OCEANSIDE (KGTV) -- Multiple customers said a North County rental company refused refunds during the pandemic and only offered a full credit toward a future stay in exchange for removing negative reviews online.Lisa Janson is one of those customers. She lives in Pennsylvania and was excited for her March trip to California with college friends. Janson was first planning to stop in Palm Springs to spend time with her son and his family before driving to Oceanside.Once in San Diego County, they planned to stay at a property managed by Beachfront Only. The company operates several rental properties along the coastline.As the situation with the Coronavirus worsened, Janson canceled their March trip. They were able to get refunds on their flight and Airbnb in Palm Springs; however, she said when it came to their rental, Janson said the business did not budge. "I was just absolutely shocked. I was dumbfounded," Janson said.She first asked for a refund on March 10. She said all those traveling were older than 65-years-old. One of her friends also had a doctor's note, urging her not to travel because of her compromised immune status. Even with that information, Janson said Beachfront Only would not make any exceptions.She lost more than ,000. Others contacted Team 10 about similar experiences with Beachfront Only. One San Diego man said he lost more than ,500. Another woman said she had to cancel her wedding due to the pandemic. Beachfront Only was the only business not to issue a refund. She lost more than ,000.A week and a half after Janson first reached out to Beachfront Only, she said the company offered her a deal."We're going to offer you a 50 percent credit toward a future rental," Janson said. "This was probably our 10th email back and forth. The idea of renting with them…. I don't trust these people!"On April 6, Janson said the company decided to offer 100 percent full credit towards a future stay contingent upon removal of any negative reviews that may have been posted, and the bank dispute has been canceled." "It just pisses me off," Janson said.When you visit Beachfront Only's Yelp page, a "consumer alert" warning pops up saying Yelp "caught someone red-handed, trying to pay someone to write, change, prevent, or remove a review for this business." Team 10 spoke to three people who said Beachfront Only offered 100 percent credit on a future stay only if they removed a negative review.Legal analyst Dan Eaton said a business compensating someone to remove a negative review is not illegal, but could have long-term effects."Businesses should understand that what they do will have a reputational tail that lasts many months, maybe years beyond the pandemic. People are going to remember what businesses have done," Eaton said.Beachfront Only did not respond to Team 10's calls and multiple emails. "I'm not wishing anything bad on them. We would just never rent with them again," Janson said.Janson said she is working to dispute the charge with her credit card. 3021

Oceanside’s Flying Pig restaurant had a wait for tables last Friday.On the surface, that sounds like a dream scenario.But owner Roddy Browning says sales just didn't match the demand.“Our capacity is just cut so much, there's just no room for that heavyweight labor when you don't have the capacity,” he said.It's because of social distancing restrictions.Browning recently reopened The Flying Pig and his Vista restaurant - Town Hall Public House - with seating cut in about half.He's working his way back after having to layoff much of his staff when Coronavirus restrictions first took effect. In all Browning had about 60 employees at his two restaurants before COVID.Now, he's hired about 25.He says challenges go beyond the finances.Browning says he and other restaurant owners are having trouble filling jobs in the back of the house.And there have been isolated incidents where people have refused requests to wear masks - taking their money elsewhere.Browning says he wants people to understand why masks are required.As for surviving, Browning says he'll just have to make it work. 1099

OCEANSIDE, Calif. (KGTV) - Therapy dogs are tasked with healing patients who are up against diversity. But two who walk the halls of Tri-City Medical Center have their own stories of survival."I think every one of us, animal or human, has our own story. We all have our trials and tribulations. And so I think having animals that have been through some difficult times helps them relate with our patients in a much more profound way," said Aaron Byzak, Chief External Affairs Officer for Tri-City Medical Center.Two veterans of the Pet Therapy Program are Prince the poodle and Calamity Jane the golden retriever, one a cancer survivor and the other a trauma survivor. "She's a very strong, strong, little pup, she's got a mind of her own," said Shar Pauley, who rescued Calamity Jane. "And she tells me which rooms she'd like to visit. Sometimes she'll walk down that hallway and then she'll stop and say I think this person needs a visit." The program has been comforting patients for over 20 years now."He's had nine lives, and I think part of his motivation for giving back is he just loves to work, and he loves people," said Mary Gleisberg, Prince's owner. OCEANSIDE, Calif. (KGTV) — Oceanside Police Chief Frank McCoy wrote a letter to Oceanside residents saying he was concerned after watching a video of one of his officers tasing a man to the ground. The letter comes after the department released body camera footage, just two days after the incident. Chief McCoy has since asked the Professional Standards Unit to review the case.A man topples to the ground after being tased by an Oceanside police officer. On Tuesday afternoon, officers learned about a man armed with a knife, punching, stabbing, and attempting to carjack several people in the Mesa Margarita neighborhood. When officers arrived, they found the suspect, David Avila.In the video released on the department's twitter page, you can see two perspectives of the incident. One was from the body camera of the officer who deployed his taser. The other was a cell phone video, shot by a citizen.During a heated altercation, the video shows Avila with his hands up, kicking what looks to be a knife towards the officer in front of him. At the same time, the officer switches to his less-lethal option, the taser."Stay back. Stay back! Down on your knees!" the officer yelled.Avila then takes two steps toward the officer, stops, and is then shot by a taser.Two days after the incident, McCoy not only released the footage but said in a statement, "I have had the opportunity to review this video and it has raised concerns to me."Retired San Diego Police lethal force instructor, Ray Shay, says it could be that the officer tased the suspect who already had his hands up, from the front. Under the department's Policy and Procedures Manual, it states:"A TASER should be aimed at a suspect's upper torso and, when tactically possible, should be aimed at the suspect's back. This provides a larger target and avoids possible injury to a suspect's eyes. (Revised 07/01)"However, Shay believes this was justified."With the taser to the front, and then lethal option behind him, and the bean bag option to the left, in this challenging circumstance, the officers did the best they can do to safely take the suspect into custody," Shay said.Barry Pollard, formerly with the San Diego Citizens Advisory Board on Police Community Relations, says what bothered him was what happened as officers subdued Avila."You would think, in these days, nobody's knee would come close to the neck are," Pollard said. "It looked like a reaction is what it looked like, then he caught himself and moved his knee."However, Pollard says because the knee was not directly on the neck, he does not see this as a blatant violation.ABC 10News reached out to Oceanside Police to see exactly what parts of the video concerned the Chief. (KGTV) - Whale watchers enjoyed a rare encounter off the Southern California coast Monday: four orcas teaming up to prey on dolphins. “It’s very, very rare,” said Oceanside Whale Watching manager Carla Mitroff. The company had a boat full of whale watchers off San Clemente when the orcas appeared. Boat Captain Shane and staff biologist Lauren Turley captured the moment. “They were thrilled beyond thrilled,” Mitroff said of the passengers. “It’s the holy grail of whale watching.” The Eastern Tropical Pacific orcas pass through Southern California after a stop in Mexico, Mitroff said. The whale watching team hasn’t seen orcas in more than a year. Monday, the orca pod preyed on two baby dolphins as the mother tried to fight the killer whales. It's not unusual for orcas to eat larger mammals.“The diet of orcas depends to some extent on what is available where they live,” according to the National Oceanographic and Atmospheric Administration. One ecotype of orcas in the Pacific Northwest eats fish, while other ecotypes eat marine mammals and squid. Killer whales are “considered a top predator, eating near the top of the food chain.” 1171
