SAN DIEGO (CNS) - A transient who allegedly overpowered a woman in the East Village, dragged her into some bushes and sexually assaulted her before running away pleaded not guilty Tuesday to three felony charges, including assault with intent to commit rape.Gary Ryan Cushinberry, 51, who is on felony probation for robbery and failing to appear in court, was ordered held without bail.Late on the evening of Nov. 5, Cushinberry allegedly grabbed a 26-year-old pedestrian walking by herself in the 400 block of 13th Street, pulled her off the sidewalk and assaulted her before fleeing.Detectives identified Cushinberry -- a recent transplant from Indiana who has been living on the streets of San Diego -- as the alleged perpetrator by means of ``several tips and leads,'' Lt. SAN DIEGO (CNS) - Authorities Tuesday were working to determine what led to the death of an inmate at the San Diego Central Jail. Deputies conducting a security check at the Front Street detention center found 26-year-old Ivan Ortiz of San Ysidro unconscious in his cell about 3:45 p.m. Monday, according to sheriff's officials. ``Deputies and medical staff performed lifesaving measures until paramedics arrived and transported Ortiz to the hospital,'' Lt. Michael Blevins said. Physicians pronounced Ortiz dead about 4 1/2 hours later. Ortiz had been arrested by San Diego police last June on suspicion of attempted murder, assault with a deadly weapon and felony vandalism. A criminal complaint alleges that he attacked two people last June 6 with a skateboard, and attempted to kill one of the victims, though specific details on the alleged attack were unavailable. He also faced two counts of assault with a deadly weapon -- a skateboard -- as well as three counts of felony vandalism regarding alleged incidents on May 10 and June 9, and a misdemeanor count of resisting arrest. At the time of his death, he was being housed alone in a psychiatric observation cell. The county Medical Examiner's Office will conduct an autopsy to determine the cause and manner of Ortiz's death. SAN DIEGO (CNS) - A wrongful death lawsuit was filed Monday on behalf of the family of a 24-year-old woman who died last fall at the Las Colinas Detention Facility in Santee.Elisa Serna died Nov. 11, 2019, a few days after she was booked into the county jail.Earlier this year, the sheriff's department said Serna died from complications of drug abuse, with a contributing factor of early intrauterine pregnancy.The lawsuit filed in San Diego federal court alleges jail staff were aware of Serna's substance abuse and subsequent withdrawal symptoms, but did not provide her with treatment. Though Serna was fainting, had low blood pressure, was vomiting regularly and displaying odd and incoherent behavior, jail staff "ignored the obvious signs of medical distress" and "failed to provide proper medication as Elisa's condition was worsening," the complaint alleges.Sheriff's officials could not immediately be reached for comment on the suit, which names San Diego County and Sheriff Bill Gore as defendants.Plaintiffs in the suit include Serna's parents, Michael and Paloma Serna; her husband, Brandon Honeycutt, and a minor child referred to as S.H.The sheriff's department has come under fire recently over a spate of deaths among county jail inmates, which were referenced within the complaint.The lawsuit cited news reports indicating the county had the highest jail mortality rate among the state's largest counties, and said prior deaths from inmates suffering from withdrawal symptoms should have made jail staff aware of the potentially fatal consequences of those symptoms.The suit also alleges staff are inadequately trained and in-custody deaths at county jails are not being properly investigated."Even though inmates are dying or suffering catastrophic injuries at an alarming rate at San Diego County jails, the medical and correctional staff whose actions or inactions cause the deaths are not investigated; not informed of their failures; not given further training or remedial instruction; and are not monitored or closely supervised after these adverse events," the lawsuit alleges. 2111

SAN DIEGO (CNS) - County health officials announced Thursday that flu activity remained steady over the last week but confirmed flu cases are still three times what they were at this time last year.The county's Health and Human Services Agency confirmed only 36 flu cases over the last week, bringing the county's 2019-2020 flu season case total to 335. The county had confirmed 109 cases at this time last year.Only two residents have died due to flu complications since the county's flu season started July 1. At this time last flu season, the county had not recorded a flu death.County health officials expect flu cases to spike as the year approaches the holiday season and gets deeper into autumn and winter."The holiday season is right around the corner," said Dr. Wilma Wooten, the county's public health officer.
