WINTER HAVEN, Fla. — The Polk County Sheriff's Office is conducting a death investigation after an Uber driver shot and killed a man early Tuesday morning.During a news conference, Sheriff Grady Judd said that a bartender and patron at the Grove Lounge on US Hwy 27 in Dundee called for an Uber when they realized a young woman was in no condition to drive.As they waited for the Uber to arrive, the patron, Jessica, and her boyfriend, 34-year-old Jason Boek, were texting back and forth about him picking her up from the bar. When he refused, Jessica told him that she had found a ride and didn't need him to pick her up; in which he later replied after arguing with her:"I'm going to f***ing beat the f*** out of the Uber driver"Once the Uber driver, 38-year-old Robert Westlake, arrived at the bar Jessica put the intoxicated young woman in the car. Boek began following the Hyundai Elantra .thinking Jessica was inside.As the two continued on Dundee Road, Boek approached Westlake's Hyundai from behind and then abruptly passed and pulled in front of it.After jumping out of his F-250 pickup truck and approaching Westlake he yelled:"You know I have a pistol? Want me to shoot you?"Westlake, who is a concealed weapon permit holder and just finished police academy, reached into the pocket of the driver door, retrieved a handgun and shot Boek once in the chest. While officials in Puerto Rico placed the official death toll from last year's Hurricane Maria at 64, researchers from Harvard believe the death toll was actually in the thousands. According to Harvard's study, there were an estimated 4,645 deaths directly or indirectly tied to the hurricane, which struck the island in September. Harvard estimated a mortality rate of 14.3 deaths per 1.000 people from September 20 through December 31, 2017 in Puerto Rico. Harvard said in its study that it believes its estimate is rather conservative due to a "survivor bias."Harvard conducted the study by performing a random survey of 3,299 households in Puerto Rico. "In our survey, interruption of medical care was the primary cause of sustained high mortality rates in the months after the hurricane, a finding consistent with the widely reported disruption of health systems," the study says. "Growing numbers of persons have chronic diseases and use sophisticated pharmaceutical and mechanical support that is dependent on electricity. Chronically ill patients are particularly vulnerable to disruptions in basic utilities, which highlights the need for these patients, their communities, and their providers to have contingency plans during and after disasters."Part of why there the death toll might have been underreported is due to how hurricane-related deaths are counted. In order to have a death counted as storm related, bodies had looked at by a medical examiner, which required a body to be transported to San Juan, or the medical examiner to travel to remote locations. With a lack of electricity and blocked roads, some bodies were likely buried before the government could count fatalities. Maria is considered the third-costliest hurricane in US history.  1816

  

WEST PALM BEACH, Fla. — There were plenty of Palm Beach County residents opposed to a mask mandate. Now some of them are suing to stop it.A lawsuit filed Tuesday in Palm Beach County court seeks injunctive relief to overturn the county's order.Attorneys representing Palm Beach County residents Rachel Eade, Carl Holme, Josie Machovic and Robert Spreitzer claim the new order requiring that masks be worn in public places infringes upon the constitutional rights of the plaintiffs.The 37-page lawsuit, filed by the Coconut Creek-based Florida Civil Rights Coalition, argues that the plaintiffs and other residents are having their "well-settled constitutionally protected freedoms" violated, including their "constitutional and human right to privacy and bodily autonomy."The lawsuit goes on to say that the county, having no authority to do so under Florida law, "has recklessly required countless American citizens and Florida residents," including the plaintiffs, "to submit to dangerous medical treatments with well-known risks and potential for serious injuries and death, including being forced to wear harmful medical devices like masks."Palm Beach County commissioners unanimously voted last week in favor of the mask mandate to help prevent the spread of the coronavirus amid a recent surge in cases throughout the county and state.The lawsuit takes aim at the "ridiculously vague" language of the order, which attorneys for the plaintiffs claim forces residents and visitors "to guess at the meanings and be subjected to punishment and criminal consequence."It also chastises the order's exemptions "because it arbitrarily and absurdly discriminates against anyone over the age of 2 years old, and countless citizens" who don't meet the "unlawful order's vague and ambiguous exceptions."The lawsuit berates county leaders for not clearly defining terms like "businesses or establishments" and "persons" as it is written in the order."Are non-citizens included?" attorneys wrote. "One is only left to guess, which is why the unlawful order is void for vagueness."Attorneys for the plaintiffs argue that a permanent injunction "will serve the public interest.""Millions of Palm Beach County residents and visitors are burdened by the over-reach of their local government in a fashion not before seen in the history of Florida," they wrote, adding that residents are "unduly burdened" by this violation of their rights. "The public has a strong interest in protecting their rights and ability to control their own bodies in the workplace and in public."Palm Beach County State Attorney Dave Aronberg said during a news conference Friday that commissioners do, in fact, have the constitutional authority to mandate masks."Obviously, those individuals who claim that they know the First Amendment have obviously never read the First Amendment," Aronberg said. "Because it is within the authority of the County Commission to put forward a mask ordinance. They have the authority under state law. They have the authority under the Constitution."The lawsuit seeks expedited consideration because the order is currently in effect. A written response by the county is required within 20 days of the filing.Several studies show that a mask or facial covering limits the wearer from spreading airborne droplets when speaking, sneezing or coughing. WEST PALM BEACH, Florida — A Delta Airlines flight from Detroit, Michigan to West Palm Beach, Florida has landed safely after blowing a tire.Delta flight 1930 departed Detroit Metro Airport at 8:30 a.m. and landed at Palm Beach International Airport just after 11 a.m. Eastern.An airport spokesperson told WXYZ in Detroit that crews responded to a level two alert, which indicated a mechanical malfunction of some kind.Video shows the plane taxied safely to the gate where it was surrounded by emergency vehicles.No one was injured. It's not clear how many people were on the plane. 595
