexico to await his trial.According to his attorney, Narciso Cruz, the man is only the second person to receive asylum who had been sent back to Mexico due to the Trump administration’s Migrant Protection Protocol (MPP.)“This individual is a bit of a rarity,” said Cruz, referring to his client’s success in court.But his story is not a rarity.Marcos fled violence in El Salvador and did no want to use his full name for this story, still fearing the gang he fled in El Salvador.“They’re a terrorist group,” said Marcos.He became targeted earlier this year after he tried to help his cousin who was being recruited by the gang. After he interfered, he started receiving death threats.“They will kill you and your entire family,” he said.He traveled to the United States, crossing the border on June 25 somewhere near Tecate.He said he wandered in the desert for five days before he was eventually picked up by Border Patrol agents and taken to a holding facility. Within a day he said he was sent back across the border to Mexico where he would wait for his case to be heard.The Trump Administration implemented the MPP in January. Despite some pushback from the courts, the policy, also called “remain in Mexico,” was allowed to go forward.As of September 1, the U.S government has sent 42,000 asylum seekers to Mexico, according to the Department of Homeland Security.As for Marcos, his case is not officially done yet. The government reserved its right to appeal the court’s decision. They have until October 25 to file an appeal. 1659

SAN DIEGO (KGTV) -- A local father is recovering from stab wounds after getting attacked by an intruder in his home. The man's 20-year-old son shot and killed that intruder according to San Diego Police. It happened just before 6:30 Tuesday morning at a home in the 6300 block of Lake Shore Drive in San Carlos. Neighbors heard the violence. "I heard the gunshots, it was like three or four gunshots, then screams for help immediately after," said Denise Rolla. When police got to the home, they found the suspect dead in the pool and the 54-year-old homeowner with stab wounds to the upper body. Police say the homeowner's son shot and killed the intruder, who stumbled out the back and landed in the pool. "I heard what turned out to be the suspect fall into the pool and then a couple minutes later, you could see the blood start to spread out through the pool," said Andrew Grogg, who lives right next door. There are walking paths and Mission Trails Golf Course is located behind the homes which are just southwest of Jackson Drive. Neighbors say they don't have a problem with transients in the area, but police say so far, it appears the 38-year-old suspect is homeless. His name hasn't been released. The family owns a tire shop in La Mesa. They are well known and liked in the community. "They're local business owners in the community. They're great neighbors. They're kind, they're nice," said Grogg. Police say so far, the attack appears to be random. 1472

SAN DIEGO (KGTV) -- A new poll shows what Californians thought of President Donald Trump’s address to the nation Tuesday night. During the address, the President made an appeal to the American people on border security and a proposed border wall. Of 1,000 people asked for the 10News/Union Tribune poll, 35 percent say they watched the address while 32 percent say they didn’t. Of those who saw the address, a majority say they believe most of what the President said is false, while 23 percent say it was a mix of true and false. 539

SAN DIEGO (KGTV) -- A local group called the San Diego Rapid Response Network is calling on the community to help asylum-seekers being released throughout San Diego County. On Monday, the group held a press conference explaining how they have been helping the migrants as they are released by ICE, awaiting their asylum hearing. The network is made up of several local churches, the local ACLU, and Casa Cornelia. Volunteers say they have been helping migrants by providing shelter, food, and medical services. They say they've also made travel arrangements to help the migrants get to their final destination. Volunteers tell 10News the migrants are released with no resources and sometimes late at night. The group says they felt the need to help after ICE ended their policy of connecting the migrants with a family member or a sponsor before their release. ICE tells 10News they always plan for releases during the daylight hours but say sometimes things can get delayed since it is a multi-agency effort. They told us of only one instance where the group was released after sundown. The rapid response network is hoping the community will help with monetary donations so they can continue providing their services. SAN DIEGO (KGTV) -- A nightmare of an opening week is continuing for an Ocean Beach tattoo shop. First, around 4 a.m. Saturday, surveillance video shows a man igniting an explosive against the window of Blackwater Tattoo Studio. Then, Sunday around 11:30 p.m., another man rides by on a skateboard, throwing a battery like cylinder through the same window. The owner, Mike Kellerman, shared surveillance video with 10News of both incidents. RELATED: Increased police presence in Ocean Beach following series of crimesThe first video shows a man skateboarding to the front of the business, taping something to the front window, and lighting it on fire. Moments later, the device explodes and blasts a hole in the window. "I expected the first one; the second one kind of pushed the limit," Kellerman said, adding he is not going anywhere.
